In California, the laws states: The marital /spousal privilege in California is the evidence rule that (1) you have the right not to testify against your husband or wife in a criminal jury trial when he or she are charged with a crime, and (2) you have the right not to disclose any confidential communications between you and your spouse.

At issue is the right of the accused. A spouse can, as the scene makes clear, give testimony against the wishes of the accused IF said testimony stems not from privileged communication between the two but from evidence gathered by the spouse absent a privileged communication. Basically it’s the accused who has the right to say no you can’t use my privileged communications with my spouse regardless of how they feel about it, but if the spouse learns relevant information on their own it’s up to them whether or not they choose to testify if they’re so compelled.

      WHO THE HECK IS SARA?
Edit: Now I have learnt that in a later episode (S9 E22 maybe) there is a murder victim named Sara Kincaid, I don't know if Antonio Costa mistook Claire Kincaid for Sara here.
