She said “FYI I’m an influencer…” says it all. I hope they sue the crap out of her.
I think more importantly, I hope they actually win the slander lawsuit! Suing her for an exorbitant amount of money is one thing but suing her for a reasonable amount of money and demanding a public retracting statement would be very fitting and would also make people second guess her other reviews.
A lot of these so-call "influencers" are just Karens with a phone. I hope the clinic sues her into oblivion.

Visited the medical office without an appointment and ended up wandering aimlessly in the lobby - quite an unusual experience. Claiming to be an influencer only added to the awkwardness. Certainly not the best representation for other good influencers.

you have a limited and bigoted and biased view of the entire picture. there is good and bad, and you are blocking opportunity to benefit from the good influencers.
There are certainly good and bad. I have quite a few favorites, but I will remove them if they really screw up, unless they acknowledge their mistake, and work to correct it.
Many of the bad influencers are straight up narcissists! They go out, camera and mic, in hand to harass business owners. They demand free meals, free merchandise, and free services! These businesses, in turn, expect the influencers to be respectful and honest, but mostly to have a large following, and actual influence on the right group of people!
Those who refuse to give them freebies, often end up with a live, bad review!

I have read some negative social media ratings that I knew where unfair because they were places I shopped at for years. One example was a eye glasses store run by a solo optometrist. The customer was offended she had to wait 15 minutes, while the owner was on the phone. It didn't occur to her that he still has to call/speak with many vendors that provide supplies, eyeglass frames and lenses, etc. He doens't have a steady stream of business that would justify him hiring another person. But, he has been in business for 40 years, so I think he knows what he is doing, and I did call out her comment. However, if no one did and you read the review you might avoid going to that place, even though he is one of the best places in the NYC area (in terms of price, selection, service, etc.).

This news channel completely cut Tina Kim's rant about horrible customer service to make it seem like she badmouthed the business itself. She explained how they were rude on the phone when she called months prior, she happened to be in the area and walked in. Im sure standing 5 minutes being ignored feels like 15 minutes the customer service is bad.

Yes, she never did anything or had an appointment nor had schedule. Very odd for anyone to do such thing. If you watch her TikTok video she even said by herself that she just walked in without schedule and wasn’t their patient. I find this very odd and strange that people would want to pop in a Plastic surgery center to walk around and look at the brochures. On top of this she lied about how long she stayed in the lobby. To me this is a malicious attack and abusing her “influencer” power on regular work people.

And 2. if your overall review is telling people don’t go because of your experience, I don’t see anything wrong with that either, it is up to the viewer to make their own judgement themselves. There are lots of reviews on yelp that say Don’t go there because of their bad experience.

Someone who claims to be an influencer however is expected to know the ramifications of their actions whether it happens or not, it's literally the title they are self proclaiming. There is a very good reason why slander/libel laws exist.

I have been involved in many defamation lawsuits, which it may be said that it is a double edged sword! The business owners actions and/or response to negative review (true/not) has repercussions that could result in business loss. Any business that sues any patron could be canceled. For example in the case bar, not because of of influencers video (I am not even on tic tok) but for the simple reason that business owner/doctor decided to sue patrons of his establishment is a real big turn off and frankly I wouldn’t go there or anywhere similar or like. Who knows that perhaps they may end up suing me if they don’t like my review. But here by the business own actions and/or admission, essentially only highlights this case and could have more of a negative impact that desired results.
The best way to combat defamation is not to sue but to burry the action either (1) posting a response; (2) warning the person privately (3)etc. Going on the news only draws more attention to the issue. Lastly, people often can survive a defamatory statements whereas business who take any action may have a harder time. We live in a vocal time where social media and the court of public opinion is at times stronger and/or more impacting. Either way it’s a sensitive issue and each case must be handled in a way that minimizes/does draw too much attention to the original/initial post or statement.
Ohh shut up! Stop making excuses for these Karens! The judge sided with the business!

this is not how the libel and slander laws work. customers are protected under the law to be able to give reviews of businesses. there is also consumer protection laws and this is part of it. libel and slander only works in certain circumstances are met. reviews from customers is a protected act under law. this helps keep business from being corrupted by allowing for customers to complain and report and do reviews to help keep integrity of businesses good. the professional way for a business to handle it is own up and apologize for the misunderstanding or whatever. instead he is trying to silence a protect act she was doing.
me personally am sick of health industry and the staff just being absolutely aweful myself. including hospitals. so it's good people shine light and awareness of what is happening. this will help raise standards in society. it's incredibly common for health industry to be just aweful at serving the customers. they know problems exist, lack of growth in the industry lack of ability to serve customers lack of job creations, in general high amount of antitrust violations and price gouging. and just lack of care in general from health industry through all layers including cosmetics or other industries like i wouldn't be suprised plastic surgery also.
so the business should lose this lawsuit as a frivolous lawsuit.

however she is just a consumer a reviewer, mostly fraud is against contracts and businesses who do it.
IF she filed a complaint with a govt agency about the business and did fraud on the complaint, then a lawsuit against her for that would have merit behind it. much more so because there is expectation of honesty when file complaints with govt agencies.

but i'm not perfect as said. if you see something i said that seems wrong, i'd like to learn. but i'm just sharing how i think the lawsuit should or would turn out with my knowledge of law. i'm open to learning if you knowing anything i dont please do share.
