  • I was flying a drone capturing aerial photos of a construction site for a client when a neighbor approached in a hostile manner, using profanity and called the cops stating he felt uncomfortable and that I was somehow invading his privacy. I refused to leave before completing the job.
    I am a Part 107 drone pilot and this flight was conducted under 14 CFR Part 107.
    I was parked on a public street (NOT PRIVATE PROPERTY) and maintained visual line of sight of the drone as it flew above the construction site taking orthomosiac images of dirt.

    To all those complaining about "reverse racism" and "playing the race card" ... as others have mentioned, he did not accuse anybody of being racist, he just wondered if the thing would have been different if he weren't Filipino ... and I would just say that I noticed two things during the video:
    When asked on the phone for a description of the person, the guys first words were "He's an ASIAN guy ... ", which says a lot ... for the police coming, I think it would be more relevant size and clothes, as from a distance facial feature will not be that recognizable
    Second ... to all those that say that the guy's concern was privacy ... it was not ... he was concerned about having this individual outside of his property ... when told that he could see the footage to address his privacy concerns, he clearly said that he didn't care, and then insisted about parking across the street ... and that the neighbors would not be happy either ... privacy was just a justification

      The issue was about a drone not what color his skin was. Saying, "Just wondered if the thing would have been different if I weren't Filipino" is an insinuation of racism, no point trying to sugar coated. Describing someone by their ethnicity has nothing to do with racism. You've just got stop drinking the Kool-aid my friend.

      I would probably agree with you, if not for the fact that the guy explicitly said he did not really care about what he was filming ... and he mostly insisted on parking on another location ... which does has nothing to do with the drone. ... he seems to be saying "I don't care what you're filming, as long as your are not standing here"...
      Yes, wondering if it would have been different is insinuating that racism (or at least implicit bias) was part of the cause. Unfortunately, my friend ... this is a reality for minorities in this country ... I personally didn't have to worry before moving here (I'm from Chile, so I'm Latino, or Hispanic, whichever term you prefer)... I am mostly white, like a bit part of the Chilean and Argentinian population, but as soon I speak I worry about possible reactions. Luckily for me, I live in a very tolerant part of the country, but I have still noticed less-than-friendly faces (and heard annoying comments). It is not something I had experienced before, and it has changed how alert I am around other people. I cannot imagine how it is to grow and live your whole life feeling like that.
      Regarding that "describing someone by their ethnicity" ... well, it's also common here ... there are several ethnicities in other countries, but in most places you would start describing somebody by height and clothes, probably hair length and color if it is particularly good for a description... I will tell you, while I was watching the video I had not noticed the Asian ethnicity until I heard the description given in the phone... Given that the title says "SoCal" I had thought he looked a little Latino, which didn't strike me like something relevant.

      for the first issue you have..... asian latino white black... says alot on a description.. doesn't matter what you think, it is a proven fact that ethinicity goes a long way in identifying a person. it's not racist... and if you think it does... then you are the racist not them. your second point is spot on... the guy was just looking for anything to make the drone guy the bad guy.... which alot of racist do.... like you with your first issue.

      I agree with you 100%, you are not claiming that the entire system is racist, you are claiming that this guy acted like one, which in my opinion also, he did, for sure. And you are right, I don’t think it would have been the same if he didn’t recognized you as a minority. I know that is a subjective judgment, but everyone is entitled to their opinion and mine is very close to yours

    May I just say, you handled that sincerely and with manners, as an amateur nature photographer I get these bozos come up to me all the time when I’m filming. I carry around a laminated version of our country’s drone laws to show to these people. Often it makes them go away, but I’ve been threatened with firearms over this thing before.       Well you can't really be fined for wasting a cops time. You can however get fined for false reporting, but its very hard to do that because we don't know if this A hole called 911 or just non-emergency. Also he believed his complaint was enough probable cause to warrant police. So now when police respond, they're going off the RP (reporting party, aka caller) probable cause.

Policemen and policewomen who do their jobs like this in the above video, should be commended for knowing how to deal with situations like these and how to de-escalate it quickly. Training and experience in cases like these are invaluable to any law official working the beat. Knowing how to identify if a violation and that said violation of the law or if a violation of a complainants rights has taken place, is also a rare and invaluable skill.

My partner works in a pharmacy and a guy was irrate because they wouldn’t do what he wanted (something illegal) so he called the cops while AT THE PHARMACY! The cops pretty much shut him down immediately after arriving. But, to your point, these people need to start being fined for frivolous crap. All on board with that!

      @@hannahsmovies5612 It's not illegal to call 911 for something that is not an emergency in any State or jurisdiction anywhere. It is illegal to abuse the 911 service, but in order to show abuse a pattern (as in several instances) of behavior has to be proven in which the person calling 911 has already been informed that the issue they are calling about is not a police matter and that they should not call 911 for that reason.
      The reason it is not illegal to call 911 for a non-emergency is that it would create a chilling effect for callers trying to decide whether or not they should call 911 to report something. You do not want members of the public, who in general are already reluctant to call 911 for several reasons (denial, fear, etc) to also have to worry about whether or not they are subject to arrest if the thing they are reporting turns out to be something that isn't illegal. We want people to call the police sooner and more often, not less often and only after they have fully convinced themselves it is a true crime.

    As a drone pilot myself, I can understand why he was flying standing at that location, noticed he was stood near some bushes probably for shade to improve visibility of the screen. The drone pilot was very polite and composed, such ashame the guy complaining had such a bad attitude and was angry. Kudos to the cops on this one.

    I think its a good idea to have printed instructions to hand out at times like this or make a verbal statement to the effect: "Please give me a few minutes to land my drone and then we can discuss your concerns." As certified drone pilots, we're probably going to be in the right in most situations. But we must be prepared to handle situations just like this, especially in urban areas. After watching the full video I decided to add how professional you were in handling this obnoxious guy, to put it nicely. People do not know their rights, but pretend they do. The guy missed an opportunity to learn something new, suprise, suprise, right? Thanks for posting.
