Wish there was legislation that imposed a $1M fine every time a DMCA takedown is even filed. We need more protection against these anti consumer businesses and practices.

Japan was and is and U.S have become pro corpos and anti-consumer.

I think it would be more likely for the DMCA to actually be repealed in its entirety than for that to happen, since that basically amounts to punishing companies for sending DMCA notices. And I highly doubt anyone, even reasonable politicians, might be willing to scrub copyright protection from the statute-book.

My dream is that Nintendo sustains extended losses with failed hardware and are force to pivot to selling software on third party platforms instead. Imagine being able to buy Zelda and Mario games on Steam, officially. I would be first in line even though it's already easy to play them via emulator.

If a game is available on multiple platforms, I will ALWAYS avoid pouring more money into Nintendo's massive DMCA budget.

Well all I have to say is that all people have to do is get a copy for now since it’s maybe maybe just months away that people will be capable of dumping the cpy into an AI and have it do a complete reconstruction according the user’s preferences. As one working with AI I know it’s so easy to do that it’s actually harder to prevent people from doing than the actual setup.
The company’s know this and want to create a precedent before the AI capable get released to the public so they can keep an iron grip on the direction of tech advancement.
I remember when Nintendo was struggled with money in the WiiU era due to the bad sales that reach to the point that the president had to cut his wage for avoid layoffs to the employers.
Now it looks like Nintendo has tons of money to spare for pay lawsuits every second with DMCAs.
It would be better if use the money for improve more their hardware and developing games instead.
Edit: Nice to see new improvements for GB Studio!, I tested before and it's a pretty cool game engine for development or messing around if you want to start into game development.
To be perfectly accurate, Nindo _always_ has money. even during that period they had billions in the bank. The CEO did that as an effort to take personally responsibility for the failure of the product more than to save jobs, it's a very Japanese thing to do.
But why are they gonna improve their hardware if they sell asFK with the actual status of the console? Soon the switch sales will reach PS2's sales.
Iwata was a good dude but it was Japanese culture and labour law that lay behind his decision too. And Nintendo was aggressively protective even back then…not to mention sending DMCA claims doesn’t really cost anything.
If anything it’s probably down to increased awareness of fan work on their part + probably the use of AI to process and send DMCA notices faster and across a wider scope than ever before.

Clearly, Nintendo’s DMCA rampage must be some kind of guerrilla marketing tactic for Luigi’s Mansion 2 HD. By ‘killing’ all of these great fan works, fans will be thinking about death all the time, which will perfectly set them in the mood to suck up some ghosts in a full-price remaster that looks like the original game running through an emulator. If this isn’t Nintendo’s marketing strategy, then I guess they just expect people to blow $60 on a game with next-to-zero advertising that they won’t even let you preorder.

These Nintendo lawsuits make me hope that their software and hardware sales are commercial failures. So Nintendo is forced to put their titles on at least Epic. One can only speculate what Bandai Namco were trying to accomplish with Metroid Prime 4.

I hope that the dev for PSOff gets through whatever it is that's thrown him off, and that when he's ready to do more, he just joins the RPCSX or another PS4 emulator team. We don't want our talent all reinventing the wheel separately.

Why doesn’t everyone just gang up and all agree to not purchase anymore Nintendo games until this settles down? Seems like it would be easy enough with enough news and social media outlets.

Nintendo has targeted casuals and general audiences for years, and those just so happen to include the people detached enough not to care as much about deeper gaming discourse and issues in gaming, including the emulation issue. This means Nintendo benefits from its target fanbase being less aware of the current state of gaming, giving it more leeway to do what it likes without reckoning with heavy public pushback. And on top of that many people are emotionally attached to Nintendo games, particularly due to exposure at their most easily influenced period (childhood), which results in a warm and fuzzy view of Nintendo and their products that’s harder to shake.
What all this means is that their crusade against emulation will be very slow to make any kind of noticeable impact on their sales…plus, even if it could, they might probably just interpret it as a problem with the games or console instead of with their business strategy.

@@VerbDoesStuff Well, you've seen how many people paid for and enjoyed the Mario Movie (especially kids), and how many kids right now are playing games on the Switch or some other recent Nintendo system because their parents bought them one. Nintendo can bleed a few people who grow up and become adults, and who might even realise Nintendo's nostalgia-marketing schemes and detach themselves from their psychological marketing tactics, because Nintendo can count on a revolving door of new fans at a young and tender age coming in to have their brains moulded into adoring fans, and on a large majority of casual players who are simply detached enough from gaming discourse that they couldn't give a damn about the emulation issue and just want to play some games in the most obvious way possible.
What Nintendo does by going after fan works and emulation doesn't do their reputation any favours, but I fear that it doesn't do it much harm either for this particular group-in fact, the success of legal action may bolster people's beliefs in the whole "Nintendo's way is the right way and everyone else they went after was unlawful", in something of a weird opposite counterpart to the oft-cited Gabe Newell principle. Piracy may be a problem of service and convenience, but its public image among the majority of casual fans may instead be a problem of publicity and "spin".
Now, of course, all of this depends on parents introducing the Nintendo drug to their kids, so a wider shift in consciousness among Nintendo parents may trickle down and affect fan consciousness across the board, prompting new change. Perhaps with enough aggressive legal action that interferes with stuff most casual players are likely to actually care about, enough negative public opinion might arise for Nintendo to be pushed into changing its tune. But with an audience that's already less likely to be in tune with gaming news and discourse by virtue of its very nature, it should be understood that it's not simple at all for such a change to materialise.

The last time I i bought a new Nintendo product was a Wii at release and a few games in months after release. Nintendo didn't get any money from me since. Thanks to some folks who sold their used consoles I never gave Nintendo a single dollar or Euro for that matter but I played every game I wanted to play so far. And I don't intend to give Nintendo a dollar in the future either. 😅

I am utterly clueless how this company still has any support. Maybe it's me, I guess, but I've never cared for any of their properties, so, I have no qualms with them going bankrupt someday. I pray it comes to pass.
Because people keep buying their products. For Nintendo to take the hint, people need to stop buying Nintendo products which convincing people to do that would not be easy to say the least.
I personally love allot of their products, mostly retro though. I haven't owned a new product from them since the wii and ds though. I got my N3DS second hand, along with all of its games and just emulate the switch. Their quality though has seen a noticeable decline over the years.
Nintendo still manages to have support primarily because they’re that good at capturing the public consciousness. Right from the start, Nintendo’s been appealing to less hardcore gaming crowds, casual players and the general public for ages, providing them with an easier-to-influence captive audience who’s less familiar with gaming discourse, controversies in the gaming sphere, and what other publishers and hardware makers are doing, giving them less of a basis of comparison for Nintendo’s weaknesses. This allows Nintendo to get away with a LOT of what they do.
The effect is particularly pronounced since Nintendo appeals to kids so much by virtue of its family-friendly games, allowing it to capture the preferences of people right from a tender and easy-to-influence age when they’re still developing their emotions and preferences. Call it indoctrination if you will-this instills a lifelong attachment to Nintendo’s games and, by association, the company themselves, which can become harder to buck even with awareness of their controversies.
Effectively, Nintendo gets away with being an obsessive control freak IP landlord (as well as with its many other instances of anti-consumer or outright dated practices) so often because it’s built such a name for itself in the industry from years of targeted marketing, cultural integration, multimedia and merchandise, all culminating in a devoted and faithful psychological attachment or acquiescence among the people that make up a large proportion of their consumer base.
Well then someone needs to get into the headquarters computer networks to find out who the lawyer's names are and spread awareness so people would know who the heck is the one causing these DMCA's/Takedown notices in the first place. Unless we know who these people are, then we're playing a game of cat & mouse+whack a mole in order to find other ways to keep these stuff up long after they haven't been supported in a long time.

Projects like that do exist, just search around for things like "Sega Megadrive IDE" and various homebrew and wiki development sites.
SGDK is an example, as well as CA65. 😄
They aren't an exact copy and don't make everything as easy, but they function as really good starting points. 😄
