    I greatly appreciate this video. This was so eye opening. As a spouse of a vet I just wasn’t sure what in the world is going on. Thinking it was something I was always doing, but when trying to ask my husband he’d just clam up. This has really let me know some avenues I can take to help my husband. He’ll more than likely buck at the information, but this really tells me a lot of what is going on, and what I can hopefully do to help him, and our family. I’ve stuck it out for a few decades so I’ll just keep pushing through to get him the help he needs. Thank you so much.

    I had 2 c p exams for mental health and both said my problem started in service and my service file clearly says problems , and they still denied my claim , unbelievable , great video thanks

    Hello there.. just saw an old benefits denial letter from a claim i filed the month that i ETS'd 8/2001 and it shows I was claim knee and back issues... I forget why it was denied, but most likely i didnt make the C&P appt is because the process was over a year at that time and I had already moved out of state. OAN, I dont have my outpatient STRs only inpatient STRs because thats all national archives provided me... crazy part is VA is now saying I never complained about back pain in those days when clearly, I did. Maybe during those days they didnt have the, "you have up until 1 year to service connect injury rule"... I am still attempting to service connect with a nexus letter from a letter of intent filed 2/2023.... however, do you think that I can possibly win at the board of appeals to get the knees, back and dizziness back dated all the way to 8/2001? Your thoughts on that? My apologies on the length...

    is it easier to prove MST when the two people were court-martialed, found guilty and did time in the brig and I have a lay statement from the base police officer that was the reporting officer for the initial report and subsequent stalking?

      You already have more evidence than most people do. File a claim. Also file a statement in support of your claim that describes the incident in detail… you should provide the names of the people that committed these crimes, units, dates, locations. What happens is VA will do a records research request on your behalf and pull records. They will try to confirm the names and events, and if those court martial records are there, you’re golden. All records you have, submit them…. Investigative reports, the office lay statement, all of it.

    Received 100% August 2022. File to increase my ptsd Nov 2022. Granted the increase from 30 to 70% September 2023. I know my 100% will not go up, but back pay wise I should be entitled to the difference, 40% for 10 months. Am I correct??

    I'm old school. I don't know anything about these rating systems. I didn't report being raped becase we didn't didn't do that back in my day. WE did not talk about these things . We didn't have 'markers' .. WE're old school . like 1988. .. No one cared back then.

      We actually internalized the cultural mindset that we did something to bring it on (clothes, drinking, etc), so we bought into what other people would think: we were to blame. There was neither a vocabulary, or criminal justice avenue for it in the pre-tailhook era. Even after that, it would be and still is slow to permeate the culture.

      They still don’t care. The whole “see something, say something” programs are mainly to make it seem like they’re doing something, when in reality it’s still difficult to get heard.

We got sexually assaulted and we were basically told ... you'll be on trial more than that senior staff member.. we knew we'd lose payroll/promotion. But that's how it worked back then. Meanwhile, Screw your VA claim because you didn't report it back then (when we were threatened if we DID report it) It's all evil.

    Myself and my county VSO did the NOD after my initial claim got denied in 2019. We did the evidence docket route for AMA to the board for a PTSD Claim, in regards to a sexual rape/assault that had happened to me in the service by an NCO. The overwhelming evidence for the diagnosis and witnesses statements is clear cut as it gets. I have current diagnosis of PTSD from my private care provider & prior VA healthcare treater. My case has been at the board since July 06, 2020. Myself and My VSO have heard no new updates on the case for quite sometime. No updates on case flow management he can see. I took it upon myself to reach out to my local congressman twice within my district to do a “congressional inquiry.” My congressman agreed to help out and expressed remorse and wanted to help anyway possible. After doing congressional inquiry asking for status update of the case just to find out where I’m at in line. April 29, 2022 the Chairman received it. I received a copy of the response from my congressman from the (now) former Chairman of the board Cheryl Mason on May 11, 2022. It was the same response as the VA website. That it’s pending review by a VLJ. Absolutely disappointing news and overwhelming not more information was provided. Such a disservice and not having any closure. My congressional inquiry however was noted it be attached to my file with the appeal we did. On 06/26/2023 I received a 2nd “Congressional Inquiry” response for the 2023 year at 12:57pm est. I still haven’t had a VLJ looking at the case. It’s been over 3+ Years of it not being looked at. Hope no one goes through the same struggles as I did. Additionally, hope this provides some timeline comparisons to others that are waiting. I will continue posting updates and my story for other veterans who look in the comments section for timelines and where other veterans or at in their possible similar process. My personal opinion recommendation if it’s been a while you been waiting, one thing that could help give more or maybe none for clarity that CCK or other channels don’t promote as much is a video directly relating is how and why do a congressional inquiry. This 2nd Congressional Inquiry however, did admit my case is above normal metric wait times and that my (AOD) Advance on the Docket Request Packet due to other sufficient causes, will be reviewed by the Deputy Vice Chairman of the Board asap . Myself and my VSO are awaiting that decision as of today. How often or what are the percentages you’ve seen AOD requests been granted by a Deputy Vice Chairman? It seems my congressman pushed to get a decision on the AOD packet motion submitted by my VSO.

    Is there a local lawyer in Arizona, Phoenix or Anthem, AZ that could help me...I have a successful rating of P & T 100% but wish it included back pay....unemployability...and MST As it is defined now...30 yrs. Later...I was recently -re-traumatized by the local police, in Prescott AZ and the VA police as well...thrown in jail...deniel health care, county wide and blocked from calling 911....the local clinic in Anthem called 811 for me and I received proper care...Court date is July 20 for nusance charge....as I called 911... 14 times that day...and the crisis line 3 time to no avail...please ...please help represent me...I documented everything....500 pg. Record... thanks alot....ursula...307.797.6853

    My VA Psych put a disclaimer in my file to prevent me from being able to use my diagnosis for filing a claim: **The listed diagnosis is based solely on the veteran's self-report of symptoms. The clinical assessment that led to this diagnosis did not include any measure of potential response bias, a review of the veteran's claims file, or a review of other collateral sources. The assessment results and diagnosis documented in this note is for treatment purposes only and should not be used to make legal decisions, such as VA Compensation and Pension determinations.** Can they do this??!? I literally can't file a claim bc of it. I've spoken with multiple other veterans who are service-connected mental health and none of them have ever seen or heard of this happening. Also spoken with multiple VSOs, they too have never seen or heard of this.

    Hi thanks for the great info! Put in a claim for PTSD in MAy 2022 and i received a letter last month stating apologies for the delay and not to expect any decision until June of 2023 at least. Is this a normal amount of time?

      Honestly @liquidaloha nothing is really "normal" with the VA. The answer I'd give a year ago doesn't apply to today. The PACT act seems to be dominating the resources these days along with terminal veterans and cases expedited due to homelessness, terminal illness and severe financial hardship. It's extremely frustrating, I know.

    Can you give a timeline for a decision after a CAVC remand back to the board. VA. Gov says "your appeal is being reviewed by a veterans law judge, you will receive a decision soon" my husbands appeal has been on going since 2013.

      Unfortunately the timelines are changing all the time so it's hard to say. Right now I'd ballpark about 6 months or so but that could change. Sorry I couldn't be of more help and that you've been dealing with this for that long!

      @@mrsdreamweaver8677 I often tell people the BVA doesn't share the same definition of expedite as the rest of us :) That said, when your case goes back to the BVA from the CAVC it would get faster attention than a case just reaching the BVA from an appeal from the VA. So you're in a better position than those.

      Hi Gil, sorry their timelines keep changing. They have been saying for years their target for direct review is 365 days but I have cases sitting in direct review line for two years.

    So im appealing a ptsd 30% rate because im doing worse since that rate and they never took into account my civilian psychologist records. Currently, i will be going to a C&P exam in a couple of weeks even though my civilian doc sent in all her records AND did a DBQ. Why would they send me to a C&P exam with all the info and DBQ sent in?

    I was awarded 30% the end of last year. I feel that is way too low. If I appeal would my current girlfriend be allowed to attend the C&P with me? I ask because after discussing my last C&P with her she pointed out there was so much I missed bringing up, such as frequent job changes because I refuse to put up with their BS, frequent relationship changes for the same reason, she says I lose my shit while driving if someone does something I don't like (drive slow in the passing lane), my drinking has increased immensely, and SI. I have a lot of pride so telling a stranger that I am a weak failure and I suck at life is not something I can do.

    My father has been actively applying for VA benefits since leaving Vietnam in 1969. All have been denied, he has had 5 heart attacks, is diabetic, has hearing aids provided by the VA but does not qualify for anything else. Can you give me any assistance?

    when I served in the Marines, I served 4 years on active duty and was deployed to two separate countries. I was in Field Artillery which is Big large heavy Cannons/ Howitzers I saw many very dangerous situations I had more than one instance where I felt I was going to lose my life and I have bad dreams about those things I suffer from Anxiety as well as anger I went through a divorce and have had flare-ups at work with certain co-workers who have got me in a heated state I am for sure hypervigilant and afraid of leaving my car anywhere and etc.. I've asked the VA for help and I am hoping they are going to give me the help I need I am not doing that well but I keep trying each day to hang on and not to give up. I loved the Marines but it took a toll on me. I am service connected for bilateral hearing Loss my hearing and equilibrium is really messed up. I'm doing my best but I for sure need some help. thanks for your video.

    Hi Amanda, couple of ?'s. I have a couple of denied claims before the bva (direct review), should i have provided a brief to help fortify these claims? Is a brief something your co. will do after a decision letter review? Also, if these bva claims denied again, where do i go from there? These are what i thought were solid claims, current diagnoses and treatment and service connection, one documented in service, the other secondary to a rated condition with an IMO. How do i retain my effective if denied after bva? I want to go scorched earth on these guys. They are nothing more than a bottom line organization at this point. Thanks for your content here!       If you do direct review the VA will only consider evidence of record at the time the appeal was filed. If they deny you, because you're in AMA appeals you and preserve your effective date by filing new and relevant evidence within one year of the Board denial. OR you can appeal to the CAVC and argue the BVA made a bad decision. This is harder to prove but we do win cases at the CAVC all the time.     Can you report a C&P examiner for neglecting to put information that you clearly stated, during the C&P exam ? I just got back a 50% PTSD rating, because due to her findings, I did not have - suicidal ideations [which I do] obsessional rituals [which I do] illogical speech [which I do] continuous panic attacks [which I do] impaired impulse control [which I do] spatial orientation [which I do] neglect of personal hygiene [which I do] etc. I have bad memory, so my girlfriend had to be the one to read the rating and she recalled the conversation with my examiner, as she was there. That’s what refreshed my memory. Nevertheless, please let me know if I can get a copy of the C&P exam video and how to report the examiner. Thank you, for all these educational videos.

      Hi Carlos, we recommend you submitting a VA form 4138 Statement in Support of Claim outlining the issues you see with the exam. You can submit one as well as your girlfriend. This will make it part of your claims file record. You can submit it with a supplemental claim as new evidence in appealing the 50% rating.     In 2010, I had to provide SIRs, statements, and psychologists statements and received 30% for PTSD. Then years after anyone could say whatever and get 70%+, I guess combat PTSD isn't such an issue, I already hated going to a shrink and after losing my marriage, several jobs, nearly my home and my vehicle repossessed which I got back. If you have PTSD or similar, it's difficult to talk to anyone at least for me.

      Yes, thank you someone who falls into the same category as myself. I am a combat veteran, had the provide SIRs, statements and combat awards. I got 30% in 2010,now people just say it and get rated higher.

    What happens when the VA is the one that orders the PTSD exam and not you?

      Hi Patrick. The VA is always the one that orders C&P exams for rating purposes. You can also get your own doctor to complete a DBQ form in support of your claim, but for a C&P exam, those are with VA doctors or their contractors. Let me know if I can help clarify

    It would be nice to be able to speak with you concerning my case. I am a Disabled Navy Veteran. This case goes back to a time period between March 18th, 1983, to June 24th,1983. And I have complete Documented Evidence that will clear up this matter (original Navy records concerning everything). I am a standing member of both the AMERICN LEGION and DISABLED AMERICAN VETERAN, of which have helped some, but if I was never giving my rights under DUE PROCESS of LAW. If I had been given my rights under Due Process/ This would have never happened and I would have spent 40 years and retired a SENIOR MASTER CHIEF...They took everything from me. I have been a Homeless Veteran off and on since 1983, when is this going to stop? I really don't want to die without my HONOR RESTORED. I am truly a innocent man. I will check this remarks evry couple of days..Thank you

      I didn’t think that’s possible because of SAPR unless you made an unrestricted report I doubt a report was made not saying mst didn’t happen but there are VERY strict guidelines when SAPR has been actived
