      Isn't cross examination usually shorter than direct anyways?
      Since you know, during direct you try to paint the whole picture whereas during cross examination you literally just focus on specific things FROM the direct.
      Not trying to take any credit away from him here or anything, just saying afaIk cross is usually shorter than direct anyways.

      Cross examination is not limited to replying to direct testimony. Redirect, however is limited to replying to cross and recross is limited to replying to the scope of redirect. Then that ping pongs back and forth redirect+recross as many times as necessary to exhaust all available lines of questioning. During cross examination, counsel can enter their own evidence.

      The prosecutor had to establish a foundation before discussing the traffic incident. Thus, police officer background, training, and general experience need not be repeated unless something out of the ordinary occupied in the past. Defense need only concentrate on the incident at trial.

      It's the VOICE OF POWER, the NO NONSENSE, I AM YOUR MASTER. They have forgotten what it means to be simple human beings with all the failings that ordinary people exhibit. They consider themselves to be beyond reproach, yet yet the truth is far from it. Wife beaters, sadistic thugs, murderers, you name it and the police are well up there on the list. Trouble is that they tend to get away with it, because gangs of thugs don't generally visit their homes in the early hours to kick the door in and go in blasting.

      She had alcohol (vodka) in her car. I know we have issues with law enforcement but she was not legal to drive. Her life and lives of others are in the balance.

      I agree with you. We need to get our counties and cities to change the big bad cop plague. Cops do no know the lae they are told to enforce. It is costing tax payers and people who are becoming victims of cops demanding that we go against our rights to comply with them breaking the laws.
      There are good cops and bad cops. We need to force these bad ones out.

    As a licensed nurse, I had to take 4 pharmacology classes to learn drug to drug interactions, side effects, adverse reactions, etc. as well as anatomy, physiology, biology, etc in order to competently perform an assessment on a patient.
    How can an uneducated cop be considered competent to perform a health screen or assessment on anyone? One week in their academy and they are experts on pharmacological/chemical effects on the human body? The power to ruin lives on top of it. SMH

      **@Chevelle 1...** My sister is an RN as well, we have talked about this subject many times, as she herself used to be an RN for a county jailhouse. She was only there for a very short period of time, as she was always trying to be coerced into "falsifying" blood test results!!! Even seeing Deputies adding alcohol ( Tequila, rum, whiskey, beer... whatever the Deputies were told by the driver, or thought was the drink of choice by the driver, who is now... "the Arrestie!" ) in order to bolster the counties case, because at the time, with M.A.D.D., S.A.D.D., etc. getting LEO's money for all three events... ( 1.) stopping an impaired driver, 2.) arresting an impaired driver and 3.) getting a confiction from an impaired driver, they were paid very nicely for those events!! And in many cases, with 🤑 money 💰 hungry LEO's, they were stopping everyone and their mother, having drank or not, and going through the motions of "a roadside pirate" ( that is what a LEO is when they manufacture DWAI's, DWI's and any other "fake impaired" drivers just for the money!! ) So my sister did a mix of being pressured/threatened into lying and or falsifying blood and or urine tests, something in which she WOULD NOT DO, and QUITTING that shit job, quick, fast and in a hurry, SHE WAS NOT GOING TO LOSE HER LICENSE FOR A FEW HUNDRED DOLLARS ON "FREE DWI MONEY!!"
      Eventually that lead to some county administrators who posed as they had been drinking, put Tequila or Whiskey on their face and arms like a cologne or perfume, or mix the two, even controlled burning of oak leaves ( the symbolic irony of that...!!! ) inside their cars to mimic Marijuana and all documented by the state Governor's office, because his daughter was pulled over for what lead to a DWI, AND SHE WAS STONE COLD SOBER, as she was with her family all day, including her father the Governor AND NO ALCOHOL WAS CONSUMED BY ANYONE AT THE EVENT THEY ALL ATTENDED!! Yeah... shit gets deep when "free money" is on the table!! Alot of upper brass as in "OAK LEAF WEARING MAJOR's" ( that designates a major and is worn on the collar tips of the uniform Shirt ) were fired for being in on the "money grab!"
      Buttttttttt, you are right about the roadside experts as in Dr.'s and nurses!! Although, you forgot a few... A.) Expert drivers, B.) Expert speed indicators, C.) Expert marksman, D.) Experts in descalation, E.) Expert fact finders, F.) Expert weight watchers, G.) Expert knowledge of law, and last but certainly not least.. H.) Expert negotiators!! JUST TO NAME A FEW.... 😆🤫🤔
      BUT... HERE'S the thing, we in 2022 ( and in all fairness over the last couple of decades... ) have allowed this to happen!! We all got "fat and happy," comfortable really, in our lifestyles, thus allowing for ALL THIS SHIT TO HAPPEN, I think it started out with good intentions after 9/11, but the LEO'S of N. America got too big for their own good, and they think they can make you do everything and or anything they want, ALL while they think every command they give is LAWFUL, THESE VIDEOS SHOW that about 5% of what they do and say is lawful... the rest of it... they make up as they go along!!! THINK 🤔 ABOUT IT!!!!

    This Trooper is a proven liar. He perjured himself in January in an excessive force case where he claimed, under oath, that he did not use any force, fists, or a maglight to beat a compliant subject. Then the home security cam footage proved otherwise. Why is he still wearing a badge?

    It's amazing to me that in the US an officer must complete 6 months (even less) to become a licensed officer that can take away your freedom, but it takes 2 years to become a licensed cosmetologist to cut someone's hair.

    I'll never forgot my high school health class teacher brought a cop in to scare us into not drinking or doing drugs. The cops picked random kids in the class to do the sobriety field test. He said all of the kids failed the nystagmus test and it would be cause to arrest and book them for DUI. WTF!? We were IN SCHOOL and 16 years old. lol This was over 20 years ago now. The whole class just started roaring at the cop. Hearing that cop say that to us I will never trust them with these field sobriety tests. I don't drink, but I think a cop would likely arrest a complete sober person with these BS tests.

      If Field Sobriety Tests can be failed by sober young adolescents then it brings their validity into question. Its a test which if the victim passes can be ignored and if the victim fails then incriminates them. So the victim is on a hiding to nothing here and the test is just leverage to put someone in jail.

      Well what happen with those test is they have you keep you eye in a very uncomfortable position and stress the muscle in the eye. When the muscle tire they start to move. It is like doing that final pushup and your arms are shaking. Some of these cops will hold the position for like 15 seconds when it suppose to be for 3. Now when you blow 00 they just say you are on weed. The problem is when you are on medications that are prescribed. Many time these med are mood altering when you first take them but you body get use to it. For example a lot of chronic pain patient are on opiate medications. But they have been on the same dose for years so it does not effect them like someone getting the first time. Addict alway need more to get there high. But they can give you a DUI if you even have Benadryl and some people use that all the time for minor things like rashes and that is not necessarily mood altering for them after a while. But just showing up positive will give you arrest. Over 25% of arrest are dropped due to the lack of evidence.

      @@JAM661 The scary thing is since I wrote that comment, I have developed meniere's , nystagmus and vertigo. There's no way in HELL I could pass this now and I don't think they'd believe me. I watched a video where a college guy blew 0's and they said exactly what you said, that he was instead on drugs. It was absolutely disgusting. You can tell the dude in the video was totally sober. No one would think he was impaired or anything. The cop was just power tripping.

    Exactly why you NEVER, EVER concede to a DUI test on the road!!! YOU WILL NEVER, EVER PASS! As soon as you, trying to be a good citizen, accept taking a DUI test, you are going to jail!!! Then they will do whatever is necessary to make sure you are prosecuted, whether you've had a drink or not!!

    Yet, being 50 pounds overweight makes his test unreliable. So doesn’t that mean that when cops conduct these tests, they must take care to not administer the test to people 50 pounds or more overweight?
    The more we look into American police work, the more it looks like a House of Cards.

      All field sobriety tests are unreliable. It should always be refused and go directly to the breathalyzer. The whole point of FST are to build probable cause and to be used against you in court. They are almost impossible to pass even sober.

      I really must disagree. A house of cards implies that there's a table of rationality underlying the house itself.     I went to school for 7 years to be deemed an ‘expert’. I still, at times, don’t feel like an expert because I’m still learning. These jokers take a weekend course and are called ‘experts’ at certain things. It’s bad enough they’re already stupid, fooling a stupid person into thinking they’re smart is truly dangerous.

    I believe you can refuse the FST , but not the breath or blood test .
    At 58 yrs old I could never pass any of these. Thank goodness for a a great DUI lawyer 👏

      You don't have to volunteer for the breathalyzer or a blood test. They can get a warrant potentially, however you may have your license revoked for refusing.

    I've tried to pass FSB tests a few times absolutely sober with buddies who are LEOs. The older I get, the worse I do each time. They use to think I was fucking with them. Now they realize I'm just a beat up human& the tests are ridiculous.

      That's why they are supposed to ask you about any injuries or disabilities and then take that into account when you attempt the tests, the only real thing that can somewhat tell impairment is the HGN and VGN test

      You aren’t required to take a FST in Kentucky, but the cop will almost for sure arrest you. But of course the FST is designed to fail! One time, I had to take one and I was wearing high heeled sandals! I still managed to pass bc I’ve taken many years of martial arts and have great balance. I also refused to let them search my car. They ended up calling for backup, and I had two cops screaming at me. Then, they tell me they couldn’t ‘prove’ I was on anything, but he KNEW I was, so if I didn’t go straight home and he saw me again that night, he would pull me over again!
      I went to Waffle House like I planned in the first place bc screw him. I wasn’t doing anything!!!
      I recently turned 49, and I just tried to do the one-legged stand. Granted, I’m not feeling well today, but I couldn’t even hold it more than like a second!

    I didn’t hear any slurred speech. Trooper Wright needs to have been put on the Brady List. He has no credibility. In April 2020 he participated in the beating of Alex Hornbeck in the basement of his home, gave false testimony about it under oath, had his knee on Hornbeck’s neck forcing his face into the floor and lied about it, and denied seeing a fellow trooper pummeling Hornback with a flashlight while kneeling next to him. Trooper Wright was neither disciplined nor prosecuted. He should also keep his mouth shut about medication since he was totally wrong about Wellbutrin.

I wish more dui attorneys fought this hard for their clients.. i got a bad deal and got lucky my case got transferred to a different county and they lost my file because it took 2 years to prosecute. they were trying to give me a dui for being sleeping while driving, passed breathalyzer and blood test. it was 14 degrees outside and they had me take a field test while my arm was in a cast, while in a light long sleeve while shivering. no proof i was intoxicated. youre an incredible attorney sir

      I was thinking the exact same thing, like who tf do these idiots think they are, they take a 4 hour class and suddenly they're neurological experts? Most of them don't even understand the law they're supposed to be enforcing. There are many medical conditions that would automatically cause one to fail these sobriety test, let alone the fact that they get off on terrorizing you the entire time you're doing them,and they made up their mind the second they decided to make you take it, they're going to find a way to make you fail it regardless.
      I have a few medical conditions, one of which, adhd would cause me to fail no matter what, and I am terrified of the day I encounter one of these power crazed cops, and I don't even drink..

    I love how one week of training on DUI detection was adequate for a state employee to be treated by the court as authoritative, but the person who trains those people had to have a Court Colonoscopy before the judge would be comfortable lending him any credence at all. It's fair game for a prosecutor to object to your witness on any grounds they think they can stand on and try to get everything to slide for their own case, but it is an entirely different matter for the court to indulge in that sort of reckless disregard for justice.

      You are correct, it is an antidepressant. It is a DNRI. More about that below.
      1. It CAN help with anxiety. It can also worsen anxiety.
      2. It is a common first line rx for ADHD - especially inattentive type.
      3. Nystagmus - sufficient to “fail” field sobriety test - can be a frequent symptom of ADHD. The nystagmus, if present, is not fixed by Wellbutrin.
      4. Other aspects of ADHD could invalidate the FST, such as significant difficulty estimating accurate duration in “passage of time” part of test.
      This, among other things pointed out, could cause the FST to be inconclusive.
      Weaving on the road could be the result of driving while tires, then being startled by the rumble strip, then trying to course correct.

      I agree, I'm constantly amazed at the lengths US cops go through to escalate roadstops into something more by 'smelling' alcohol or drugs. Especially when they then call for a K9 who's dogs will almost always also indicate drugs and an hour later there are no drugs. Very American!

      A cop will still arrest you if you blow a zero. Police departments have DUI arrest incentive programs. They are going to arrest you one way or another.     That is 250 dui cases a year? That leaves 115 out of 365 days that this cop does not arrest or pulls over someone for dui. If he’s working a normal 40 hours a week per year that’s 260 working days.

    As the defendant's lawyer, my first question for Trooper James Wright would have been "are you on any medication either prescribed or not, at this point in time or at the time of the arrest"? My second question for Trooper James Wright would be "would you consent to a full panel blood, hair follicle, and uranalysis test for both drugs and anabolic steroids" today, right now? I would have also had a professional body-building trainer as a witness on standby. Something stands out in all these trials, audits, and harmful interactions with LEO'S. Roid Rage! To be perfectly honest driving on that narrow road and being blinded by high beam passing cars and a trooper riding her ass with his high beams in her rearview mirror I thought she was doing a damn good job driving. That prosecutor doesn't seem to like you at all you could tell in the 1st video she was getting upset and her final question for your expert witness was how much you getting paid was reaching in my opinion. Haven't finished the video so I don't know the outcome which I have an ideal on the verdict lol.     I've watched several of your court videos, and you're a damn good lawyer. You are intelligent, articulate, well-prepared, chronological in your presentation, logical, detailed, confident, and professional. I have a high interest in law and have watched many lawyers defend clients over the years. Many are clumsy, unprepared, and lazy. You are an exception.
    Thank you for protecting the rights of citizens against tyranny in my home state where it's much needed.

    I'm always left wondering what the verdict was. Can you share the outcome with us on the courtroom videos that you share please. I understand that it's public information and we could look into it ourselves but it would be much nicer if you let us know the outcome of your cases. How often does the DUI guy win, how often does he fall short?

    1:11:19 Wellbutrin is NOT considered a CNS anti-anxiety depressant. This officer seems to be under the impression that Wellbutrin is an anti-anxiety medication along the lines if Xanax and valium.

      He did not say that all. He just corrected him that it is not a thyroid medication. Wellbutrin is used to treat anxiety and depression just in a different way. Though it is an anti depressant and works very different than SSRIs. He was pretty spot on.

    I've seen it happen way too many times. You let a halfway decent person put on a KSP uniform, and within 6 months or less, you won't be able to be in the same room with them. Their ego will literally take up the whole damn room...even the ones with no neck, lol.

    4 years and “over a thousand DUI’s”? 365 days in a year just to make things easy on a 5 day standard work week at 52 weeks is 260 work days x 4 years is 1040 days so the guy had 1 dui every day he went to work. Wow that’s a lot of drunk drivers. Wtf is going on in Elizabeth-Town they need an intervention bad…

    The officer failed to mark the chain of possession of evidence part of the blood draw document. This calls into question the validity of a proper legal blood draw. Not good officer, not good! Looking forward to part 2.

      It shouldn't have been let in if the chain of command wasn't followed. Or maybe the results aren't we will see in part 2. Also he lied about traffic having to stop for her. Sometimes when these cops lie to fluff their case they assume the person will plea and they will never have to be held liable for their lies. Well the DUI is here to insure yoi think of him next time you want to lie in a citation!!

      Larry won't take the quick money and have you plea! He'll look forward to balacing the scales of the law! Holding them accountable for their actions and freeing you from a system that wants to expedite cases with plea bargains. Ensuring they get paid and their conviction rate stays up! Seeing to it you walk away with a stain on your record!
