I’m still “ employed “ by my job after an injury and I’m collecting workers comp . They told me only come back once I’m fully healed. I applied for TDIU and got denied but va increased my depression and migraines. . Can I file for TDIU ?? Need some help. My lawyer said I can’t file once I’m still on the books at work.

I had a c&p exam on 03/02/23 with va contractor QTC for an original claim with conditions of chronic kidney disease, gout, and sleep apnea secondary to anxiety which I am 50% service connected .I am also service connected for SMC K .I was given an at least likely than not for all three secondary conditions. Nine months later while waiting for claim to close I received another call from the va to have another c&p with va contractor LEH for the same indentical secondary conditions and their examiner said less likely than not on all three secondary conditions. Shouldn't the va had gone with the first examiner? I filed a HLR two months ago and waiting.for informal call.If denied I want to file a supplemental claim with you guys I'm diagnosed with all the secondary conditions. Thank you

What if you don’t stay at a job for a long period of time if you stay at a job for less than 6 months at a time because of your ptsd does the va look at your social security statement to see that you haven’t held down a job I resigned from jobs due to personal reasons I didn’t say because of my ptsd.

Yes, VA will go to SSA to look at your statement. I'm doing TDUI and I submitted my SSA statement to VA to show I have not worked since 2002. TDUI takes a while for VA to complete.
