      Even when the singer is average he's happy. He still owns them 500 average singers CZcams advertising money still adds up to a decent figure, add that to 200 magicians, 100 comics, 300 dancers, that random ventriloquist... Etc. This contract is just as harmful if youre mediocre, he still owns you

    My friend's niece was going to be on there, and they had to go sign this. She had to make their own way there. They didn't get to see the full contract, just an abridged version. A solicitor was in place to answer any questions. They also had an 30 minute window to do this.
    She had the fortitude to take her dad along who although not a solicitor, was very familiar with contract speak and basically told them to stick it up their collective arse.

      It isn't morally wrong, it is a company making a profit and knowing individuals considering it worth the price. Do you expect them to say "here's free advertising for you on our EXTREMELY popular show" they have a right to operate however they want, if any of you who are complaining were in the position to write your own contracts, you would realize it is just business. Don't like it? Don't sign. It is morally wrong by your standards but it is a good deal by the standards of people who sign it and instantly become nationally or even internationally recognisable.
      People complaining are just over-entitled brats that expect everything to be handed to them on a silver platter of one-sided gain. Of course, Britains got talent will gain more in this situation and of course, they will milk it as much as they possibly can, they are in the position to do so. Artists that need the popularity so much that they sign that contract are obviously going to fail without Britains got talent and as such will have to pay some price which evidently isn't an upfront fee. If they don't need it and are doing it of their own accord just for greed, that's their problem.
      Jesus christ I hate what this society has become... "This company isn't making it easy enough on me and that's not faaaaaair!!" it's either this contract or a hefty upfront fee, worth whatever you can put on instant advertisement to 8.5 million viewers.

    I'm not a layer, But I've worked with legal contracts before and am pretty well-versed in what they are and what their value is.
    This contract sounds pretty nasty, but there seems a loophole in the wording that can be exploited to shield yourself from the worst part.
    The worst part about signing over ownership of your online content. What you can do is, sign ownership of all of your existing online content (Your youtube account and it's content, twitter, ect.) over to a friend before signing the BGT contract. And let him keep ownership of it for the duration of your contract with BGT. You can then have a gentleman's agreement with him/her (Obviously make sure that you trust this person) so that any profit he makes from the channel and the rest of your content gets sent back to you and that when the BGT contract ends, he will sign your content back to you. This allows you to make your existing tweets and online content untouchable by BGT because everything you've posted is your friend's content, not yours even though you produced it. By the wording you used, it seems to me that only standing contracts (Such as licensing) will make you illegible, meaning completed contracts (such as signing complete ownership of your content to a friend) shouldn't affect your privilege to sign the BGT contact.
    Other than that, make sure that whatever performance you make while your under contract is something that you don't mind losing the rights to. You should make an act specifically for BGT.
    Obviously you should still avoid appearing publicly or creating new content while you're still under contract but using this loophole (Which you can do with other content as well such as CD's and other publications if you want to be on the safe side) should keep your past content completely safe while you pursue BGT.

    A bully from my school who everyone hated went on this show in 2011. He got through to the semi finals and they painted him like a perfect child and. They had all the teachers on there saying he was a golden child and even asked people from my class to go to the news cameras and act like his friends which obviously no-one wanted to do. He got disqualified for something and no-one ever heard from him again, all his social media was down and I never saw him out anywhere.
    Pretty sure now he's working behind the tills in an asda or co-op or something like that.
    now you said about how they own all their social medias I'm wondering if they found out he was an awful child and so made up a reason to disqualify him and not let him online. I just checked and he still doesn't have social media.

    The saddest part is that people go into this with genuine hopes and dreams of making a career for themselves in the entertainment industry, and those genuine hopes and dreams can outweigh the doubts they might have about the contract. And then of course there's people who don't really read the contract and end up signing their careers away. This is pure exploitation and this is the reason I can't stomach any of these shows. Glad you're speaking out about it.

    Just another corporate money only focused company manipulating contestants and rigging the competition so that the most relevant acts win, its not talent, but popularity that's wins. Absolutely all acts who have won the show or competed at a high stage in the show are utterly average at best at what they do, since they're not judged by professionals in that particular skill/art they are performing in. Acts because of this fact dont last long mostly in their careers after winning. But the company owned by Cowell, syco or whoever it is will always drop their act after they dont hit targets made for them, I would presume a certain unrealistic amount of revenue must be earned by the act to keep them on, people are treated like dirt and cast away for the winner of the subsequent year, how many xfactor winners get dropped after about a year lol, having a competition each and every year is completely unfair on the winners aa fhe limelight is taken away from them almost immediately after they win, a career every year is ruined. Yet i will never understand the publics desire to support these evil companies and Cowell, oh yeah i forgot, they target kids and young teenagers who generally do not have enough life experience to understand about money and manipulation, and this dark side of talent shows in general.

    This was really insightful. I expected that contestants wouldn't get much choice with signing on if they won, but the fact that they inherit your own social media material just by your applying for the competition is just ridiculous.

Though as solo artists they are signed off to different labels( Harry-columbia , Zayn-RCA and Louis-syco/arista...still under different branches of Sony). But they have one common contract. They did not allow Louis to get out of syco. And he was probably forced to judge the x-factor 2018.

    And this is how they get away with making some people absolute Butt-Monkeys, constantly showing them in the most humiliating or unflattering light for the world to laugh at - the person concerned is contractually forbidden to complain about it. Their "brand" is "laughable fuckwit" or "horrible ranty person" to contrast the brand of "Most wonderful person", "Most talented". After all, how can we know how great the person being built up is if we don't have someone else to tear down?
    It's an unhealthy, depraved dynamic.
    Other "Reality TV" is just as bad, so the content of this contract is most likely indicative of what's in the contracts for the likes of Survivor Island, The Bachelor, Big Brother etc. If they want to paint you as the villain by focusing on the times you lost your rag or said something that can be taken out of context, then you are the villain - because every show *needs* a villain and how can we advertise our show effectively without putting a clip or picture of someone up with "Is this UK's/USA's/The World's MOST HATED man/woman/child/amoeba?"
    How do they get away with this? The public can't get enough of shit like this and people are so hungry for fame or for the money/contracts they perceive they might get if they win that there's vast amounts of money to be made and no shortage of victims. Passed the initial audition for this (or any other "Reality" programme and don't want to sign the contract because it's demeaning? Fuck off, then, we've got plenty of victims, I mean _people_ who are prepared to sign.
    The show is rigged and uses downright deceptive editing and obligatory "choices" to spin out the conflict, suspense etc? Who cares? Plenty of people will tune in to watch it, anyway - even though a 3-year-old would wonder why the "nasty person" that everyone is hating has made it through to the semi-final and not been kicked/"voted" off already.
    They're nothing but fucking meat-mills; this contract - while truly disgusting - is not (unfortunately) surprising.

    This is why when the producer of the show rang me up (nice enough guy, he had managed Sigur Ros and a few other successful artists in the past) and asked me if I wanted to go on the show and go straight to the TV round I politely told him what I thought of the show. I'm still unsigned, still trying to get somewhere with my music/make a living via it. But I have no regrets.

    It’s with all TV talent shows sadly. A friend of mine auditioned for the voice and then got in and signed the contract blindly since he was only 16 and didn’t know better. He got moved forward to audition in front of the celebrity judges and no one turned their chair for him. They never even put his audition on TV and yet he is now stuck with a seven year contract. He didn’t know about that much about the contract though and decided to work hard for two years to go audition for the x-factor. He auditioned and got a yes from all 4 judges but once they learned he had a contract with the voice they dropped him. He couldn’t get any jobs in the music industry or do anything. Couldn’t even upload his own music online. It’s absolutely horrible.

    A clear-headed adult deciding to sign this contract is one thing. Adults signing away their small children's lives is a whole other level. I don't think a 10 year old let alone a 5 year old really understand the repercussions of signing such a contract. Furthermore, what about people who have a disability that limits their ability to understand this contract? What legal guardian in his/her right mind would sign or aid in signing such a document?!

They're basically contractually obliged not to have a social life, see their families when they want, eat when they want, or even breach the contract since they're monitored 24/7. It's awful and there's basically no way out since their money and lives are constantly being controlled by their management. That's why you've got so many cases of hospitalization due to dieting/stress/exhaustion and dozens of cases of suicide in the past 10 years due to pressure.)

      It doesn't work that way, phone contracts are a popular example used by lawyers to demonstrate this point. Even if you consent to a term in the contract that term still has to follow the rules of contract common law and statute
      Therefore if you agree to a term that doesn't follow contract law, your consent cannot be used to justify this
      A lot of terms in mobile phone contracts are not authoritative but they are put in anyway. In reality the phone company couldn't enforce these terms even if they wanted to

      Most of the clauses in this contract are fair, however, let's go through the ones you see as controversial.
      I'll take it point by point. Having a clause whereby you agree to another contract which is not formed and the terms made clear and explicit to you, would not hold up if they tried to enforce it.
      Contracts also can't act retrospectively, so they do not, and cannot own your previous content. They also cannot ban you from releasing new material, especially not things like Tweets/Facebook posts, only material that relates to the show directly, again, regardless of terms, contracts cannot control your life to that extent and if they tried to take it to court it wouldn't stand.
      As for adapting your image, this means so they can photoshop you onto backgrounds for posters etc. not to make you look bad, as you seem to think, as this clause has clearly defined limits in legal precedent. For example, they cannot photoshop you having sex with a pig and put it on posters, as this would constitute defamation and misleading of the public.
      Next, you say you license over your rights to your original perfomance - yes - you LICENSE it, meaning they don't own it, but they can use it, and this is necessary for them to be able to show it legally on television in the UK.
      You then say it's mean for them to be able to remove them for any reason they choose, and this is fair and normal in almost every contract, e.g. going to a bar, the management always reserve the right to remove the people they see fit, it's to protect against lawsuits from people who think they were unfairly disqualified, and is a VERY common clause.
      As for not appearing online, they mean in terms of interviews, they cannot legally stop your friends/family taking photos of you and posting them online, again, if they tried to ever enforce it in this way it would fail (not that they ever would).
      Not being liable for injury unless you can prove it, what is unfair about that? That is quite literally just how Tort Law (lawsuits) works.
      As for varying the terms of the contract when a clause becomes unlawful - if they modify the contract you always have to agree to the change, this is again - the law. You can choose to disagree and keep the original contract with the (now) unenforceable clause.

    It’s literally a reality show, I expect nothing less from it sadly, I was just at the live show of America’s got talent and literally everythingggg is planned. I went on a Wednesday and the acts sucked so I went on Saturday and all the acts were great and they pressed the golden buzzer. As the act was performing, I looked over to the side of the stage and a crew member was nonchalantly holding a white board telling a judge to push the gold (mainly cuz of the boys inspiring story) so the new judge pushed it

      Don't say that! There are plenty of real entertainment schools designed to teach and foster your talent and further your career. Syco(and many other) makes reality TV shows and are a insult to what art is.
      But you don't need talent, it's all hard work and joy in what you do. If you enjoy doing it, you'll get good at it. No one is born a singer or musician. never too late to start.
      If you look up real competitions, they are night and day with this "talent show." There is barely any talking between judges and performer. No backstory, how beautiful you are don't matter. You speak with your performance. There's a proper dress code, etiquette and skill level required. You are judged based on technical standards(not just insults like Simon) ranging from execution, style, tempo etc.
      There's proper constructive feedback and winning or losing is not that big of a deal since anyone that make it pass the preliminaries already have the skills to have a future ahead of them. What it does is challenging you, a learning experience and helps you grow as a performer.

      Ben Wilson you are right, though in my limited understanding, civil law is much more complicated than criminal law, which makes it way too costly for someone to who is not a multi-billionaire company to take said company to court. Also so much hassle. And unlike the contestants, they can pay for really good lawyers who'd spin the story any way they like. I'm only vaguely aware of a few cases when an individual sued such a big company, and only a couple of successful ones. But then again, I never looked into this properly

      Anyone who asks you to sign a NDA unless it's to do with child protection or state secrets should be treated with extreme suspicion.
      There are certain times when ethically you'd keep your mouth shut such as actors in a series saying something that will spoil the surprise the series has lined up for its viewers. But then, it should only need a verbal agreement not to say anything, not a contract.
      The problem with contract law is that it goes through a civil court and people like Simon Cowell have enough money to pay for top lawyers that you can only dream about affording. The problem is seperating the two terms "Legal" and "Ethical" and judging on the basis of the latter rather than the former. Civil judges really need to start considering the ethical grounds and using that as a guideline since the law is really made in the courtroom based on precedents set by judges. It only needs one case to go in the contestants favour on ethical grounds and that contract would be destined for the bin.

      Tryst46, there are many good reasons for having an NDA. Corporate secrets for instance. You don't want people having access to the source code for your bank's website, and your bank doesn't want its employees sharing inside information with other banks either. If you are an employer trying to hire people and you have a test that you use to eliminate people before first round interviews, you don't want that test and its answers being made publicly available, that defeats the purpose of the test.
      That being said, an NDA that prevents people from talking about this contract sure is dubious. The only reason you'd want an NDA to prevent people from reading a contract that they would be forced to sign at some point is because you know that people won't be interested if they know they have to sign the contract beforehand.

      they are excited that their kid has talent and somebody gives them a stage. and while they are still hapy that their kid got accepted they get that paperwork. not per mail but of course in persoin whicxh makes them feel even more special and even more overexcitzed. the kid feels special and happy too the "salesman" talksd with the kids and the parents "all that´s left is to sign here" and only people working in business know how disgusting business is, nobody really understands the legal euphermisms anyway and the kid is like "come on daddy, sign" and daddy without reading and understanding it signs it. it´s evben more disgusting with kids than how for instance i pressurized customers to taking contracts in the past. It´s the kid doing the job for the guy from sico and the kid has WAY more emotional leverage

    The worst part is that recently on talent shows, I see a lot of elderly people, children, people who seem to come from poor backgrounds I.E. people that can be exploited and won't know any better. And if they try to defend themselves, they'll head to ruin, because they weren't aware of the exploitation until it's too late.

    I was contacted by ch4 several years ago to do a cartoon illustration of the main presenter of a show and also send in my Big Brother Cartoons for them to use on the show later that day!
    They sent over a contract that meant they had full rights to use all artwork for anything, sell and use as they feel fit without even having to mention me or pay anything for 10 years!

    Publishing in a musical sense is not “books” as you stated... it’s much more sinister than that... in this instance it refers to ownership of the songs themself... not the recorded version, but the actual concept of the song... which means as a songwriter, you’re giving away your intellectual property.

    As a fellow musician, I am FURIOUS at this contract. It's like legal slavery!!
    If anyone who is watching this is a musician, PLEASE don't go on talent shows like this. Do the very long way route of DIY. You'll be your own boss, choose your own style, shows and career choices. It will take much longer to get the smallest sniff of success but ultimately any money you make is your own , all social media will be your own thoughts , all the hard work will be earned and you will feel MUCH better.
    I HATE shows like this and this contract makes me feel even worse about it!! YUCK.

      it's just to creepy when I think about it. I went to auditions in a different talent show, and I just skimmed through it, I'm glad I didn't pass the pre rounds, funny thing is, they choose (the best) and (the worst) those in between, that have somewhat talent, but not that special don't get far. so it's creepy they use the worst people just for views and to humiliate them. they handed out stickers before we entered the building (red and green) waay before contact signing, red means bad dressed or funny , green is best dressed. they use that for humiliation as well.
