Summarizing John Prior's motion: After scamming my client and the court, pretending to be a robust and competent lawyer, obtaining continuances after continuances, milking my client of all of his property, I simply don't have any way to get more money out of Chad, so I want out.
I suppose the best thing or only thing Prior can do is delay prison, which is very different from jail. Lazy Chad looks chubbier and weaker. He might be more comfortable on death row because general population can take advantage of a weakling.

Tagging onto what L. Blake was saying regarding the victims, basically the law is written so this fruit basket turnover can happen , all to be certain the guilty defendant will have a fair trial. Ya, I get that, even though it stinks bc it’s CD- & he’s GUILTY.
But at the end of the day, yes, this is a joke. Daybell just needs to throw in the towel & save everyone a lot of $ & time, heartache, stress, etc. If he wants to even remotely go out on a higher note than rock bottom, he should do everybody a favor. Plead guilty & get it over with already! Idk if that’s even a possibility at this point, & even if it is, I’m sure CD wouldn’t consider it for a second.

Chad is insane for not asking for a plea deal, but thank god for us, he’s too stupid to do so.
He is too stupid to realize that Prior has been robbing him for the past 4 years with no intention of representing him at trial. CD still wants Prior to represent him even though Prior pretty much admitted that he won't be ready in 12 weeks for trial.

Bottom line: Prior is prepared and ready to go to trial, although you'd think not. His strategy is delay-delay-delay. So much the better for his client. Delay as long as possible. He can have 25 death penalty qualified attorneys appointed to work on his case, and of course that will amount to further delay, as any new attorneys brought on need to bring themselves up to speed.
It will make not one iota of difference. His client did the crime(s), and he will be found guilty.
I don't have one bone in my body that feels sorry for him. John knew what he was up against. I also think Judge Boyce finally grew a backbone. I also think this is a grab to delay. John needs to stay.

It's always been an antic for Prior to prep mentally how Loris case is presented to ferret out strategy and stall. Period
It was on his own dime, coming out if whatever funds he already has from Chad's house. If he were truly hurting for money he'd sell Chad's house (that he was given in lieu of payment) to fund all the work that's been put in. The money issue puzzles me greatly. Prior isn't taking on much else - how could he? - but he's able to keep going with this case &pay his bills? He's getting paid. He's just not getting paid the way he'd like
Hope all this doesn't mess up this trial and result in miss trial or whatever.

And I also think he's trying to make a case for Chad to be able to appeal because of an insufficient council or whatever they call it when John inevitably loses this case.
Couldn't happen to a more deserving attorney. Prior has been delusional from the very beginning about his capabilities and taking this case to a death penalty trial. He better not end up putting a guilty verdict at risk.

At one point Prior said he’s eligible to become DP qualified but chose not to do so. If he truly wanted to do his best for Chad why doesn’t he apply for DP qualification and he could have a non DP qualified attorney to work with him!
Well, since he opted out of becoming DP qualified, Judge Boyce will just have to take the death penalty off the table. Otherwise, if he is convicted, the claim will be that he had ineffective assistance of counsel.
So what if it was the plan? So flipping what? What other plan for defense could there have been?
@@karenholley8356 actually it doesn’t mean the DP has to be taken off the table. Chad chose his own counsel knowing DP was on the table and private counsel isn’t required to be DP qualified. The only time DP qualified is required is when the counsel is court appointed. Chad could have chosen to go that route from the beginning, or a year ago when declared indigent. Again he chose to keep Prior, and Prior agreed to stay. Waiting until the last minute to change their minds is not going to change the potential sentence. True, he could appeal any judgement, but it’s highly doubtful the appeal would be successful unless Chad could somehow prove that Prior was ineffective counsel and misled him into believing they could change counsel at any time.
This is one of my least favorite lawyers to see and listen too. He is disgusting.
I don’t feel sorry for Chad. He and Pryor had the cases severed. The cases would be over by now! He gave up his right to a speedy trial then delays court on every turn. They’re playing games. Chad is not a victim. The families and witnesses are suffering because of Chad’s antics; THEY are the victims. Lust and greed took over his mind and ate his soul. He needs to be working on that and not on being evil and drawing this out.

Did Prior ever intend to go to trial himself? How many other cases is he working on? How much time did he actually spend on this case? Withdrawing 3 months before the trial is just very, very fishy. I now understand why he didn't suggest to Chad to enter a plea deal. He can't continue to get more money.

Hard to believe that these cases began with Mark Means and John Prior. Both have proven incompetent. Prior knew that this would be a death penalty case and could have recused himself then or gotten qualified himself.

I'm not sure I understand your reply. I'm not "after" anyone. Just stating the obvious. This case was a huge complex case from the start with multiple murder charges. Neither Mark Means nor John Prior were qualified for such a death penalty case yet both took the case. Prior has had plenty of time to be ready and get help. He waited to the last minute and acts surprised that the case is bigger than him. No, this is either a very bad tactic or complete incompetence.

Since the weasel got Chad’s death house, it seems like he’s been paid in advance and will make money off the property long after Daybell faces the firing squad. Furthermore, I understand in order for justice to move in the right direction it takes times to prepare and schedule an important case. It pains me though that the dismembered and burnt bodies of children were found discarded like trash at his home.
Seems to me Prior received payment already; he was paid loads cash and also got that Daybell property.
I very much doubt that property is worth much, in some little rural Idaho town in the middle of nowhere. When you think of what it costs to hire an attorney for 3 years, it is a drop in the bucket.
He’s playing games. He’s trying to get the DP off the table, trying for another continuance, trying to get more money for his work and trying to get someone DP qualified and another chair. Oh and I forgot, he’s setting up an appeal as well.
This is a high profile case. The only issue I can imagine with finding additional council is their refusal to work beside Prior. I have never ever heard of any death penalty case not having the ability to find council but I’m not an attorney so maybe I’m just ignorant to the way the system actually works.

Did you listen closely to the very end of the hearing? There was a hot mike incident. After court adjourned, Prior wispers something to Chad, then Prior turns to the prosecution and Prior can be heard saying "Plea deal" before John Wood moves the mike.
Oh for sure he will write a book! I’m sure he’s had another near death experience in jail and wants to talk about how godly and “light” he is.

He’s definitely playing games. He wants to frustrate the prosecution and wear them down to get the DP out. But Judge Boyce went out of his way, twice, to move the case out of the county. Another delay would be expensive. I don’t know why JP wasn’t sanctioned for it. Maybe he was by being forced to work for free 🤷🏻♀️. JP can raise the rent and get some money from Chad’s house.

The defendant being "indigent" is only due to his house/property being procured by the "unqualified" attorney as the legal retainer/fees so why should the state get stuck with the bill for a qualified attorney when the defendant wants the unqualified one.

This morning I saw that three states are now on board to use nitrogen gas as a death penalty method. Not every state is comfortable with it yet but I’d be curious if this would be adopted by the state of Idaho.
All states should just have one federal facility for all death row inmates and get the sentences administered timely ... however that happens.
He murdered his wife and hacked up the dead bodies of those children. That’s enough for me. To believe he is guilty. He could have put a stop to all of it, but he chose not to.

Chad Daybell is making a very quiet mockery of the judicial system. We’ve heard his voice very little. For all we know, he’s still running his cult and writing even more books from behind bars. He certainly doesn’t look like he’s missed a meal. We know that he’s not in Gen Pop because he hasn’t been sentenced yet. Chad is sitting pretty and protected. If he got the DP, he’d be martyred. I wonder if Chad is contemplating doing exactly what he stated in his recent podcast that when you have done wrong, you need to make amends, ask forgiveness and suffer consequences for what you did wrong. Wonder if Chad is thinking of pleading guilty to everything he did to prevent him from getting the DP like his wife and his 2nd wifes 4th husband and her 2 children AND ALEX and Branden Buedruoe received?
Is that why Prior after a short chat with Chad, he walked to the prosecutor and said something?

Where washis heart when he brutalized his wife , Tammy, mother of his children and loyal. How about where was his heart when poor Tylee and little Jj were brutaly murdered and disposed of ? When Charles and puppet Alex were manipulated ? How about when Charles was cruely killed?

Ugh, John Prior is talking in circles!!!
I think that Prior has spent the past four years procrastinating instead of preparing for trial and now he's scrambling to throw a defense together in 3 months. Prior thought that he could take Chad's house without going to trial and he was wrong. Now, we all get to watch Prior make a fool out of himself and his client in court and I'm here for it.
This is basically Pryor telling us that Chad is for sure going to get the death penalty and that he’s guilty because all defense has to do is raise enough probable doubt they just have to doubt they can’t even get to the point of a trial because Pryor knows his client is guilty…. This whole motion was a waste of the courts time
