      She said two years later in 2021, they filed a federal lawsuit accusing the City of San Marcos and the three officers of violating Kelley’s civil rights and the Americans with Disabilities Act.
      “We allege in the lawsuit that the police used excessive force,” Webber said. “He wasn’t arrested or charged with anything.”
      Webber said a judge is currently deciding if the lawsuit will go to a jury trial. She expects a decision by July or August.

      When I worked at Arby's if I had a deaf customer I grabbed a paper to write what I was saying unless they made it clear they can read my lips. If because of their disability I couldn't understand them I'd apologize and explain that to them asking them to write what they want. It's not hard to accommodate people

    The problem is qualified immunity. This will not stop until the police know they will lose there homes, cars, pensions and face mandatory long prison sentences

      Qualified immunity only applies to civil suits. On the criminal side, the problem is corruption in the police and judicial system preventing effective prosecution.
      It used to be possible to get around this by following the route of civil suits, just like in the case of the KKK (which was ruined with civil suits when corruption prevented effective prosecution). The Supreme Court then invented qualified immunity to make this impossible.

      No, the problem is Prosecutors who conspire to protect known violent criminals. If prosecutors did their job, and charge those uniformed criminals, get convictions, then this will go away. And mind you, the law on the books concerning Crimes committed under the Color of Law have very severe punishments.
      Oh and... a conviction results automaticaly in the loss of Qualified Immunity.
      In the end QI is just a red herring to keep the masses occupied, while the actual problem could be solved by electing DAs, Judges, Sheriffs and Mayors who'll do their job properly. Local Elections matter.

      in the UK it take minimum two years training before becoming a full trained officer I've been told you also need a university degree before training. De-escalation isn't part of the San Marcos training manual

      Mine too as I'm deaf (bilaterally) as my wife, mother, and many who know me do worry about me as I'm very active in many outdoor/recreational activities such as fishing, boating, hunting, as well as other things.
      I have few friends in the law enforcement ranging from local PD, Sheriff, State and even on the "other side" of LEOs like Game Wardens, Marine Patrol and one good friend in USCG.
      It's a sad reality that I have to "prepare" myself before venturing out of my place is to "be sharp" or "on toes" cuz you never know - ie get pulled over for whatever "excuse" that cops can conjure up.
      What I have (still do) found is to know the "dynamics" of how things are operated based on location and go "extra step" like knowing the "rules." (AND the law too!!)
      Too many times. I have "outwitted" those who fail to "listen/educated" by showing them the rules, proof, technology and most of all the "Holy Constitution."
      At the same time, respected their position as LEOs (similar to LEOs "de-escalating situation" but in opposite which I have many times and that shocks them in a way and then all is good/easier.)
      I'm a law abiding citizen and honest yet respectful but knowledgeable as well as VERY observant of my surroundings. 🤠🫡
      Not all LEOs are "bad apples" (as it seems to be growing nowadays) but education does go a LONG ways for those who are "bad" yet still too much power or overstepping authority is NEVER a good thing anyway. 😒😬

      I don't think giving verbal orders to a man you know is deaf is a training issue. It goes against common sense, and is an intelligence issue. The US Supreme Court has ruled that police departments and police academies are allowed to reject candidates based on IQ tests. Idiots are welcomed, while most normal people are rejected for being too smart.

      Once I was climbing 30 feet up the side of a building, and the cop came up and yelled "COME DOWN OR I WILL LET THE DOG GO!" So I laughed and said "You've got a climbing dog? I'd kind of like to see that!" and then he pointed a gun at me (an unarmed teenager)

    I'm hearing impaired and similar happened to me. I was going over a low wall to the grocery store as a short cut. All the sudden a hand grabbed me and spun me around. He screamed at me why didnt you stop. The other one had his gun pointed at me. I said I didn't hear you and pulled my hair back so he could see my hearing aids. Scared the hell out of me. Seems I matched a robbery suspect. I was 17.

      Cop arrested a blind man walking down the sidewalk for his foldable stick being in his back pocked. It was long and very obviously a blind person's walking stick. She was driving by and "thought it was a gun". He showed her it wasn't but he wouldn't ID (no crime) so she just kidnapped him and put him in a cage for resisting. (a secondary charge when there was no first charge at all)

    I’m glad he won the settlement, but I’m sure the officers still have their jobs. Probably have been promoted in the ranks by now. When I had seen this before, I didn’t realize they had talked to his wife already and knew that at least SHE was deaf, and I imagine she probably told the cops that he was too.

      Exactly. Plus, a lot of people don't understand, a fight between deaf persons is going to get loud, often. That's because they can't hear how loud they are talking. It's natural to get a little louder even for hearing people, when you're excited and angry, imagine not being able to modulate your volume because you can't hear yourself.       My town got busted a big scandal over targeting disabled ppl to put on probation and keep fraudulently violating them for the $$$ and jail them if they cant pay. It went deep. Many were investigated.. judges, sherriff, lawyers, DAs, officers, but nothing really happened except they switched probation for profit companies and had to pay a lawsuit. Sherriff was fired but for something completely different (selling vapes to inmates and abusing his wife)

      A motor vehicle can most definitely be engineered to be operated and driven on the street legally with hand controls only. I personally was close friends with an individual who had his legs amputated below the knees shortly after birth due to serious birth defects that were unable to be treated medically. He was able to obtain a vehicle outfitted with hand controls which he operated quite easily and safely on the city streets.

    This was actually heartbreaking to watch. I’m not deaf, but I am disabled. I feel terrible for this man. He deserves more money and those officers need disciplinary action and more training - ADA and sensitivity, at the least.
    If they killed someone who is elderly, a pregnant woman’s baby, or a heart patient, they should be charged with murder.
    And I say this as an avid LEO supporter. Do they even know what would happen if they tased someone with a pacemaker??

    I'm Hard of Hearing in Texas, and I recall originally seeing this video and thinking "How can you comply if you don't know you are being commanded to do something?" I'm not even Deaf but I can't properly discern what is being said unless the speaker is in my line of sight. So much wrong with how this was handled... it is absurd.

      a lot of blind people can still see a bit and a lot of people who are deaf can still hear a bit. also they are on a call for a verbal argument would tend to imply that it's not 100% hearing loss just some simple math.

      ​@billboein Thr ability to MAKE NOISE does not imply the ability to HEAR. Notice that the man's vocal cords still work but his words are hard to distinguish because HE HIMSELF can't hear what he is saying. It's like talking to someone with headphones on. They are shouting and don't even know it.

    End QA , make officers get Law Enforcement Insurance , so when they mess up they get sued , happens too much no more law enforcement for you !

    The application of the law can not discriminate. Hearing impaired citizens must be subject to the same rights violations as anyone else.

    Tampa cops just did the same thing to me 2 months ago . Being deaf is a crime in Florida according to the judge

    I remember working as a photographer for a daily paper decades back. A SC trooper t-boned a deaf driver at an intersection, running the light. He said his sirens were on, but no lights. The driver was ticketed for failure to yield.

      A cop in my town made a left turn on red, hit a paraplegic man in a wheelchair who was in the crosswalk and had a walk signal, and he wrote him a ticket for jaywalking even though the whole thing was on dash cam, just so he would look worse during the inevitable lawsuit.

    Thank u 4 sharing! I never seen this either! Its outrageous how this is ok!! He wasnt doing ANYTHING wrong! Even if he seen them pull up, that doesn't mean its 4 him! Ugh disgusting! That officer SHOULD BE FIRED...but at very minimum, RETRAINED, at his own expense..not taxpayers!!
