She fell and broke her wrist, so she’s suing for the assault and medical bills. The defendant says the plaintiff was drunk and violated her personal space, so that’s why she pushed her. She’s countersuing for lost wages.

The defendant…. Is clearly STILL deeply wounded by the fact that her own husband went behind her back, and spoke lowly of her to her best friend (plaintiff) apparently the best friend (plaintiff) didn’t IMMEDIATELY bring this information to her friend- and now the defendant feels betrayed by both her husband and best friend. - and both of these women need to apologize to one another. The plaintiff needs to apologize for meddling in her best friends marriage, and the defendant needs to apologize for taking her hurt/anger out on her when she should’ve been angry with her husband.

Because legally she wasn’t in fear of her life to use self-defense, hence why he asked that and why he stated she could walk away. An unwanted hug isn’t cause for physically force or bodily harm unless you feel threatened and she stated she did not. That’s why she’s at fault.

Yes it’s unwanted touching, however in order for it to be considered assault the victim would have to have perceived it that way and she stated she did not. An assault claim isn’t cut or dry it’s based on the presumption of the intentions behind it. She meant her no harm, but only to de-escalate her from further anger. I basically already broke this down. Your opinion vs the law/statutes are two different things. Now it could be considered HARASSMENT, but that’s after just one instance. If she kept touching her after repeatedly asking her not to, then there’s that claim. These are common types of assault verbal, simple, aggravated, and sexual. And they basically all are confirmed with fear even simple assault you simply fear you were about to be injured. AGAIN SHE HAD NO FEAR. You can’t just say something’s assault, there has to be basis behind it. And just like the defendant in this case. Your opinion isn’t correct or lawful love. With all due respect.
