Let me clear things up for you guys : The first girl stopped because she thought she was going to hit the foam roller or she did hit the foam roller. The second girl was clearly on her phone there was a huge gap for her to see she stopped, but as she was on her phone she wasn’t paying attention so she crashed. The motorcyclist didn’t have any part just for the foam roller.

But you do have to admit that if it wasn’t for the biker “not securing the load” then the first girl wouldn’t have had to stop at first and the second girl wouldn’t have risked losing her unborn baby. To a small extent it is the biker’s fault for events leading up to the crash but the crash itself was caused by the second girl.

That 2nd girl (in the Ford) can still sue the biker for bodily injury even if she was found to have been on her phone. However, there’s no evidence to substantiate her head was on her phone, especially considering the laceration on her forehead. The biker is completely at fault and since they were convicted of causing the accident by failing to secure their load, both drivers can sue this biker.

Its really dangerous to have stuff falling off your vehicle, it can easily cause an accident and you are liable if it does, in this case it didn't directly cause an accident so you are not liable, however you did indirectly cause the accident and deserve the ticket. Imagine if the first girl swerved to miss the foam and crashed into a tree and died, you would be liable for her death, that's why its important to make sure everything on your vehicle is secure.

I don’t believe it’s his fault, the item fell out of his bag which he then went back to retrieve (correct thing to do when safe). The lady chose to pull over and put her hazards on which is again the safe thing to do. The 2nd lady that crashed into the pulled over girl is the person at fault. When someone’s hazards are on and they’re stationary you have no excuse as to why or how you ‘accidentally’ crashed into the back of them. I think the girl who crashed into the back of the first girl clearly wasn’t looking where she was going 🤷🏼♀️

Its really dangerous to have stuff falling off your vehicle, it can easily cause an accident and you are liable if it does, in this case it didn't directly cause an accident so you are not liable, however you did indirectly cause the accident and deserve the ticket. Imagine if the first girl swerved to miss the foam and crashed into a tree and died, you would be liable for her death, that's why its important to make sure everything on your vehicle is secure.

People who aren’t paying attention to their surroundings and fooling around, such as texting while driving, should not be driving on the road, maybe if she was paying attention, she could’ve completely avoided that accident.
