  • The plaintiff claims his 19-year-old son threw a New Year’s Eve party that got out of hand. His son ended up with stitches from a fight, and the house was trashed. He’s suing one of the partygoers for property damages. The defendant claims the damage isn’t his fault, because he was actually trying to break up the fight.

    "You're all very intoxicated, I don't want any trouble" isn't the same as "Get out of my dad's house. You're not invited. I'm calling the cops if you don't leave." Easy peasy. Be courageous. You've already got some liquor in you... let it work for you. Call the cops and report these trespassers. Period. 🤷🏾‍♀️

    • @joela.4279
      @joela.4279 Před 2 měsíci

      As Judge Milian said during the hearing, that is a strategic decision the father made in hoping to collect for the full amount of damages, which exceeded the statutory cap of 5k. The defendants can be held jointly or severally liable. Which means one can be liable for the damages of all, or all for the damages of one. In this case, the father can choose to bring separate litigation for each person of the defendants group, but in this melee idk how he's planning on being successful in arguing who broke the railing and who pushed whom through the sheet rock, etc. The concept of joint and several liability is born of the thought that each person of the defendants party acted in orchestra, and it's not the plaintiffs burden to prove who damaged what. The defendant can choose to bring litigation against his friends if they don't see it fit to share the responsibility of damaging the property.

    I think it's ridiculous that the defendant thinks the plaintiff's friends should be partially responsible! The defendant brought a group of inebriated people to the plaintiff's house they were asked to leave as soon as they got there, they refused to leave and had to be escorted off by police officers, then after that they decided to come back and cause drama! that's 100% on the defendant and his friends. I also think that the plaintiff and his dad were entitled to the walkway, and the reason I say that is because if they don't make that specific pattern or brick anymore whatever it was and the entire walkway needs to be redone then that's what needs to happen the plaintiff is entitled to a matching walkway just like he had prior to the incident, as the judge always says they deserve to be made whole and put in the exact same position that they were before the incident happened, if that happens to cost way more than that's on the defendant he should have thought about that before he caused all of this drama.

However, he didn’t invite the friend whom had the problem. So more liability was on the defendant for bringing the uninvited guest.

      Believing they were right 100% would be a judgment of $5000. The defendant was definitely liable for a portion of the damage.
