      I think it was more the fact that he said he lost 100 million dollar with less emotion that you or I would use when saying we lost ten bucks! Which means that loss was not going to affect his life in the slightest while the 14k people he swindled got their lives destroyed!

    McCoy was right... The jury remembered "14,000 lies". That was a key phrase which ultimately let to a conviction.

    This line makes me feel for him so much. Envisioning his life the way it could have been. The way it should have been.

      Is there anyway to get both, or all pieces of each episode? I hate seeing the police do their work to not see the court ending, or vice versa, missing the beginning.

    I invested in a company that seemed, and was mentioned in accredited financial magazines that they were trustworthy.
    When the Lehman Brothers fiasco happened, which also affected the real-estate I invested in, I lost all my money that was supposed to downpay for a house. It took me 10 years to get back up on my feet, and I can thankfully give my wife and son a good life, although without a house as I planned.
    Just hope I never meet one of those SOB's again, since I won't guarantee for anything.

      As a suggestion....Savings are where you put money for the down payment on a house. Or any other short term needs you may have. Investments are for longer term horizons.

    The rich guy was dumb here. He was an unpopular defendant with a reasonable line of defense (dunno if accurate, but there was at least reasonable doubt here). He should have asked for a bench trial and had a judge decide instead of a jury. The defendant always has that option if they think a jury will rule on emotions as opposed to the law.

      Why did he take the stand? That's how the defendant's past convictions were effectively submitted as evidence, by the prosecutor asking him about his convictions.

      Watch Bill Gates testifying in Congress during the antitrust probe in 1998. He comes off as a smug and sarcastic know-it-all. You just know that his lawyers were telling him to dial it down behind the scenes. But when you think you are right, and your fortune tells you you are, sometimes you'll go against good advice.

      @@Treblaine 1. He's basically Bernie Madoff in a way. His convictions are so "public" that it's gonna be tough finding a jury pool ignorant of the fact that he was in prison for it.
      2. His crimes are an irremovable part of the testimonies against him. The very reason he "hired" the man to kill Kopinsky is because Kopinsky was blackmailing him of money that he had swindled. If I was a robber and after I got out of prison, I got revenge on the grocery clerk who put me in jail by beating him up, they can't just ignore that I was convicted of robbery since the circumstances of it directly led to the assault.

      @ Geotpf And yes, it actually is sloppy screenwriting that he didn't ask for a bench trial. The judge may or may not have liked him, but an oath to the law may have saved him on flimsy evidence. McCoy relied on hatred of swindlers to convict the man, not actual proof. Tappan goaded the man into killing Kopinsky but he certainly didn't hire him. Morally, he's guilty. Legally, McCoy abused the CJ System. Thankfully it was only against a Willard Tappan.

    I miss the interaction that Adam Schiff was a part of. He had some of the best interactions on the show and in particular within the Ben Stone era.

      McCoy did what he wanted to win the cases. He decided that any moral opinion or advice that could stem from Adam Schiff was practically meaningless in his pursuit for victories.

    I love how accurately they portray the blitzing speed of the law and the order...the justice system wraps up every case in about an hour, 45 min without commercials... The law and the order is strong!

    This is peak law and order for me! Season 5, McCoy Kincaid logan briscoe and the criminally underrated adam Schiff. I’m currently on season 13 and I still love law and order but it doesn’t even come close to these days.

    I was always disappointed in this episode. As a matter of law, Tappen cannot be convicted. Section 60.22 of the Rules of Evidence for New York State: “A defendant may not be convicted of any offense upon the testimony of an accomplice unsupported by corroborative evidence tending to connect the defendant with the commission of such offense.”
    The fact that Tappen benefitted from Kapinsky’s death (since that is true of hundreds of people) and the fact that he spoke to Curran on the phone (since he did not initiate that call) are obviously not enough - Curran easily could have called Tappen just to create a fall-guy.

    If this was real life, particularly in today’s legal world, the defence would file a appeal for a error in judge instructions to the jury and 50% chance the verdict would be reversed

      How were the jury instructions in error? He told them not to consider the previous crimes. Kind of tough to appeal the fact that the jury disbelieved the defendant.

      theyd be correct to appeal one way or another, theres nothing in this clip(idk about the full episode) that proves beyond a reasonable doubt that the fund manager was responsible for the lawyers death.

      @Angelous Bacon Actually you can if it goes to credibility. Defendant lied 14,000 times, hence even though he is not on trial for past crimes, the prosecutor can question the defendant's truthfulness based on past behavior.

    Imma be honest, I kind of wish McCoy lost this case. It would’ve gave him a sharp reminder that you are there to provide facts so when you rest your case you can be assured that the jury is basing their verdict on the truth and the law. Not because of how their eyes looked. This was early on too so it could’ve helped McCoy see that he still has things to learn and even though Schiff hasn’t been in a courtroom in a long time he still knows his way around one. If you know what I mean…

      You don't understand law very well, do you? Jury trials require a unanimous verdict so you would need all 12 jurors to "rule on emotion" in the same direction. If even one juror dissents and they fail to reach a verdict it's a mistrial and they pick a new jury and try again. Compare that to one judge possibly ruling on emotion with no checks? 1/12 vs. 1/2 odds, guess which way I'm swinging?

    If all you have is $1 million then losing that is losing everything. If you have, say a billion dollars, then losing $100 million is still leaving you with plenty. "Grow up" wasnt the best thing to say.

    There wasn’t enough evidence and the jury was biased and used it to convict him! I hope the other guy got immunity from it because he was ripped off either way

    It's not about how much money you lost in absolute numbers, but about what % of your total weath you lost. The rich can make financial mistakes bigger then the poor and recover, while the poor may lose less in term of absolute number but get wiped out and cannot recover. This "grow up" is the arrogance of the rich.
