A constitution exists to protect the individual from the tyranny of the state or even the tyranny of the majority. When the state does not honour a constitution they become criminals who need to be jailed or failing that it is the Constitutional duty of the obedient citizens to arrest them.

Many have bank loans or bonds on their property some large amounts outstanding. Who is going to settle the bank?? This whole idea is not practical. What did they do with all the income of services , municipalities etc? Afriforum, you guys are doing an amazing job, period. Taking a leave from the ANC's book when they involved the international community and rallied the opinion against the apartheid NP party at the time, is an excellent strategy which worked against apartheid and will also be effective against reversed apartheid. Already countries like America, England and Australia to name a few has provide their opposition against the attempts of this failed government to try and justify land Expropriation without compensation. This attempt will inevitably fail just like the attempts of the apartheid government failed. The ANC is under pressure due to their failed policies being in power for far too long, being held in power by the ignorant masses who remain voting for them election after election. I want to point out something... How many people will understand what is being referred to here or care about the outcome? If so many live in squatter camps, live in slums, or below the bread line, then how does one make a case to be heard and taken serious? Take the small town where i live and the 8000 people that make up the residents that live here. Only a few hundred of these own a title deed to their home in the town. To this day, the municipal owns a lot of the land/open spaces in town and some land around the town to eventually "grow" the town... However, many of the 8000 people living here, live in government granted houses and don't have deeds, those living in back yards dont have deeds, nor does those thousands living in the squatter camp on the outskirts of the town on municipal land. Where they come from and why they flock to the small towns like these, one would not know. But, when it comes down to a vote, the 8000 have voting rights, yet only a few hundred pay levies, rates and taxes, water, power and for services in town. How is these municipalities then to survive or uphold property rights? If we vote about it, then those few that still own houses would be out voted. When they take my house, i have to accept it as a law abiding citizen... yet if they move people that dont have property rights in a squatter camp, they burn down the area and bring the town and its economy to a stand still. How is this productive and something that you can build on? If you give all of them living there houses, they still dont pay for services and dont abide by laws, do what do you do? Here in my town the amount of houses given to people far outweigh the amount of houses that where build by buying land and building a house by the private sector... These people pay very few to no accounts ito electricity, water, services, etc. How does these municipals survive financially and how do they then ensure longevity of the town? They cant expand... how do we get this message understood by so many people that have nothing to lose because they refuse to privately buy and build etc.?

The other fact is that the constitutional court comprises politically appointed judges. They are supposed to keep Government accountable to the electorate.
Irrespective of that there is a potential issue that these judges may be beholden to a particular view of a political party in essence.
What everyone seems to forget, it is the Citizens that put a political party in power.
Therefore, the political parties are beholden to the Citizens and so are these Judges who make rulings on constitutionality of law. They have any right to change the constitution. It is not their prerogative.
The Parliament which is made up of a bunch of politicians have no right to amend the constitution without express permission of the electorate who are the Citizens. This prerogative to change the constitution therefore is vested in the Citizens and a 75% majority must be the agreed percentage not a simple majority in Parliament.

From a demographics and democratic perspective, everything that was said in this footage doesn't matter in South Africa because people of colour are a minority here. The ANC is approaching the land issue from a "majority" angle. The pre-text in the draft bill and the eventual act will most probably be heavily infiltrated by a historically informed background with a "reparations based" future orientation. That`s how they will approach the courts and that`s how they will win the case, that`s if it makes it to the roll.
The ANC has managed to stay in power, and abuse office, for so long because of the "majority (democracy)" narrative.

We built this country over 500 years. Now is the time to do your part and discuss the self determination of the cape.
South Africans can no longer afford to suffer from masochism and stockholm syndrome. We want to enact our international, CODESA and human rights to self-determination as what is happening in this country is exploitation, abuse and meets the international legal definition of genocide.
It would function to hedge governance and hold RSA to higher standards less risking losing citizens to the Cape, rather than them fleeing overseas they remain in the region. You wouldn't need to leave RSA to overseas but would have a less extreme alternative. We would retain human and capital resources.
What we are proposing would give you the freedom to continue to live under the current trajectory, treatment inter alia. But to resist a referendum would be tantamount to infringing on our rights and quite frankly the best option for this region. Hedging Governence will lower the risk of the RSA public servents being able to afford to enact communist policies less risking a loss of resources. It's a win win situation.
Let everyone consider the freedom to sculpt a harmonious and prosperous future for themselves and their children by hedging governence with self determination of the Cape rather than endure the untenable social, economic and psychological abuse and exploitation at the hands of people with naturally occuring differing interests.
You may feel free to remain a citizen of RSA but don't hold us hostage. Say no to being gagged, say no to masochism, say no to not having a say, say no to stockholm syndrome.
I guarantee you everyone in RSA will be free of the current dispensation's policies by standing together and demanding self determination of the Cape.
Let us plant the seeds of harmony and prosperity.

A Constitutional court does not have the right to overrule the majority decision by referendum whether he (Adv Oppenheimer) likes it or not. It was the decision of the majority by referendum who allowed de Klerk to ending apartheid was held in South Africa on 17 March 1992. He (Adv Oppenheimer) needs to smell the coffee.

Millions of hectares of valuable arable & pasturable land are in the hands of kings, chiefs and indunas in South Africa for many decades, which is completely left out of the equation and little said about. The truths about these millions of hectares, thousands of black people who live in the towns and cities have large allocated portions and have communal use on some portions of this land. Many have large herds of cattle, sheep and goats back at home at their homelands. Because these portions are not registered in the deeds office, it is purposely left out and not honestly brought into account when land is theoretically debated. It is about time that reality also brought into account. Many of these “portion owners” are far richer than revealed and disclosed. It is common knowledge that many of these herds of livestock owners own up to 200 x head of livestock. Actually many millionaires in their own right and nobody speaks about it.

It was the biggest in the southern hemisphere, now that government owns it, the workers haven't been paid in 18 months and the government has to pump more money into the farm to save it.
