- Ariha, a 20-month-old little girl, has been living the life of an orphan in Germany for the past year despite being a parent and her parents are fighting a legal battle to get her back. It is noteworthy that Ariha's father Bhavesh Shah (34) and mother Dhara Shah (32) live in the city of Berlin, Germany. In order to bring back Ariha, now the Jain community has started mobilizing in Mumbai and across the country. Ariha's parents are originally from Gujarat and have lived in Bhayandar West for the last several decades.

Should not return the baby until thoroughly investigated. Child abuse is prevalent and a very serious issue.
This is a serious case. It's not like Mrs. Chakraborty's case. She was fighting for her two physically fit children, atleast there was no harm or injuries from parenting side. But this case is too suspicious and critical. Their daughter has such a bad injury which she referred as "a tear" in her genital area, how can you explain this? Such a tear that needed stitches and full night of admission in hospital. Can you see how critical it was? I don't know if these parents should get the custody or not but I'm cent percent sure these parents have failed in parenting in so many levels.
Harm and injuries don't necessarily mean that the parents are abusing the child.
It could be something else that requires thorough investigation.
This situation could have become a police case in India too. If the child is seriously injured in her private parts the mother can’t overlook it. I hope you get your child back but it’s everyone’s responsibility to become a parent when they have enough maturity as parenthood is a big responsibility

I think the baby is in good hands. What kind of parents don't know about the seriousness of that kind of injury where baby needed stitches. They just want their baby, whereas they should demand for investigation about how the injury happened. For me it's a serious sexual abuse case. Can't the parents see it.

If it was my own child. Firstly I won't let my child get seriously injured. Secondly I would demand for investigation and I would not rest till I find the cause of injury and who the culprit is.
In this case the family has been proven to have been acting correctly. The famiyl needs now to go to Verwaltungsgericht to get their chidl back without delay. German law is on the side of the family. They just need to file the application at the correct court. Family Court just delays, Verwaltungsgsgericht is faster and can order the Jugendamt to return the child. Verwaltungsgericht does this often but German Family Court lawyers often don't tell parents this fact.

I am a mom but somehow couldn’t digest that a lil baby got so much of a tear that she needed to go for stitches and parents are totally oblivious to it ke pata nai kaise huya Kya huya… i mean if not child abuse at least this is a major case of child NEGLECT … also as a mother I know when women give natural birth 90% of the women get vaginal tear and for that we get stitches too… so all the mommies know that how much painful it is when we tear n when we get stitches…. 😢😢😢how can a lil baby go through all these trauma without the knowledge of their parents ???????

The more I hear about this case, the less inclined I am to believe the parents' version. When the infant got hurt(apparently so bad she needed stitches), atleast one of the parents may have been around? No one heard her cry? This is at the least a case of very careless and shoddy parenting and worse, something more sinister. They offer no explanation whatsoever of such a serious injury. This isn't India, you cant shrug your shoulders and say we have no idea how our 7mo has injuries that look like S A.

@@netisharma I'm not sure how aware you are of the details of this case. The child was violated twice, the first instance she was only bleeding and in second instance she ended up needing stitches. The child's grandparents then left Germany, the grandmother later presented an affidavit from India stating she violated the child using her finger for some superstitious beliefs. The parents were not guilty per se, they were let off by court in Germany. But they've decided to cover up the grandmother's actions.
If parents are careless enough let their child be harmed like this. They don't deserve children, that too Vaginal tear.

What exactly happened to your daughter I mean how she got hurt or who hurt her in private part to that extended point that she needed to get switches or she was bleeding. Else if that's not the case which seems very very rarest of rare and almost impossible then it must be racism. Parents might have fought with doctors or staff at hospital due to some treatment or some linguistic barrier which might have triggered them to go for such a strict action but later one doesn't feel to be likely as well.

An external blow, such as bumping against the side of a table, not even a hard blow, can cause temporary such bleeding that will stop. I got kicked by accident when I was about 8 years old at school at gym class and it happend to me temporily and stopped. Germany has a major child pornography industry (just search for 'Kinderpornografie' and one can see it is in the past few years a major topic of concern in German media) and therefore the police wanted to rule this out as well because it is a common problem in German these past few years. The police after the thorough investigation completely exhonerated the family so much so that nothing was even brought to any trial. Case 100% dropped. The family needs to go to Verwaltungsgericht now to apply to get their daughter returned to the family.

This looks too fisshy. Have raised three children and have changed diapers never once anyone had a vaginal tear, bleeding and required stitched. I feel both the mother and father are covering. I hope and pray the little girl is safe and through investigation on both parents to say the truth and child should be given to relatives who can take care of her and keep her safe.

Thank God the baby is safe. It’s very scary and painful to know about the baby injury. I worked in Women empowerment NGO in India. If I find something like this, I would also definitely complain and In India also officials might have got involved. Parents should fight for their children first. They should know the root cause and take proper legal action . Then they can claim the baby . Thank you to the govt officials/ doctors of Germany who acted fast and saved the baby. Parents should also be sent for counselling for hiding truth. Baby is not a toy, she is LIFE.

But unfortunately such practices are still followed in India on name of culture and doing such cultural practices in foreign land have zero tolerance. To all the Indian parents , pls nevrr treat children's based on religious belief system. They are innocent and helpless and depend on you to communicate their pain. Turning blindsight to such practice and leaving kids alone with superstitious believer is danger.

German authorities don't take away children easily as the orphanage system is already at its limits, and doctors too don't call the authorities easily. They really must have feared for the child's safety. The tragic thing is once there is a suspicion of s**ual abuse of children, they'll be ultra cautious to return the child :( as I understand the parents have been cleared of suspicion and the charges were dropped, but what about that paternal grandma who supposedly caused the injury? If the authorities suspect the child may be returned into an environment where she might be in her care, chances to return her may look worse. I wonder if an affidavit by the parents vowing to not let the paternal grandmother take care of her may help a little bit more.
I really don't think that there is any bad intent from the authorities' side. It will be an unlucky combination of fear for the child's safety and the infamous sluggishness of German bureaucracy. doesn't change that it's awful and traumatizing for both parents and the baby, who is uprooted twice first from her parents then later from her current surroundings.
Personally, I feel cautious about signing any petition here as I feel I only know half of the story. With vaginal injuries of infants... I really feel one needs to know the whole story to take a decision. That being said, I do pray the Indian consulate and foreign ministry are already involved, the case thoroughly looked at and everything done to unit parents and child as soon as possible

@@user-pk3yl2uc6y how would that accident happen? how? you clean a baby's bottom with soft wipes and water. you never bring anything pointy near it. this kind of injury is absolutely not normal. my friend is a pediatrician in a clinic, and those kind of injuries are insanely rare. they don't 'just happen' like that.
there are so called straddle injuries that cause female vaginal trauma that can happen if a child falls with force onto a rod or chair arm rest or playground toy or anything similar, but such bruising usually heals within days on its own and doesn't need stitches like in this case. Also when this occured the child was way too young to be climbing anything on her own to fall from it. She's at an age where she barely learned to walk a few steps. How would she use playground toys?
the parents themselves blamed the paternal grandmother. it's clearly not self-inflicted. an adult did this to the kid. and no matter if it was intent or 'accident' - in which case it would prove the adult to be incompetent to take care of an infant - you do not want that kid to ever be in that adult's care ever again.
I want to stress I personally do not believe in s**ual abuse in this case - though I can't know - but in a generally too rough non-competent handling of an infant.

So case of stitches how exactly happened this english speaking parents couldn't explain neither that Pak guy so that moreover would have placed them in more doubt. Otherwise why would they visit second time if knew that something like crime committed with baby, even if so in Frist time they might not have gone. So very serious but total misunderstanding due to linguistic barrier

Parents will move to India and take baby away again to get abused. Once they are in India what German govt will do- they will have no control.

May be it was a half cm cut, I had such cut and initially my surgeon kept it open, but due to puss formation, they had to clean it and stitch it. Happens when low immunity and your v part gets hit on hard surface, the tissues get compressed such that only option is to stich.

Im not convinced. Genital tear as severe as requiring sutures is definitely serious. Any good doctor would be suspicious. We are always so proud of our Indian parenting but trust me if we were auch a wonderful parents we wouldn’t be making children who accepted slavery under mughals and britishers. 99 percent of us were ok being exploited by foreigners. Even today if we were making great kids we wouldn’t have been 150th ranked country in world in terms of gdp per capita. We have horrible prenting which is borderline abuse and also we dont teach our children the importance of hygiene, honesty, integrity and hard work. Millions of Indians lack in such values.

For everyone one here in the comment section saying the baby many have got hurt in her private parts by falling on a toy , in most western countries they use diapers , easy to dispose and cheap . So for the child to have such injuries it must have done deliberately. Second in most western countries the toys they sell have to undergo the child safety regulations. Even a musical toy’s sound is very low as it could hear a child’s ear . I don’t buy their story . They are defending their mother by not telling the truth . Maybe the grandmother wanted a boy .

First of all this mom looks like a child herself-especially compared to the husband. She may be older but sure doesn't look it and if a baby has that kind of injury, something is wrong and there should be an investigation.

Since the baby was with the grandparents n the parents were out so plz the grandparents must be taken on remand. I understand children get hurt unknowingly but private parts thats impossible. Im sure the parents know the truth . Its nt a joke a 7 month baby being injured in her private parts n hving to tke stitches. The grandparents should be severely taken to task.

I am just wondering how an infant or a toddler understand why they cannot go home and stay with strangers .. why donesn't the authorities do an in depth investigation before separating the kids.. if the authorities really care about the well being of the kids and mental health is considered a major issue in other countries unlike in India , why don't they see to it .. and if at all the kids are separated from their parents why are they not allowed to check on a 24*7 surveillance

custody was taken by the German authorities after the baby was accidentally hurt by her paternal grandmother. Since then, the custody battle is going on. so the parents hide something.

Please help the parents get their daughter back. Tears can be for various reasons specially if she is without diaper and falls on any toys with sharp edges. Medical reports have proved its not a case of child abuse and relieved the parents of any criminal charges. Why they have not been given back their daughter yet? Stop harassing Indians staying abroad please.
