It seems like for the rest of the movie after this scene, Harry has been driving his dog van illegally because the police officer never gave Harry his driver's license back. Luckily both Harry and Lloyd have been switching seats back and forth where sometimes Harry would drive and sometimes Lloyd would and if they got pulled over again by a police officer (lucky for them they never did), it would be better to have been pulled over with Lloyd driving (that is, hopefully if Lloyd had his driver's license with him).

You can't arrest or give someone a ticket unless the bottles were open with alcohol in them. Imagine taking your beer/wine bottles to a bottle depot for recycling and getting a ticket because they were open yet has no liquid inside? If they were full they would have to test the bottles and to find out it's piss or water and not alcohol they can't do anything. At this point it's just a bottle with water and piss.
