'An America that you won’t recognize’: Legal scholar Kermit Roosevelt III on SCOTUS and Project 2025

  • The Supreme Court’s latest term revealed just how fundamentally the ultraconservative supermajority has changed the dynamics on the court, as well as how dire its ethics issues are. The justices, however, seem to believe they’re above reproach. “The only way to take the Supreme Court back in the near term is actually court expansion,” Kermit Roosevelt III, Constitutional Law scholar at the University of Pennsylvania, tells Ali Velshi. It’s a critical moment for the country and the judiciary alike, with Republicans using the Heritage Foundation’s Project 2025 playbook to prepare for a possible second Trump term. Roosevelt adds that if they succeed, “it’s going to be an America you won’t recognize.”

      Actually not. One of the POTUS official duties is to appoint justices… So he can do that. Appointing justices without congress approval is illegal… so he can do that too according to this SCOTUS ruling. The SCOTUS own defense to their ruling is that the POTUS must be able to take bold actions to govern, not having to contemplate if those acts are legal or illegal.
      It is however an unethical act if you think the POTUS shouldn’t be immune.

    Isn’t it interesting that Presidents can break the law, Congress members can break the law, but somehow Supreme Court Justices cannot break the law? Their Constitutional role is to interpret the law, not create it. They are supposed to follow the Constitution, not create their own version. Clearly this court has gone rogue, has an agenda and has now engaged in legal malpractice. When does it become unlawful? Because until their latest immunity ruling, no one was supposed to be above the law. So, why do they seem to be? And if they’re not, how are they held criminally accountable?

    Love Kermit Roosevelt III. He wrote a great book called "The Nation That Never Was: Reconstructing America's Story." It shines a light on the attempts to distort our nation's founding and critiques "the standard story" of our history. It illuminates how racist that story is and how hurtful to our future ability to overcome our misconceptions about history.
    A great quote from the book is this: "When you're used to privilege, equality feels like oppression."

    I think the reason it was life tenure was because back when the constitution was started people didn’t live very long and people didn’t retire. In 2024 people live a lot longer and most people want to retire and enjoy their retirement.

      I think the reason the founding fathers gave them lifetime appointments was they believed it would be the best way to make them independent and be able to judge on the merits and intent of the law. That's how all judges should rule. If given term limits, could potentially go rogue knowing the term is coming to an end. Making deals behind closed doors. Such as highly favorable jobs for a specific ruling. And other issues. Making them elected positions for a period of time like the rest of government offices makes them beholden to certain voters for election and re-election. Not independent.
      Worked as it should for a while but didn't last. Number of reasons for that. I think the 2 biggest are:
      1. Parties. Our founding fathers knew the dangers of forming parties. They had advised against ever forming a party but chose not to ban them.
      2. Allowing the justices (or any judge) to accept gifts or do speaking engagements

      The constitution did not make sure judges (and their decisions) were independent from undue interference by the executive and legislative parts of the government. It made them EQUAL to the two branches.

      Federal judges have lifetime appointments. If Democrats control the House in 2025, then they could threaten the right wing Justices with embarrassment by Impeachment. McConnell and his fellow Republican “power before nation” cronies in the Senate would block any convictions. So it would only be an embarrassment in the history books, not actual change.

But while they do that, in-practice they promote legal actions and legislation that serves radical right empowerment and big business profiteering. The originalists claim should be routinely clarified to be a decoy and a ruse.

Most people only receive a fraction of their salary after retirement if they're lucky enough to have a pension. The vast majority of people rely on social security and savings if they have it. There must be a better system, because the current one leaves a lot of people behind.

    When the chief executive of the military gives an illegal and unconstitutional order. It is up to the generals and the military to ignore and refuse to follow such orders.
    Therefore it reasons that if the supreme court fails to uphold the constitution and gives an illegal ruling, let every lower court do what is constitutionally right, and ignore their unconstitutional ruling and directives. Then allow the case to be appealed back up to the SCOTUS and let them try to defend each and every corrupt decision that they have to make on a case-by-case basis. The supreme court wants the lower court to do their dirty work for them. Don't do it. Let them get their own hands dirty and show the American people how corrupt they really are.

    I agree with Velshis question about ‘…putting on cap on it after expansion’ because it seems the other side takes our concerns (i.e. election integrity) and wrists it to work for their agenda. So, first expanding the court then putting checks and balances in to keep it honest and stable.

    Change the rule to allow 4 more justices. Change the rules of the Senate to forbid any future changing of the Senate rules must have 75% votes in favor of the change. Enact direct election of SCOTUS justices. Term limits of 6 years for any Justice.

    Americans do not like the idea of expanding for political reasons, but growing our judiciary is not a Republican Party vs. Democratic Party issue. It is an increased population issue. It is an expanded geographic territory issue. It is an urbanization issue. It is a caseload vs. workforce issue. A pragmatic structural analysis comparing the First Circuit to the Ninth Circuit, the number of Circuits to the number of Supreme Court Justices and the extensive backlog of cases at every level provides observable, measurable proof our judicial system is fractured. We need a seismic retrofit.

    The amount of judges are supposed to align with the appellate courts. There was 9, there is now 13.
    We should have 13 justices.
    There should be term limits and there should be age limits.
    It would also be nice on constitutional issues, all.justices must agree to it.
    I would also encourage changing our two Senators per State to be changed to population of that state.
    Why should Wyoming have 68%, more voice in the Senate than California?
