Hi Amanda, couple of ?'s. I have a couple of denied claims before the bva (direct review), should i have provided a brief to help fortify these claims? Is a brief something your co. will do after a decision letter review? Also, if these bva claims denied again, where do i go from there? These are what i thought were solid claims, current diagnoses and treatment and service connection, one documented in service, the other secondary to a rated condition with an IMO. How do i retain my effective if denied after bva? I want to go scorched earth on these guys. They are nothing more than a bottom line organization at this point. Thanks for your content here! If you do direct review the VA will only consider evidence of record at the time the appeal was filed. If they deny you, because you're in AMA appeals you and preserve your effective date by filing new and relevant evidence within one year of the Board denial. OR you can appeal to the CAVC and argue the BVA made a bad decision. This is harder to prove but we do win cases at the CAVC all the time.
