  • Plastic surgery clinic Wave Plastic Surgery Center in Koreatown is suing a TikTok influencer, Tina Kim, over her video in which she told her tens of thousands of followers not to go there after her experience.
    FoxLA interviews business law attorney Ugo Lord for his legal perspective on this fascinating case. The key to a successful defamation lawsuit is that the plaintiff must prove the statement is false. If the statement is an opinion or an overgeneralization, or if the statement is substantially true, a plaintiff will not succeed. Although this lawsuit is still in its infancy, the facts of this case indicate that it will be an uphill battle for Wave Plastic Surgery Center to succeed.
    This exclusive FoxLA coverage shows how influencer Tina Kim may have gone a bit too far and stepped into legal hot water. Instead of limiting her review to her experience, she attempts to drive people away from the facility by saying, "Do Not Go to this Wave Plastic Surgery Place." Additionally, it appears she exaggerated when she stated she waited for "like almost 15 minutes", but surveillance cameras show she only waited 4 minutes.
    With that said, mere exaggeration is not enough to be found liable for defamation. The plaintiff must still prove that the exaggeration was made with malice or a reckless disregard for the truth. If a court finds that Ms. Kim's statements are substantially true, the influencer will succeed. Considering Ms. Kim clearly calls this video a "review" and goes further to say that it is not a reflection of the doctors at that facility but just her own experience, Ms. Kim has a strong probability of success. It is unlikely that an exaggeration of 11 minutes rises to the level of malice or reckless disregard for the truth absent further evidence.

      Me, too! I was so relieved that he wasn't the one in the hot seat! He was, instead, tapped by this news program to use his talent in translating the law into layman's terms so that we, along with the newsmen, could understand the nuances of this case.
      The "influencer" obviously overstepped when she went on her tirade against the "Wave" personnel. Truly, since she just walked in without an appointment in the first place, I feel that she was trying to make something happen, stirring things up, just for the attention. I see more videos of these "influencers" doing stunts like this and thinking they can say or do whatever they want "'coz it's for TikTok"😎 or whatever. Their mantra is, "Do you know who I am?" 🤓🥴💩
      And, it is getting worse every day. Sigh...🥺 😡😡😡

      It appears that she exaggerated 11 minutes, but it will be difficult for the plaintiff to succeed in this case. If a court finds that her statement was “substantially true“, then the influencer will absolutely win. The business has to prove the statement was said with “malice” or a “reckless disregard for the truth.”

    As someone who used to have to watch cameras as a manager to investigate claims when people called corporate, I can tell you this is pretty standard. 1 minute is 5 minutes, 10 minutes is half an hour, and if they wait for more than 15 they're gonna tell you they've been there for over an hour. They're always going to stretch the truth, you'll see a ton of employees who are supposedly "yelling" at the customer calmly standing behind the counter. And they'd always throw in weird stuff like "employee had their phone out" or "employee ignored me" when it didn't happen. So even if a nugget of truth was in the complaint, it never really got the employee in trouble because the customer proved they were lying and if the employee denied it then that was it

      I was a manager at a DQ many years ago and I did a turn around shift. 30 minutes after close when we were about to leave a woman was banging on the door claiming her phone said it was 9:55 pm and we needed to let her in even though it was already 10:30. I calmly told her , sorry, your phone is wrong, it's 10:30 and she started screaming how she knows the manager and how I'm getting fired. The next day shortly after I opened the DQ, she calls, makes up a story saying the guy at night was screaming at her, swore at her, used racial slurs toward her and she was demanding he be fired. I said "So im going to stop you right there, you're lying to me because I was the guy you screamed at last night and I'm the day time manager you claimed to know and I'm not firing myself because you can't read a digital clock. We also have you on camera with audio so feel free to call the owner when he is in, he's already reviewed the tapes and is prepared to fire you as a customer"
      She swore at me so I hung up. We never heard or saw her again.

      I worked backroom at Sears and did merchandise pickup. People would say they waited twenty minutes when the timer literally said 6:00 minutes. Fair enough it was over the 5 minute guarantee, but you don't need to over embellish it.

    An influencer certainly has the right to their freedom of speech, but they are also held to the same standard as journalists of the past. She straight up lied with malicious intent due to her god complex from being an influencer. I hope this case punishes her and shows to modern influencers that their words are taken seriously when it comes to business.

    I think what Ugo is referring to as "malicious" is getting more common, and businesses are fighting back. Courts have ruled that reviews are no longer considered to be protected speech, and as a result businesses (especially hotels) are starting to go after people who write malicious reviews. People get their feelers hurt when they get charged for smoking in a non-smoking hotel, or they get charged for damages, so they write a negative review nit-picking their experience. Happens a lot, especially by local guests.

      1 person's bad experience and exaggeration shouldn't be taken as a fact...
      And if that person isn't a person with actual clout or credibility (or connected with something credible) then they shouldn't be taken as credible and their reviews should be taken with a grain of salt.
      My issue with this is that some random TikToker is getting the same credibility as a proper journalist.... which is actually quite scary if you think about it...

    I don’t have TikTok and definitely don’t listen to so called influencers. I do look at reviews and from regular people and decide if the spot is worth spending my money on.

      No, the biggest problem with influences is that people are stupid and take them at face value...
      1 person's bad experience and exaggeration shouldn't be taken as a fact...
      And if that person isn't a person with actual clout or credibility (or connected with something credible) then they shouldn't be taken as credible and their reviews should be taken with a grain of salt.
      My issue with this is that some random TikToker is getting the same credibility as a proper journalist.... which is actually quite scary if you think about it...
      Think about it... did this lady even realize her random 30 sec clip could actually do such damage???
      Honestly, I think it's worrying that people even gave her "review" the time of day...
