What are your thoughts on this?
It almost seems like the system is made for you to give up. Vets get dragged through all the red tape for the system they upheld.
Absolutely correct J dawg! File yourself! Represent yourself!
Great seeing you Nick!
Today i received my 2nd denial for a claim with supporting documents covering everything in the DBQ I waited 6 months and was sure i would get approved. Im pretty pissed about it, but i gotta do it again. For all the crap I've done just to get denied by someone that has never enlisted ain't gonna stop me.
My VSO tried for to tell me for half an hour that I didn’t have a claim when I plainly did. I would never recommend a VSO to anyone, there is a lot of good information out there to do it yourself!
How did it turn out for you and did you do your own claim?
Bro I highly recommend getting a good vso that is going to listen and keep an open mind
Agreed, My vso did absolutly nothing for me and when I asked question he could never give me a propoer answer, you FAR better off to get yourself a good VA attorney.
I initially submitted my first VA claim with a VSO and won 10%. I tried reaching out to submit appeals for claims I was denied and the VSO just never responded to calls or emails. Got from 10 to 90% on my own and now the VSO finally responds. 🤦🏻♂️🤷🏻♂️
I know about that I lived it for years now . And finally through all that bull crap in the year of 2021. They finally gave me my 90% P&T and IU from years of having 80% service connected since way back in 2012 when I got out for a medical discharge
Thank you for educating us on how to approach our claims
Cheers Marc 🫡
VSO came to my command recently for anyone wanting to attend their training. I asked the simple question “at what point should I do my personal statements and buddy letters?” VSO said you don’t need those and they are for individuals that have been out for some time. VSO stated the VA doesn’t really look at these for the BDD process. It’s tough because the VSO seemed knowledgeable to get you to the right rating but I didn’t fully agree with that statement. He also mentioned if you file while you are still in (BDD) you do not need any secondaries tacked onto primary disabilities. That everything is separate. Just some things totally went against everything I have learned and gathered from about a year of attending CZcams University.
i spent from 2014 to 2023 fighting with the department for the claims i submitted with proper documentation and even the proper items in my medical record to justify the ratings i was seeking. I finally had to hire an attorney and take the VA to court in order to receive what i deserved. and come to find out during the year it took in the courts it was determined that i was in fact 100 percent total and permanent alon with housebound special monthly comp due to my PTSD rating being 100% P&T and having at least 60 percent in other disabilities. Keep fighting Guys and Girls
I looked at my C&P visit notes, and they documented the opposite of what I told them.
I absolutely hate when that happens. Google “C&P examiner report hotline”
That is why I always type in the DBQs " The Veteran states" and then I repeat it back to them. So I think Veterans often forget what they tell us and blame us for not writing what they said.
@@everhappy6312not likely, the fraud & negligence on VA's part is very real! In all areas of VA.
Polar opposite records almost all of them
Ths is 100% the truth. Brother has stage 3 kidney disease. He filed under the PACT act was denied even though he was in Iraq at stationed at Balad as a Crew Chief for the F-16. He then requested some forms trying to see why he was denied and we found on the TERA form they checked yes he was near burn pits but never in his regular career was he ever exposed to toxic chemicals. Which is quite amazing as a mechanic who not only deals with JP-8 along with all the other chems. Anyhow the fact they said this was all the room they needed or denial. Now he's fighting this. The problem I have is the fact the grader did not even look at his DD-214 to see what job he held. Regardless, you shouldn't have to have Burn pit exposure and something else to qualify. I mean the PACT act is straight up for burn pits. People who are grading and not doing their actual job need to be fired. This person has most likely denied many others. I'd post her name but not sure if that is the right thing to do.
Great info Sir! Thank You!
I have in service diagnosis for all my issues and all my c&p exams are at least likely as not. I pray I don’t get played with because I can’t handle much more bs
my vso told me not to file a claim about something that happens to almost 90% of vets so this video is accurate
Hmm that’s odd, I’d definitely look for a second opinion on that one. Cheers to you for being so early 🫡
Just did my appointments this past month. Diagnosed with Asthma in a hospital in Boise. Doctor on base concurred and put it in my file. Can’t walk up a flight of stairs without becoming out of breath. Was put through pretty exhaustive testing for the diagnosis. (Was also being medboarded for it) In the Va exam they had me blow into a small tube once and came back with a 0% rating.
I have back pain that about one out of every ten days I can hardly get out of bed. Continuous muscle spasms, not disk or bone related. Pain at all times in my life, massive loss of sleep and prevention of long travel on aircraft. In the exam I made sure to ask if I stop when the pain level increases. Less than 20% forward flexation. 10% rating according to Va.
job security + backpay = of course they don't want you to win the first time. It's your claim, educate yourself and you take the driver seat...not them and make that clear!
OMG! You are so right. I was initially dealing with this guy who claimed he could help me with my disability claims. 4 years later I was still at the same percentage. When I finally looked at what he put in my file and was claiming, it was all wrong. After realizing this I filed for the PACT ACT on my own and was approved, and then he asked me for some money. I told him he didn't file this claim so he's not entitled to anything. Total waste of my time. But you're correct. He was BSing for the back pay.
It’s horrible. I see Colonels get 100% disability when they sat behind a desk but enlisted who are hurt to the point of contemplating suicide, they turn a blind eye. If you can play softball or volleyball with 100% disability whereas people like me are bedridden with scraps…. Sigh…
My vso has been somewhat negative.
I never used a rep,i did everything by myself 😂😂😂😂
What’s your rating?
The VSO I have here in Utah is worthless. He could not care any less about getting us the benefits we deserve.
I too am in Utah. I originally looked for a VSO from Disabled Vets. I found doing my own work and research netted me better results. Mine did nothing for me but ignore all my initial questions.
Jordan. You are totally on point with this. I used a company and would like for you to review my submitted claim. I believe they purposely did it so i would have to return to their company for an appeal or supplement claim. This benefits their cause. I'm going to send you an email. I appreciate all you do brother
This is 1000% true. I am going through the exact same thing. They purposefully don’t get you to 100% even tho they know exactly how to do it with the evidence you have. So you come back and when they get it for you the next time you coughing up 10k plus. Also they take routes like going straight to appeal instead of a supplemental claim so they can eat up more time and charge more.
Exactly!!!!!!!
I just think some of them don’t care cuz honestly why should they? That VA check clears whether we win or not. Some VSO are amazing and truly care but I think for the most part they don’t get paid to care about us so there is no incentive to win for us.
My pact act claim was denied after being processed for a year. They said that I never served in Vietnam. Come to find out they had inputed the wrong "service nuumber" even though I submitted that information to them five times that they requested.
I owe ya so much Jordan!
I have never gotten further than intents and revoking a VSO.
Extremely hit or miss on it… I’ve had some people write fake info into my record on a C&P and I’ve had someone who was one of the most meticulous individuals I’ve ever met… so many variables… but I’ve truly noticed some people will intentionally screw you..
Of course they are. Last claim I had they didn't adjudicate 4 parts of the claim m and act as if that's okay. They also keep asking for medical records that have been turned in 5 times. They keep intentionally mis-labeling files and I had to have the local VBA and I spent 2 hours identifying and relabeling my evidence so my claim could be processed.
Can I get 2 separate ratings for Pes Planus and for Plantar Fasciitis? Or do they fall under the same ranting?
It took me 3 denials and 3 C&P exams just to get my 10% for tinnitis and I was 11C Infantry mortarman 😂😂😂. They most defintely DO NOT want you to win anything under any circumstances even when it’s obvious.
Don’t stop. File a secondary condition associates with tinnitus (e.g. migraines). Refer to CFR, Ch, 38, pt. 4. And good luck…
@@MLHP37 I’m 92% with a Sleep Apnea claim in HLR and a migraine claim in deferred at the moment. Just waiting at this time until some movement with the claims in the process.
Yeah,I sat across desk told me and my wife.As of now you're 20percent.at Cleveland.I go back to VSO.He puts me at 10 percent, his reason was he thought the two looks like a one unfortunately Iam still at 10percent ,after watching Utube shouldbe 60/80 percent.so much for veterans in dark.
The dept has alerted me that I have a vso representing me. He did nothing. I did everything myself. He since retired. They still have him on my record. How will this hurt me how can I correct it ?? I’m still working on my own claim so I think I need to fix this
This is real.
One of these guys tried to charge me 10k and they would get 50% for 5 years. I never responded they kept tryimg to get me to sign and it was a famous youtuber that i actually spoke to!
Does it matter if they’re cheating to deny benefits?.
Jordan, are you an accredited agent or attorney? I searched your name on VA’s website and didn’t see your accreditation.
Do you still recommend personal statements if you’re doing a BDD claim?
Yes. Write it down. Also if you have another buddy statement. VA likes lay statements.
Yes
Wait, who taught you how to file a claim in the military?
I'm mean in TAPS they kinda told us the basics. Like go to VA.gov and search up file a claim. Besides that tho they pretty much said just leave it to a VSO
@@SauceDon32 ah I see. I got out in 82 and nobody went to VA unless you missing legs and arms lol.
@boathemian7694 I was I'm from 92 to 2001 and didn't know jack about VA disability.. No one ever told us anything.. Still kind of ticks me off..
Sounds like a scam to me, what makes them better then us Veterans?
All veterans need to call their congressman and senator and complain loudly and demand better. The system is broken deliberately.
