Contracts for Artists + Illustrators EXPLAINED! ✏️

  • Whenever you work on a project with a client, even if it’s something small, you ALWAYS need to have a contract in place. However, I know that for a lot of artists, especially when you are first starting out, contracts can seem a little confusing.
    In this video, I’m going to try to make it simple for you. I’ll list out some things you should be including in an illustration contract and explain why it’s important, to make sure you’re ready for the next project you work on.

    I’ve been given the opportunity to illustrate a children’s book, because the author couldn’t afford the price of their publisher. It wouldn’t pay a lot, but I’m still in Highschool so it’s a pretty good opportunity! This is very helpful as I have almost no experience with money.

    This video was so so helpful. Thank you so much Anoosha. I love your videos because you give really good and specific and usable examples. One hears so much in theory about contract and pricing and so on but only few concrete examples, it's always so abstract for me. Pricing, contracts, even writing a work mail...one knows the rules but without a concrete example I find it really hard to use them. That's why I find your videos incredibly helpful.

    Such an incredibly informatove video! Thank you! I was just propsed an art job and was all 'i jave no idea what to put in a contract for this, but I know i will need one' watxhed this video and 100x more confident in moving forward.
    Question: Are their forms of payment from a client you would stay clear of?

    Even though I've been a professional illustrator and artist for 3 years now and have worked with a variety of clients (and contracts!), this was still a super usable and informative video. Thank you! Alwayssss get a contract, or a written agreement in email (which is binding in The Netherlands as long as someone says 'agreed' to the quotation invoice). I made the mistake before of not making them and you, as the artist, always get the short hand of the stick.

    This was so helpful. I made the mistake of agreeing to work with a friend without compensation and hundreds of hours later it’s a very unfortunate lesson learned.

    This is all so incredibly helpful and thank you for making this series! As an illustrator, I still often wonder how to approach charging for sample art. Do you usually try to ask for the payment before starting on the sample? I've run into a situation where the studio abandons the project halfway through the sample's completion, and I end up having time wasted.

      I always aim to ask for half of the payment upfront, and the other half right BEFORE I send the final artwork files!

    When it comes to _rights and usage,_ what, if your client is just a single individual that wants artwork for personal use.
    Should I still avoid giving them _full_ rights?
    Should I specify anything, like he can only use the artwork for personal and not commercial use?

    I planned to make an outline of this video as the contract. Mainly using the captioning you narrated over.
    Just so i have an outline to work from.
    I'm curious how would you go about finding a lawyer though.

      Google! (And note; my examples are EXAMPLES, they don't cover every situation so get that contract double checked by a professional!)

    Very interesting, helpful video! I have 2 questions though:
    Q: If I did a "strawberry -jam logo" for a client...Am I allowed to post this art on instagram/ my website.. or how to negotiate that (in advance/ or after even?)
    Because the client might argue, this art was solely for him?
    Q2: If then somebody steals my logo on instagram and the client finds out about it, what would I have to DO then about it? To protect my client of any copycats of his logo...? Also I'm living in Europe where laws might be different...Thanks for any answers.. 😊

      I cannot answer the second one but I make it clear for the first one that I should be able to put anything I make into my portfolio as a condition of working together especially as I am a newer artist. If they don’t want that, they need to move on. After that we can negotiate.

      @@tomatochemist Yeah, good advice I MUST learn to have the ok in advance..Maybe solution is to take a picture of the logo instead from my IPAD only, or post only some low resolution copy.?! ( I mean, if I had a portfolio on instagram/ or private website...Emailed Portfolio might be differently)

    Oh wow, this has me thinking. I just got a contract job to make illustrations for a small gaming company, they only pay me once (and not a lot) and will own all the rights to my work…is this a bad deal?

    Thank you so much for this video! It was incredibly helpful. I have a question about exclusive and non-exclusive right. For example, when a Client ask for exclusive right to use the work on a certain product, does that mean the Artist can’t sell the right to a third party even though it will be used on a different product? And can the Artist make further profits from the work like prints and merchandise? Thank you!

      That's a little tricky and would depend on what exactly was agreed in the contract and the language used! If the rights are -specifically- for a certain product, and you would otherwise hold the right for anything else, then yes you could then sell other usage rights to a third party or your own use.

    I never know illustrators could request samples of end product. So is the samples are free from the client or should we pay to get the samples?

      In general you would agree on a certain number of free samples, that is usually the industry standard! Early in my career it would only be one copy but now I ask for at least 15.

    Help I have been asked to illustrate a book and I’ve never illustrated anything before. I’m only 14. It is a small project but still, any advice?

      Pricing can get pretty complicated because it involves a lot of factors so check out my pricing video for more in-depth info! But I would think about how much time you are going to be spending on this book (number of hours), ideally you want to be charging at least minimum wage for it to be worth your time. For example, if minimum wage in your area is $10/hr and you think it’ll take you a month to finish (160hours) then you would charge at least $1600.

      Of course, this might be a lot of money for the person who is hiring you (maybe this is a request from a family member or a collaboration with a friend) and you might feel like you’re doing this mainly for the fun and experience. I would always say to charge what you’re worth (self publishing picture books should pay artists $5000-$10,000) but I also understand this could be a more casual project for you, and you might feel like you need to adjust the number. I hope this helps a little bit!

    What about royalties? I’m an aspiring writer and would like to know more about this. If I pay upfront for the artist illustration do I have to keep paying them if my book does super well?

      I don’t have any experience with self publishing so I’m not the best person to ask, but I believe it’s author usually don’t do royalties since it can get complicated. However it can vary from project to project so I would say to look further into it! I reccomend the Facebook group Childrens book Illustrators for help!
