  • The plaintiff says she was friends with the defendant, who she says is a horrible person. She’s suing her for a bounced check, and overdraft fee, and emotional distress. The defendant says the plaintiff badmouthed her on social media and made fun of the fact she had cancer. She’s countersuing for harassment.

    I was diagnosed with cancer in 2013 as well. It’s hard to believe it almost 10 years. I wouldn’t wish cancer on my worst enemy.

    Don't make fun of a person sickness, this is a true story, I worked with a lady that made fun and laughed at a coworker, the coworker was diagnosed with breast cancer, she was dating this person husband, approximately 6 months later, the coworker was diagnosed with breast cancer, the coworker passed away before the person she had made fun of.

      Yeah right. But it’s okay that the bank took the SSI for her daughter who has a disability and that the defendant admitted to stealing. Is it wrong to make fun of ppl because they’re sick, yes. And based on your own story you can be sick and still be a hole. She doesn’t have to have empathy for her. Especially when she has a child who’s actually battling an illness and not scamming ppl.

    Sounds like the friend was trying to do bank account fraud - she knew the check would bounce. Anytime someone asks to deposit a check in your account, friendship is over…

      Yeah, I definitely think it was some kind of fraud. The defendant said she got an insurance check but had never made payments to a finance company before so she didn't know she had to send the check directly to the finance company and she could just deposit it into any account... But she spent $500 of it knowing it was supposed to go to the finance company? Sounds like she was trying to defraud somebody.

    How do you have a disabled child and you still say stuff like "I'm not[sorry to hear she has cancer] " in regards to feeling bad about someoned diagnosis?

      Sounds like she got into an accident and her car was totaled. Then, the insurance company gave her a check for the value of her car and she cashed it knowing that money didn’t belong to her. It belonged to her lienholder. The lienholders name was on the check and because the lienholder didn’t sign the check it “bounced.”

    I think the defendant was just trying to commit insurance fraud.The check was for car damages and she had a lien holder so that typically means its a 2-party check issued between her and the lien holder and she was supposed to sign the check and send it to them but she tried to cash it instead and the insurance co stopped pay on that check and sent another one directly to the lien holder which caused that girl's account to be jacked up. smh

      If the check was in the lien holder’s name, the lien holder would’ve had to endorse it. If the check was in both the lien holder and the defendant’s names, they both would’ve had to endorse it in order for it to be cashed. The plaintiff wouldn’t have been able to deposit it without both endorsements and the defendant would’ve had to sign the check over to the plaintiff (which probably happened) in order for the plaintiff to deposit a check made payable to someone else. Most likely, the plaintiff did a mobile deposit in which the bank automatically deposits the money and verifies everything later - this is where it was caught and the check “bounced”.

    I am so sorry about the defendant's diagnosis, but her story is just not making sense. Financial matters are not this intricate The plaintiff should be careful about how she talks about people. She has an ill daughter and often those type of things humble people. Not in this case. They are both young, but their maturity level is that of adolescents still in middle and high school.

But the supposed friend is truly a bum, cancer doesn’t remove a person’s requirement to be a decent human being. Stealing from a friend and giving someone a bad check then spending the money, is some wicked action. If she did it in her own bank account ok (still bad but it would only be between her and the company) but she sought the plaintiff out to scam her. That is a bad person!

    Checks issued by insurance companies must be signed off by both her & the finance company before they will be cashed. She tired it with a scam.

    Whilst the defendant sound very cheeky about the bounce insurance check and the result of it in plaintiff's bank account
    The plaintiff in the other hand was insolent and one day she would want others to give her grace and forgive her; no need to calling her rude names, that is too much and very out of pocket with all her unkind comments
    Proverbs 18:21, and the plaintiff needs to be privy of this, for karma karma will rear her head the plaintiff's way
    Words matters, even if the plaintiff was wrong and bear no accountability from the know how of the rejected checks
