      what would fix the problem is if the government entity that pressed charges would have to pay for a defendant's defense if they are found not guilty.. it would completely eliminate malicious prosecution

      I'd honestly like to see more of her to get a better understanding of how she works, because as pointed in being a JUVINIEL facility it is possible her overreaching was because it could directly impact kids, as a number of ques she gave are similar to mothers and/or older sisters getting defensive for the sake of children.

      It's mainly greed imo, they are trained to make the most arrests etc to feed the privatized prison systems and make more money for the government and corporations. It's all about making more money and turning those gears to feed the machine. I bet the only time cops even see the constitution in school is when they are graduating and have to swear an oath to it.

      I mean it literally is the citizen's problem though because they have the power to make it the citizen's problem, which is the root of the issue. And it will continue to be the citizen's problem until police are incentivized not to behave this way, which can only be done by making it their problem when they violate people's rights. Neither a declaration nor a piece of paper somewhere stating something makes that thing reality, and thinking something SHOULD be a certain way doesn't mean that it IS.

      This auditor should most certainly be fitting for a 911 call. He is unusual, as well as suspicious by filming from a public street a Juvenile center. However, we all should know that this is legal, and the problem are the officers specifically the female which simply does not understand the law.       Only if he has a criminal history or is on a terror watch list would his ID affect this detention in any way.

      This is a case, like many others, that could end before it begins. If the information the 911 call taker is accurate and the call taker knows the statute then no LEO's would need to be dispatched. That said you would need a Supervisor ( LEO )to issue final approval to send out the troops. That sounds easy enough to me.

      The Sgt's entrance was just a show of bravado to try and spook the man and put up a hardnose no nonsense appearance for his underlings. Since he accomplished absolutely nothing his only out was to say they were sticking around to protect the children in the building.     When they "detain" you and tell you they are "investigating", tell them you're NOT going to help them with their investigation, and if they have more questions to talk to your lawyer. And then STAY QUIET. Any time a "supervisor" shows up and repeats nonsense, he should immediately be reduced in rank by his chief.

    The supervisor needs to be demoted and the female cop needs to be retrained along with the supervisor. Even the detainment is unlawful. If they make an arrest they will lose qualified immunity.

    I hate when police officers say they have "the right" to detain/ID people. Uh.... police have the same rights as everyone else, and no more. What they do in the course of their official duties are their responsibilities. Not their rights! Any time they use powers under color of law, they must follow the law. These are not rights.       @@basanistes359 when you sign up and take the oath military members take for your duration in the military you surrender some not all but some of your rights as once you are in the Military you don't just have the right to come and go however you please because you are always on duty even when taking leave you can still have that leave canceled and be called back if you are supposed to be at work and just decide to call out if it is a valid reason sure but if it is I just don't feel like going in today it's awol absent with out leave and is a crime you can be arrested for likewise if you are a civilian and call out to work you could be docked pay or even fired but not arrested. If you are told to do something you don't want to do like go to basic training for several weeks or told to step into a area without a gas mask on where tear gas is released you don't have the right to just not do it because it is a legal order from a higher ranking individual. These are some examples of rights you give up in the military. Again not fussing at you just describing how in the military you do have to give up some of your rights and have others limited and restricted if you will.

      Their body cams are not submitted as evidence if it doesn't support their allegations. He's kind of covered so long as prosecutor doesn't block the video from being shown.
      You take plea deals because they throw so many charges on you, that risking it just isn't worth it. From my POV, they are creating criminals. I know I am significantly more 'criminal' than before interactions with police. No thug could ever teach me like police can, because you can hit thugs back. Police will just charge you more. Truly, bullies.

    Now to sum this up, if the Sargent investigated when he first arrived they wouldn’t have gone back and forth. He never bothered to find out where he was standing or recording from, never learned if he trespassed or not, instead he immediately backs up the officer and her unlawful orders. All of the officers get an F- for not knowing the law and for unlawful detainment.

      But the point here is, how can they "investigate" a non crime? Basically, they cant. They can only conduct enquiries when there is no RAS of a crime, to try to find RAS of a crime.     The Sargent was intentionally lying. He knew the law concerning ID. If he really thought this man was legally obligated to ID, he would have arrested him. Instead, he let him go without IDing once the man drew the line that he was not going to ID.It's sickening that a police officer in a leadership position, someone we are supposed to be able to trust, chronically lies and deceives the public he is entrusted to serve

It is illegal for US citizens to lie to them because they are under their JURISDICTION and therefore must follow their corporate policies which probably states somewhere the "PERSON" cannot lie to LEO. If you are an America National or State National or a non-US citizen you are not under their jurisdiction and you can lie if you want. They are a corporation and you are a flesh/blood living soul which has a higher authority than a legal fiction/corp.

    This is the first time I've ever heard them openly say they can detain and identify a person who they admit they have no probable cause to suspect of a crime. The officer and the supervisor both clearly stated no crime had been committed and they had no probable cause to believe there was a crime but they needed to detain and identify him to conduct an investigation to see if they could find probable cause. This takes it to a whole new level of stupidity. After that I was actually kind of hoping they would force the issue and arrest the guy. His attorney would have probably sent them thank you cards for handing them such a slam dunk win.

      Exactly. But instead of getting an attorney who is part of the system, learn how to sue yourself and JUST DO IT? Title 18 Section 241- Conspiracy against rights & 242 - Deprivation of rights under color of law. Build up that retirement nest egg.
