    The VA is getting lazy. I was diagnosed with moderate OSA last year after a VA sleep study. Was prescribed a CPAP by the VA. Had medical diagnosis of OSA, attached a nexus letter and was denied because I did not claim it during active duty and it was not in my medical records. I have since filed an appeal and am awaiting a decision. I am currently at 80% disability rating. Sometimes I wonder if they actually read things. Thank you for your videos, they are inspiring and helpful.

      Same here, but I was prescribed the CPAP on active duty. However, my medical record did not have the sleep test. I was given the c and p, then the sleep study, and then diagnosed with OSA. But guess what the VA still denied me.

      Same here. It was all diagnosed, nexus letter, cpap prescription and the rater said there is no service connection to ptsd, insomnia or tinitus.@@kraze1522

      If you did not have a sleep apnea diagnosis while in service, I think the best course of action would be to file sleep apnea secondary to an already service connected disability.

    They stalled out my claim, sent me to a c&p exam, waited 126 days then said, I filed on the wrong form. I’m really disgusted with the VA.

    Also I get horrible anxiety and closterphobia, and the last two nights for example made one night for 1.4 hrs and last night for about 3. Ive had conversations with the tech at the va about it and he said its really common.

    Did my intent to file February and have my C&P exam today in a couple hours. Current 40% hoping to turn it into 80-90% and then open a new claim once I receive my backpay and add the last bit I can wiggle to get 100%

    It’s not just 50% for a cpap. It’s 50% if you’re prescribed any breathing assistance device. This includes oral appliances (mouth piece)

    I was service connected for sleep apnea, but never got issued a cpap. So only rated 30 for that.

    hmm very interesting. seems like they are trying to make it harder for all of us with tinnitus and now with sleep apnea too. im retiring after 20 years on 2029 ill make sure i have all my ducks in a row before then. thanks for keeping us up to date. this is my favorite channel when it comes to va claims. some of this stuff gets confusing but you explain it clearly and you make it easy to understand. keep up the great work 👍

    After being off of Active Duty for 6 years, the VA medical ceter did a sleep study and I was diagnosed with moderate OSA and prescribed a CPAP. Recently got a SOC that tells me I'm 0% in the Notifications portion; but says I'm Granted 50% in the Decision portion. Let’s just say there's a lot of Tom Foolery going on with these ratings. Although I shouldn't have to, I'm thinking about hiring Hill & Ponton to represent me in this matter but wondering if we all can form a Class Action suit together? Not sure if that's possible but definitely going to look into it.

    I started off with the Mads mouth piece and it work great until I had an another bad dream and jumped out of bed face first into the hardwood floor. This damaged a crown and I had to get a root canal and another crown which I paid for. The new crown didn’t fit the mads unit so they gave me a cpap, which I used for two months and could only get 3 hours a night sleep. Now I am waiting on another Dr appointment. So anyway I filed a claim and they gave me 30%, should be 50, my VSO is looking into it. I am now 80%, should be 100.

    Bro im at 90 percent been fighting sleep apnea for 7 years now. I tried to use my CPAP machine on and off the entire time I've tried four different masks none of them work my psychiatrist just ended up giving me Ambien so when I can sleep I will sleep so I just walked around and lethargic Hayes and do the best that I can 😢

      The VA are quick to get veterans Ambien. A non VA doctor will tell you that its a temporary prescription. The medication is for short term use because after a week it doesn't work smh. Look at my post I just posted about sleep apnea and I won it as a secondary condition the first time without a C & P exam or a VA sleep study.

      This works great if you are retired or separated already, active duty folks have to hope the rule goes final after their retirement or separation date.

    So I was given the 50 percent rating dating back to July of 2023, retroactive. Just last week got the letter. 57 yrs old, PTSD at 70 percent, would that be a factor as far as needing to worry or not about changes.

    Just got diagnosed with sleep apnea a few weeks ago. Filed a claim a couple days later. I have ALREADY been contacted by someone saying they are going to expedite my claim. Also received an interesting letter from VES stating that they were contracted to assist with the huge backlog of claims. Fingers crossed 🤞

      @@tj3988 well so far, they have pulled all my medical records and all my verifying information PLUS they have already decided that I didn't need a C&P exam. All this in a matter of 2 weeks..... Sounds pretty expeditious to me. 😁 Maybe they will just deny me. I have found that the quicker the claim goes the more likely it's a denial. If I go about month without hearing anything I'll feel better about it. 🤞

    If you have an original c&p exam for secondary conditions and the examiner says at least likely as not and then the va have you take another c&p exam for the same secondaries from another one of their contractors and they say less likely than not. Can they do that and make it stick

    So here is a question I have the 50 percent rating for many years now. So say I file for another type claim say for anything. The VA can then go back and review all my active disabilities and now say in 2024 well you CPAP is working and then reduce my rating on my sleep apnea. I believe that to be true or am I misunderstood?

      If this rule goes final before you are eligible for benefits (retired or separation date), you will be rated under the new rule criteria. If you are lucky enough to be eligible for benefits prior to the rule going final and you file intent before it goes final, you should be rated under old criteria.

    Can I order a at home sleep study for sleep apnea to support my disability claim? The VA sent me to a clinic for a sleep study but I barely if at all slept and failed the study. I don’t do well with sleeping anywhere that is not my own bed, let alone covered with wires/sensors. I did a little research and found 2 companies: Night owl, and Lofta. Both are FDA and DOT approved. I wonder if confirmed sleep study from one of these devices plus a Nexus would be enough to support my claim. Any info would be appreciated, thanks!

    Are you able to help me with my claim?
    I did a sleep study through the va but I was in terminal leave at the time and doing a PCS back to my home of record. They didn’t have an appointment for me until months later. I informed them I was moving back to another state and I couldn’t be seen. Years later I got a sleep study done the VA said I had it and gave me a sleep pap machine. They didn’t give me a rating for it or make it service connection.

    I filed for Sleep apnea secondary to chronic sinusitis, got denied. I have a cpap and I am diagnosed with sleep apnea. Just not serviced connected. I have chronic sinusitis at 30%. Bs because my respiratory doctor said my chronic sinusitis affect it but she wouldn’t write me a letter .

    My direct claim for sleep apnea was denied twice previously. I am in the process of getting a NEXUS and DBA completed. Do I need to do another Intent to File to be grandfathered in? Or am I still good? I think I will be filing Sleep Apnea as secondary to one of the respiratory related illnesses that is documented in my medical records.

      Also VA diagnosed me with a mild case of Sleep Apnea and I am using the CPAP Machine that they issued me. I initially asked to be tested for Insomnia and they tested me and told me that I suffered from Sleep Apnea.

      If you are still active you won't get any rating till after your DOS. You should be good, I'm still waiting on mine too

      Maybe due to insufficient evidence. OSA diagnosis and CPAP alone ain’t going to grant you SC even you have a Nexus letter. You need buddy letter/s or if you’re married, your wife can write a letter stating that she observed you of daily daytime sleepiness, gasping for breath while sleeping or if you’re snoring loud. In my case, I submitted 2 buddy letters, letters from my wife and 2 adult kids plus my personal letter stating all my symptoms. It only took less than 2 months from the time I filed my claim to granting a SC and a 50% rating (I’m also using CPAP).

    I was denied for my tinnitus and hearing loss claims, it has been over a year. I'm still waiting for my C file to assess what I need to do to get those won. Will those claims be grandfathered even though it's over a year since the denial?

      That typically happens if there is reason for them to believe that you don’t “need” the CPAP in order to treat your service connected OSA. In this instance if you’re rated less than 50% but still service connected, I would seek a second opinion to see if you get a doctor who says you need it

    Has anyone been successful filing for sleep apnea secondary to anxiety/depression? I have "sleep disturbances" in my medical records while in but that was not enough since no cpap in service. I got my sleep test and cpap from VA so they recognize my OSA but no connection. Any help is really appreciated. Im service connected for anxiety/depression at 70 percent and 10 percent tinitus.

      Immediately apply for an increase. If you file now, it will be grandfathered in.

      It means the VA needs more time to determine how they’ll rate your condition. This is neither good nor bad, but it’s better than being denied.

      @@williamsmith8790 because the VA can choose to reevaluate your service connected conditions if you ever seek an increase, it's been in effect for less than 5 years, and it isn't a static condition

    What happens if you’re in the BDD phase, would you still be grandfathered in if these new changes take effect before your last date of service?

      I am right there with you, about to file BDD next week but I don't retire until summer. If Rule goes final prior to my retirement date, I fully expect to be rated under new criteria. It is all about when you are eligible to receive benefits. If you were retired or separated now, all you would need to do is file an intent to file and you should be rated under old criteria. Those of us still on Active Duty are the ones hanging in the balance.

    The VA is really fighting NOT to pay a sleep apnea claim. However, THE VA IS NOT ADMINISTERING SLEEP STUDYS FOR NEW RECRUITS. We know that a sleep study, upon entry, will have a negative impact on recruitment and forward deployment ready percentages.

    My sinusitis and rhinitis makes it harder to use the CPAP machine.
    Also I get pins and needles on my arms and legs because I can't movie with the cpaps connected.
    It causes more problems of other than saving me on this. I am dead . As good as dead

      Yeah i feel this. Have had my cpap for a year now, I get out next year but can't do my BDD claim till june/july

    Isn’t the rating you get because of the continued need to use the machine? Machine is a pain in the butt and you are saying that if you have a machine and use it to help then you use your rating? Seems like the need for the machine justify the rating.
    They use to remove the rating when people stopped using the machine now you are saying that if you don’t want to use it (can’t use it) then you get the rating?

    So I’m active duty in the meb process I’ve filed but none of my claims will show on va.gov till I’m out. will I be withheld from the rating if I don’t get discharged before the changes?
