- On Tuesday, when polling had ended in Karnataka the Election Commission wrote to social media platform X to take down an animated video posted by BJP Karnataka targeting Muslims. In similar violations of its model code by the ruling party, the EC has taken slow action. Why is the MCC not legally enforceable? Faye speaks to senior Supreme Court advocate Sanjay Hegde.

ECI is defunct or not fair in its duties. It favours BJP it looks like.
Before induction of EVMs,booth capturing was rampant and EC took no action. Cases filed in Courts took almost 5 years in deciding the cases.Atleast booth capturing has reduced to almost zero.
It's a hopeless situation and Hegde Saahab has only added to the hopelessness. We have no choice but put up with the carefree, devil may care 😅ways of EC.
NO NO NO, no nation has (and no dignified, strong, agile and alert nation will) to put up with such blatant and most serious acts against NATION's Future and Interest. Widespread demonstration throughout India by massive number of people will only force the situation to correct.

The ECI is not just a silent spectator, but, rather, as Ramachandra Guha said in his recent interview with Karan Thapar, it is "complicit" in this!!
The Election Commissioners are selected in such a way that they are subservient to the ruling party. For any action, they will be awaiting instructions from PMO.
Also please look into, why it took more than 10 days to release 1st and 2nd phase polls data

SC has asked the petitioner to directly approach the EC with regards to violation f moral code f conduct, .
It seems Supreme Court does not have power to overrule the EC.
SC has already observed that ECI is an independent constitutional body..
What's being reported in the media about ECI being unmindful and not taking actions against unlawful acts, speak volumes about ECI's biased behaviour!!

Agreed SCI cannot micromanage and Its the EC which has to be ensure no Model code is violated but If the EC does not take cognizance and decides to be delinquent and obsequious towards ruling party then what is to be done? It is evident from the incidents so far even to a person with an IQ of 50 that the EC is guilty of being partial, unfair and is looking the other way to all gross violations so wat is stopping the SC taking Suo Moto cognizance unless even the SC is complicit

It's surprising that the commissions and omissions in favour of a particular party there is no remedy under the constitution. whereas democracy, free and fair election is a part of basic structure of the constitution.

ECI is not that particular to oust BJP from power like the opposition parties, many of the journalists, most of the social media platforms, some bureaucrats, senior lawyers writers,urban nexalites, social workers, jihadis, comminists, INDI alliance, etc etc. That is the reason even flimcy matters are taken seriously and feel ECI is not doing the right thing at the right time.
But to have equally efficient organisation like bjp rss combine will take massive time and by then we will end up into deepest shit , unimagined yet.
