One of the first questions to consider for profitable online business, like an Amazon online sales business, is whether your sales business needs a trademark, service mark, or design mark. What about a trademark symbol? Then, you must perform a trademark search -- in this video, Ian does a trademark tutorial and shows you how to register business name and how to register business logo. What’s great is the trademark application is online. By going to USPTO online site, you can do a trademark application online and have a trademark business name, trademark logo, or trademark products. Hey! I came here to say thank you! Tomorrow Im going to be making the final purchase of my trade mark. Today they confirmed to me I am allowed to legally use that tm symbol now. I have you to thank because the people over the phone that called me about confirmation of my trademark said that they were impressed and also said "no ridiculous errors were found". And I did it all exactly like you said step by step doubke checking my work. So to anyone curious and sees this comment, I reassure you this guy 100% exactly knows what you need to do. And I will also say I was mega paranoid I would be told I did something wrong or anything like always but it really worked! I was stunned! Thanks again!

@@yoursocialmedialawyer Hey Ian I already paid a fee of $275 to get my own logo that was made by the company that makes logos I didn't know about all this stuff after it was completed they said I had to pay $1100 to UPSTO to get it trademarked, so I paid that. I thought copyright and trademark were the same thing. They sent me an email saying it will take 3 months for an attorney to review it. If it doesn't go through will I not get my $1100 back😭? All I'm trying to do is get my youtube channel started SMH.

I went to TESS and discovered that name I wanted to trademark existed with a minute difference. My name finishes with " Images" the resisted one is " Imagery". We're in different business. Is this enough of a difference?

Hmm...good question, Product or Service? What if I have both that I want to trademark with the same name?
Your information is always clear and concise. I did Trademark my name about 2 years ago, but here on CZcams I changed the name slightly. Your Travel Insurance to Your Travel. Should I trademark the new name.
If you dont want anybody to pick this name, feel free to trademark the new name.

Yes, you need to include your logo while trademarking but I'll advise that you file the logo and brand name separately.

Great video. Question, as you mentioned in step #3, "Use It Or Lose It"...so in order to Trademark we must use the word or phrase online BEFORE we register it? Are you sure? What if we do that and someone beats us to the registration process? I always thought you register the word first then start promoting and branding it everywhere. Please explain

Great information Ian! One thing you didn't touch on that I was hoping you could answer is what if I have a name I'd like to trademark and when I search TESS the same name is "live" in 2 separate classes. One for Class 32: beer/spirits, and the other for Class 41: entertainment services. Can I still register the same name but in a different class? There are no live trademarks in my class which would be Class 25: Clothing and Apparel Products

You make this look easy. Everyone else makes this look hard. I'm going to pay the extra $50 and do it like you suggest. If It fails its still cheaper to do 2 times than hire an attorney to do it for you once.

J'cobi Matthews, yes I did get an answer. You will need to trade mark your name and Logo separately. I found a few links via google search to explain in more depth on it. Let me see if I can find the ones I read and I’ll post them here.
What if I have a logo and a saying but I am such a small business that I think it is not worth it? Should a business become larger before even considering it?
