      If trump is the only person in America who the supremes made immune to criminal prosecution, but everyone around him, working for him, or associated with him is not immune from prosecution of crimes…then does that mean if trump as president orders anyone around or under him to help him do something criminal for which they can be held accountable, does that give anyone not named trump the ability to refuse the orders of the “commander in chief”? And does that not render him useless? Can prosecutors right now go after everyone involved in trumps current criminal indictments?

      The new rules brought forth are unconstitutional. To change or amend the constitution is not the role of the court. It is Congresses role to change the laws. Therefore these new rules by the Supreme Court are illegal.

      @@jim0311 How? the supreme court made the ruling. the only real way to fix immunity decision of scotus is if scotus reverses the decision. biden should arrest all scotus judges that made this decision and charge them with treason. then summarily appoint democrat judges to reverse the decision going forward, not retroactively. and while this would let trump off of many charges he is facing it would save democracy here.
      of course biden could also arrest trump for treason as well. it would be a presidential act to save democracy!!

    Judge Luttig, I want to thank you for speaking out on this matter, and for taking the time to come on to independent media channels like this one, which are proving to be an invaluable community during these troubling times.
    It’s refreshing to hear a scholar of The United States Constitution who “gets it.” There are fundamental and overarching themes-after all. The Immunity decision not only misses those, but subverts them.
    I’ll do whatever I can to support you, channels like this, and other lawyers like Mr. Katyal as we continue this fight for justice. It is of monumental importance.

    It's time to amend the Constitution to: 1) explicitly state that the president does not have absolute immunity for breaking the law while in office, 2) term-limit all justices of the supreme court to 18 years on the bench, 3) make supreme court justices conform to a code of conduct as all article III judges, and 4) create a commission made-up of senior federal judges with the authority to sanction any article III justice or judge who violates the code of conduct.

    There has never been an impeachment of a Supreme Court justice as precedence, but since SCOTUS is hell bend on removing precedence, so I am all for impeachment of a justice starting with Thomas. I would like to see a financial probe of all justices by the IRS. Most of us who worked in companies have more constraints on taking gifts than these justices.

      I was once an employee for DHS, every year we had to take Ethic training and I wonder if any of these judges ever take this training? I remembered that I could not even receive any gift more than 10 dollars. 😂 but Thomas for years took in millions of dollars and nobody said anything. Geez.. We need to have applied ethics to these judges and all official.

      It can be rejected. Would be illegal, but Biden can now pardon everyone who violates the law.
      The justices can be impeached, although not for treason. Biden could also take official actions that would removed them from their office in one way or another. Also illegal, but as it is an official act it’s now possible to do so for Biden without any consequences for him.

    The Senate should issue subpoenas to the SC justices and question them up and down about this ruling and its consequences. Let them be properly shamed in front of the American public for what they have now unleashed on the country. And the next step should be that judges who respect the law around the country should get together and state that they will no longer heed what this SC says but will only obey appeal courts as their highest authority. Time to end the fiasco of giving respect to justices who despise the people and the Constitution.

    In the presence of a crime, there is no distinction between "Official Acts" & "Unofficial Acts"..... It was a piece of silliness the way the Court ruled. "Staging a coup" is a crime, there is no way around that and there is no way defend that as an "Official Act".

    The SC (Supreme Court) decision to grant a president absolute immunity for official actions and presumed immunity out to the perimeter of their power is, of itself, a violation of our constitution.
    1. There is nothing in our constitution granting a president immunity from criminal prosecution - "no man is above the law"
    2. This SC ruled that a president enjoys absolute immunity for official acts, etc., and in doing so amended the constitution. They wrote a new protection into the constitution that was not there at all beforehand.
    3. Only Congress has the authority to amend the constitution
    4. Therefore, the ruling by the SC is itself un-constitution and must be retracted

      Agreed. My view is round them all up and charge and jail them now. If that doesn't happen now it will happen in reverse in January, under Trump (What does anyone think will happen to Jack Smith, Garland, Cheney, Pelosi, Clinton, Katyal, Luttig, Milley, MSNBC, the Times etc etc?) And the US will be gone.
      An immoral act can be moral, such as killing enemy soldiers in war, assassinating Hitler, etc. The moral difference in this case is whether to save America or destroy it. Refusing to act appropriately is understandable but is, in fact, cowardice and betrayal. Refusing to act is to betray the Constitution - action is justified because its intent is to defend the constitution - from domestic enemies.

    It's clear by looking at his face that the honorable judge Luttig is deeply torn about this. Feels defeated as the rest of us. Now questioning his entire world view as a conservative. I'm so glad that he is coming out with his warnings. I think it's far too late, but be that as it may, perhaps it's time that he openly resign from the Federalist Society. Unless there are a significant amount of other members willing to say the same in public. But I fear that most there still support Trump and even Project 2025.

    So didn't scotus commit some sort of crime by erroneously changing our Constitutional law such that they could be charged in some way for breaking our laws? Bc we have 3 equal branches of gvmt.and now scotus has removed equality in executive branch making that branch above the law isn't that illegal? Can we contest this ruling by scotus?

      AIUI there is no way to change the ruling other than another SCOTUS ruling which vacates this opinion and changes it. If Congress passed a law to attempt to change the decision then SCOTUS can (and surely would) rule Congress's effort was unconstitutional. It seems the only remaining bulwark against a criminal presidency would be impeachment, yet the chances of that under the present political situation seem nil. And even then, it could only ensure removal from office, it couldn't provide for criminal punishment. And that makes for a "heads I win, tails you lose" situation for a criminal president - it encourages criminality because there are no penalties (beyond removal from office).
