🤬😤 Uber Lyft Restitution | Settlement of Crime

- The Massachusetts settlement has opened the eyes of many, just as the Minneapolis settlement showed us how the apps were bluffing when threatening the livelihood of a community. This is another video about CONTRACT LAW and how to understand/apply contract law when court orders and settlements expose the truth.

@Leeeeeeeeaaaaddd attorney here. HOPE you guys are doing well man!” 💪🏾💪🏾
That intro STILL epic! LOL! I don't have an intro. That one is unmatched! LOL! You know where you are when you hear that...and it's gonna be GOOD!
Uber and Lyft will be up Shits Creek if this ever elevates to a federal level and there's some type of blanket judgment that's made that will affect all 50 states. A smart company would get ahead of it and pay drivers what they're worth. But not these two companies. They are just going to deal with these matters on a state-by-state basis. In the meantime - convert, convert, convert!
Big win for the drivers !
The new law is a LOSS for the drivers. Now they're gonna be stuck with PROP 22. The $175 million settlement will put only a small amount of money in the drivers' pockets.
@@messagesend8239I think so, too. They're probably already planning how to screw the drivers and say, "oops, it was a glitch."
I wonder if the "Chevron deference" being overturned will affect the rest of the cases now. I need to research that.
Well, they said it was a win in NYC when they got the settlement, but look at the situation now. Independent contractors should be able to go online to choose to work in their city whenever they want. Now they get told when they can and can't be online. Wonder if something in the settlement allows that to be done.
I just got a Lexus es 300h and I’ve been using it on Uber and Lyft
And all of sudden Uber wants to send a notification that my vehicle was used to provide trips that were not accepted thru the driver app. Local regulations require drivers without commercial licence to use app. Like dam I don’t even have business card lol 😂
They SCARED! hahahahahaha! They see us coming! They know the 300 is out there getting paid the RIGHT way, not falling for their bullshit low fares. We do independent contacting and they making damn sure they train EVERYBODY to stay on the plantation. Their wages depend on our stupidity. We have the keys and the cars, so they need to understand who has the power. They're trying to control that power with these emails and messages. Fck them. Get your money.
@@MicDropBBQ yep its about to be really bad in Massachusetts August 15
Let me go ahead and join this membership because jeff know what he talkin bout and he is in it for the drivers! Keep speaking the truth
@Commonsenserideshare Appreciate you, brotha. Oh, I've got some REAL TREATS coming for that group. I wish I could put everything out here in the big group, but we got app-employees and haters trying to destroy what we're building. Anyone who's ready to build even STRONGER know where to find us. We're in that group, brainstorming and coming up with ideas out of the energy-path other the haters.
The one thing about haters: they wanna see us fail, so we don't have to worry about them paying a DIME to be in that group. Energy-shield! LOL!
@Commonsenserideshare Don't forget to order your We The 300 T-shirt! Pretty soon, you'll be seeing drivers in all 50 states wearing them!
I don't know if they will get as popular as Harley D's shirts, but ya never know? 🇺🇸
Love the intro 😅
That's my brotha @itsxmusic with the flow! Dude is one of the best artists out there, and he ain't caught a break yet. It's coming!
a few ppl lately replied "id feel safer on the app"
"okay cool, ill cancel and some other driver will be along shortly, g'bye"
Yup. That's the play. Funny how they claim they'll feel safer on the app, but they're using an app where drivers who haven't been background checked can just buy an account 30mins from some random person and use it. LOL!
Keep making that money Jeff!
You know I'm not stopping. This summer is slow enough to really drill into some business ideas I've had on deck. I'm actually working on it today, while I'm not driving.
That's terrific information, great video, and content. Thanks, Jeff🎉
Thanks, MG! We have to stay aligned with business. Anyone thinking they're an employee can think that. It's fine. But we're going for the money.
Right on!! We The 300! Nice touch, Jeff!❤❤❤❤❤
I'm working on multiple "300" projects right now, as we speak. This was just one of them that I finally got off the board. I wanted decals and I had to do some edits to where it would cut correctly with my machine. T hanks, Robin! We the 300, and when riders/drivers see it around town, they'll know we're not just drivers, but business owners that drive!

Thank You Jeffie for verifying everything I believe
They are criminals and when Mass brought up racketeering, Uber caved and ran for the hills.
Your words are very helpful
I have been in the game for 25 years
Contract law is what rules this industry, and many of us are from employee backgrounds. We're not used to business law, so that's why it's so important for channels to start diving into LAW and not just thinking we're employed by these apps. We're not employees. The laws are very different and we have RIGHTS that most employees don't have. We have the RIGHT to inform any rider of the details of the transaction, up to and including giving them an option that more feasible for them.
It's called a FAIR, FREE MARKET. We are not employed by the apps, so we have every right in this country to speak about what's going on and what the fare they just paid is for. When they find that it's 50% to 70% FEES and the drivers aren't getting paid much, they have a right to cancel the transaction if they see fit. It's THEIR right, as well as it is OUR right.
Enough said, keep it 100%
I'm telling you Ed...we don't mince our words around here. We know what we're seeing. We're not idiots on this channel. We speak it as we see it.
@@MicDropBBQ I cancelled 2 trips back to back yesterday and they put me on time out for 30min. I asked them why and got AI from hell, so i said agent and got a agent said I'm cancelling too much and i said if i have a medical issue where i need to attend to i cant cancel, he then said i shouldn't take the call then he then said he going to put theses notes in my file and making notes, i then said me too I'm keeping my notes and files too, here are some notes you can put in my file, Duress, Undo influence, Void, Voidable, Racketeering, Restitution i said try this again he then disconnected LOLOLOLOL
LMAOOOOOOOOOOO!! They know when it comes to law, they can't say shit. They'll run the moment legal terms pop up because they're instructed not to give ANY information when someone speaks in legal terms. They know their agents are not legally trained as to what these TOS really are about, so they have to disconnect or "escalate to another dept"....and that dept is "on hold forever". You'll never get to that dept, basically. LOL! It's just a sentence they say.
They are running scared because they know the jig is up and contractors realize we are NOT employees, even tho they treat a lot of these drivers like W2 staff. We have the right to make any agreement VOIDABLE, just as the TOS says Uber has the right to void any part of this agreement at any time, without notice. THAT makes it a voidable contract...which means BOTH parties have that same right, and we can't be deemed to BREACH the contract, as we agreed to make it voidable at any point in time, without notice to the other party.
@@MicDropBBQ Bingo! So when Dara coined the phrase, "Because We Can," he forgot that "Independent Contractors," not defined in the TOS, can stand up in a court of law, not necessarily having to go thru arbitration first, and say straight to his face, "WE CAN TOO!"
We're not playing his Dungeons & Dragons game.
Private clients are where it's at your personal library of clients, is how drivers will make a living
This is the direction of ride services. From ride SHARE to ride SERVICE, and anyone not doing SERVICES will be working for these apps for PENNIES on the dollar.
That's what's great about HUM, even though you didn't use their price
Yup. You can always get paid for time...and it's $1 PER MINUTE for congestion! Christian showed us last night! I was wondering why the price was so high! LOL! That means if we aren't moving, we go from getting $0.25/min to getting $1/min!!!
@@bighornkevin7103 we need HUM here in Detroit really bad now that Uber and Lyft are throttling me so bad
@@MicDropBBQAnd that equates to $60/hour if using employee thinking concept based on an "hourly wage." 👍🏻
Exactly, Robin. No other app allows our IDLING TIME to be viewed as an opportunity cost we're losing, and riders may have to pay for our opportunity cost. We could be working with a client getting paid nice tips and flowing thru traffic, and HUM make sure to consider that by giving us $1/min for "stuck in traffic time". I know the rider isn't responsible for the traffic, but neither is the driver. This ensure that drivers aren't scared to work during busy times, out of fear they won't be paid to get people to/from work because of not being paid to sit in traffic for 45mins...going nowhere.
On HUM, you're getting paid. The rider won't have to tip you, but they'll definitely pay you. And I'm one of the only channels that says I don't want tips if you're paying me well enough. I'm ok with that statement.
@@MicDropBBQ I think everyone is ok with that statement. When Uber first started, there was no such thing as tipping in the app. Drivers were paid decently. It's in the book, Uberland, published in 2018, by Alex Rosenblat. The whole tipping thing is a farce when you think about it. The same $1 getting passed around from waitress to driver to drive thru cashier is being taxed over and over again just because it went from one pocket to another. If someone wants to tip me outside of the app, so I do not get taxed on it in an NEC form, they can know right upfront that I'm grateful for that tip that goes straight into high gas prices, to be able to provide more pickups for more community members. Uber and Lyft pay us nothing for gas.
But I did hear that Henderson Deluxe Cab service (Las Vegas area) pays 1/2 gas for their drivers! LAS Rideshare Drivers should make a note of that if they're looking to drive, not use their own car, and not have to pay 100% of the gas out of their fares.
Bro I was shocked to see Leeeeead attorney bcuz I came across his channel 2 years ago when following the R. Kelly saga . Lead is a solid dude. Thorough attorney too! 💯
That's what I'm saying. The man is a LEGEND in the space, but also off CZcams, everyone knows him. Truly an honor to see him swing thru. He's not rideshare, so it's truly an honor when a true podcaster sees this channel pop up and actually listens in. Shows me that we're on the right track with life and energy, and he might critique a few ways we do things and bring some law in to the mix, but we know these TOS agreements are VOID and VOIDABLE, so I'm an independent contractor doing what I do, understanding what I understand about law.
Jeff, the Massachusetts Rideshare Law is a disaster for the drivers and massive coup for Uber. Instead of being paid Seattle pay rates and capping Uber's cut @20% the MA drivers get PROP 22!!! A $32.50 per active hour pay rate is pathetic.
I agree it is a pay cut lower than what we currently get under upfront fares in MA time and distance was best
@@GoGigItNowRon Why did you guys in MA allow this crappy law to get passed?
@@messagesend8239 we didn't Uber went behind and filed the agreement with the state instead of letting the voters vote in november
I wanna see how this plays out when the school year hits. Summer is not gonna show much from Aug 15th til then. Wait til after Halloween or Thanksgiving to really know how it affected money.
@@GoGigItNowRon It's obvious that Uber wrote their own law and "convinced" the governor and others to go along with it. What are the drivers and their organization saying about it?
Uber is throttling the hell out of me dog
What tier are you on? I think they're throttling lower tiers and forcing riders to pay for the upper tier rides where they can charge more.
In the words of Groucho Marx I would never want to be a part of a club that would have me as a member, LOL
Yeah i think the city of Minneapolis showed Uber and Lyft their game is up so when my Massachusetts hit em they couldn't handle it
They can't play the same poker hand twice in a row. Their bluff got called by MN and all of us drivers were like, "...just leave...bye...go for it." BLUFF CALLED, even when they had execs going, "...no, it's 100% guarantee we're leaving."
Where they at? Still in MN. BLUFF CALLED. Play that hand against a weaker hand. Drivers have more power than they think. We have some cards to play that we ain't even played yet. We just getting the game situated now.

3:44 i disagree. Even with the filtering of people with contractor quality values i think you will be a massive channel. I just don't know when. As they get sued, settle, lose profits, in turn lose big shareholders, raise prices, and lower drivers take people will seek your voice out my friend
Thanks, Fred. I just know that my channel is more about the business we're in and making sure we're not being played. We have attorneys and organizations that feel the same, as they fight the apps in court on our behalf. Yet, we have people who swing by the channel and don't feel we're valuable nor feel that we should fight for our value (or they just come thru to bitch about me). In any case, I kick those mfkas off the path and we keep moving forward. BLOCK BAAAAAAAN! hahahahahaha!
We have a space. This channel is that space. A lot of other channels seek subs at a certain quantity, and I send those people THERE because this channel may not be an energy-fit for them. They have to go do something with their day that makes them feel better about their existence. Fcking with me ain't gon help their day. I'll block em so they can go find something to do that benefits them.
@@MicDropBBQyou probably think I'm crazy, but I'm telling you it's 98% bots. These ai bots are more sophisticated than you realize
I think it's app-employees trying to persuade readers that this channel is not as powerful as it really is. We are onto something big, and I'm like a bloodhound in the woods. When I'm on the scent of something wrong, the AUDITOR in me comes out and I chase shit down til I get to the very bottom with no doubt about what I'm smelling. And I smell racketeering and crime.
@@MicDropBBQ bots are cheaper and can spread it way faster
Uber is throttling the shiz out of me. One, Uber is laid back on cancelation with no repercussions so those I convert all the time. Lyft I have it only on Black so I always take those no matter what.
I canceled a Black last night because they wanted me to go 7 miles WEST to pick someone up, then take them from West of DT Phx all the way to EAST GILBERT - for $44. That was like a 23 mile total ride!! For $44 on Black??? I know that person paid like $90 - 100 for that ride, and I wasn't risking driving 7 miles to be told NO. LOL! Had they been a mile away, I would've converted it. But 7 miles West of where I was? Nah...cool on that shit. These Black rates are getting lower and lower.
I turned Uber on to see what would come up and it was like $7 for 8 miles, damn near. All trip radar. 100% of my trips on Uber are trip radar. I haven't driven for them in almost 4 weeks now. LOL!
Well, it looks like I’m done driving for the criminal apps I was getting throttled Friday night on Uber then last night they were throttling me so hard. I was only getting one ping every 20 to 40 minutes when I should be getting 10 pings every 30 seconds. And then during the bonus hour for Lyft, they throttled me for the first 20 minutes of the hour, so instead of making $60-$80 I could only make 35. And then my dumb ass ventured outside of the city on a private ride and tried to get a private ride back and the bougie ass rich people got all pissed off and reported me to Lyft and that’s why I stay in the city where they respect the hustle.
I would much rather get deactivated than be throttled. This is some bullshit.
The only way I think people are being reported is if they're doing the rides. I cancel anyone that doesn't want the new deal and move on. I've been doing this for 5yrs and I've never been reported. If you do the ride AFTER you try to convert it, they have you linked as their "last driver" and they now can report you. Honestly, I wouldn't care if they reported me because I could always tell customer service how their TOS isn't an employment contract, but an IC contract which gives us the right to cancel for any reason....with ONE reason being "the pay is too low". That is a reason, whether they like it or not.
If they ask why did you accept it if the pay is too low, then tell them because you thought a TIP would make the trip better, but the rider indicated they didn't want to tip because the price was too high. Therefore, you knew you weren't getting tipped to offset the low pay, so you canceled.
Whether or not it's true isn't the issue. The issue is that the pay is too low and you have a right to cancel for any reason you see fit.
@@MicDropBBQ oh, I didn’t do the ride. I don’t do any rides that aren’t worth my time. They were already getting out whether I wanted them to or not, the one guy was being a jackass. I told him they’re trying to pay me a dollar a mile for this ride. It cost $.67 a mile just to operate the vehicle and he got all smart with me and said so go be a taxi. I did cancel the ride, but they must’ve canceled at the same time and I ended up getting two dollars for the cancellation fee then about 20 minutes later, Lyft message me saying that the passenger contacted them stating I would only do the ride for Cash and the TOS doesn’t allow Cash rides blah blah blah. And that was it. That was actually a lie. I never said I would only do it for Cash. I said we could turn it into a private ride or I’m gonna have to cancel because I can’t do it for what they’re trying to give me.
We the 300
@@MicDropBBQ i’ve got about a 95% success rate converting people to private rides even the people that don’t want to that I cancel. I asked them would you mind if I canceled and somebody else that doesn’t know how to do math came and picked you up in a few minutes and they’re fine with it. I tell them have a good day and they tell me have a good day. I am assuming that’s why Uber is throttling me so hard because I am so successful at converting private rides Friday night. They were giving me all the rides that they were lowballing it made it harder to convert, but I was still converting. I guess last night they had to try a different strategy only give me one ping every 20 to 40 minutes they also stopped giving me anything nearby. Most of the stuff they were sending me was like 5-10 miles to pickup 😂🤣😂

I ask them if they mind if I cancel and somebody else will be here in a few minutes that doesn’t know how to do math and they’re fine with it. I tell them have a good day and they tell me have a good day. I imagine that’s why I’m being throttled so hard by Uber because I am so successful at converting. Friday night they were even giving me all the lowball offers which made it more difficult to convert but I was still converting so they had to go to Plan B last night and just send me one trip every 20 to 40 minutes. @jonah426 double ya money that fast! The truth will set ya free!!
So has Uber ever lost a case, or do they always settle so there is no precedent?
Exactly! They don't go to court because they're scared of precedent being set. Once that happens, MILLIONS of contractors will have a case to refer to, and most cases won't be flipped over and over and over and over, each time it goes to a judge. We know that. Uber knows that.

Aye… $47 is still cool. 6 miles and under an hour… that’s a win all day long! $60 is even better!! If that was Uber that woulda been $15. The customer woulda been been charged $50 but insurance woulda been $40 while Ubers take rate woulda been $1. Congrats… you would have gotten 95% of the fare according to Uber mathin. 😂😂😂. What a great company model that treats the drivers fairly. I bet HUM would never give the driver 95% of the fare! 😂😂😂
LOL! Uber would tell the rider, "...you're pulling our CASH COW DRIVER off the road for an hour, so you've gotta pay $90 for the time and mileage"...then turn around and give the driver $15. LOL!
We're nothing more than CONDUITS OF CASH for these apps. We are slaves to their system of tech. They make riders think the prices they pay is for the service, when really the prices they pay Uber and Lyft are for the TECH and FEES of the tech. The driver isn't in the chain of value-added services. The driver is just the "earner' that earns whatever the app bills the riders for.
I go around the app. I am worth the money charged because I'm doing the ride, the cleaning of the car, the maintenance on the car, the insurance and car note on the car, and making sure I'm physically and mentally healthy to do the work requested. The app couldn't give two shits about all of that. You say the word "health insurance" and they laugh, as if our health doesn't matter.

yeah i'll be waiting to see what money i get.
Hope they pay up! Real talk. It's about time drivers get a cut of the profits and revenues we're out here generating.
