Interested in knowing is there a way to have a giveaway accessible to a membership base only? If the paid membership gave access to special perks and pricing for products but then did random giveaways to only the current member base, is that allowed?

I spoke to you before covid and was never on social media. I actually called you about 2 other friends that I was helping to record music reviews. You told me I should be making my own videos about welding (steel deer antlers I welded might make you remember) You also told me about TT and I finally decided to jump in 2 years ago. I did it as a test to see if you were right. It is going great so far and I just wanted to say THANK YOU.. I am finally beginning my CZcams journey . Ian, I am working on my first giveaway. I have done most of what you said in this video before I even watched it like naming the sponsors but I do not have any contest rules (I am looking at buying yours) but I need to know before I buy the rules, does it have a liability clause in the contest rules. I am giving away a skateboard and do not want to hear from a lawyer later on that the winner skated into a brick wall.

Are Giveaways and Raffles the same thing? I see CZcamsrs doing Raffles for ticket "donations" and don't follow these same guidelines. Are they different?

Well, that appears to be on-the-line. You can't require money payment without it becoming an unlicensed lottery.
is it legal if the giveaway rules indicate that the prize will only be shipped within the continental U..S but anyone in the world may participate as long as they can provide a physical U.S. address? makes sense?
I was going to ask the same question (but only to be shipped to the UK). Would this be against the 'equal chance of winning' requirement?

I've seen people selling raffle tickets on CZcams to enter people in a giveaway....so that is against the rules

@Ian Corzine Great informative video. I would like to see how mail in entries (AMOE) are handled at the sweepstakes place. While I understand there are sevral ways, I would want to know what the most popular way they are tabulated/counted/collected or whatever it may be called. Also, I would like to see the abiiity for entrant to be able to see that their entry has been received and counted, and if there is a multiplier (2x,3x,4x,5x) for the entries that they have been calculated properly. This could be a simple as a portal/account the sweepstakes would allow the entrant to access or make and see their information. The sweepstakes company could surely beneifut from that by running ads or just collecting the data used in the account making process. I have always wondered how the mail in entries are done, are they shoved into mailbags, dataentered into a computer by a clerk, or thrown into a barrel of sorts and spun for mixing prior to selecting a winner. All this behind the scenes stuff would be interesting for a entrant to know. Thanks for the video.

If you do a giveaway for subscribers, is it reasonable to discount those entries who hide subscription status? As I cant see if they are subscribed.

What exactly does that entail? What counts as an "equal chance?" For example, if you have to solve a puzzle or correctly answer a trivia question in order to be entered into the raffle, does that violate the "equal chance" provision?
Well, your examples appear to be "contests" -- for a giveaway, everyone must have the same rights and access as others to participate and potentially win the prize.

I'm subscribed to x channel about gaming let's say and that channel made a giveaway but made clear that partners of that youtube channel(people who donate to the channel) have higher chances to win the product given away and it was also kinda mixed with contest because he daid he would choose one comment and then ask a pair of questions and choose the winner but as I mentioned he made clear partners have more chances than subscribers. In my opinion this clearly breaks the rules, how can it be? That channel didn't get in trouble

Thank you Ian for doing this video! As a new CZcamsr and small channel I thought this might be a great way to grow but I am not so sure.
The key is tying the prize EXACTLY to what you do. If you have a knitting channel, don't give away aPlayStation, you'll accumulate the wrong audience. Think: "What does my perfect audience member REALLY want?" And then make that the prize.

Hi Ian. Thanks for the video. Really need help. Wanted to know what would be the best way to report a company that is running a nationwide sweepstakes which is really an illegal lottery. They have promoted and ran these lottery’s numerous time and have profited hundreds of thousands each time. I'd like to use one from my group of these certificates I have access to that is a 5 day - 4 night cruise.
