RAW: Officer explains why man who is deaf was arrested following traffic stop

  • A civil rights lawsuit was filed last week on behalf of Brady Mistic, who was arrested after a traffic stop in September 2019.
    According to the lawsuit, Mistic cannot read lips and can only vocalize a few words. When he tried to communicate with officers using sign language, the lawsuit says they put him in handcuffs.
    The lawsuit names Officer Nicholas Hanning and Officer Ellie Summers, who were both involved in the arrest. It also names the City of Idaho Springs, and the Clear Creek County Board of Commissioners.
    The lawsuit claims Hanning was unnecessarily forceful, and the two officers used a stun gun on Mistic twice.
    The lawsuit also says Hanning broke his own ankle during the arrest. Mistic was charged with second-degree assault on a police officer and resisting arrest, charges that were later dismissed.

      When they mute their cam, it’s also known as a conscience of guilt. Same thing if their video you and then he goes off to the side to talk to other police officers and they shut off their camera. It’s called a conscience of guilt that will not go over very good in court.

      What happens is that when they turn the camera on it saves the last 30 seconds of video automatically and starts recording, but it doesn’t save the audio, about 15 seconds in you can see them activate the camera and that’s when the sound kicks in

    Poor guy spent 4 months in jail because he could not communicate with anyone on the outside to help him. He sued and received a $255K settlement. One cop was fired later for tasing another suspect.

      It's strange. She didn't say one word about him being deaf, which prevents him from the proper reaction. Public servants are supposed to show empathy.
      Imagine that he may need some money for his diagnosis and she treats him like a criminal putting him in jail or she treats him like a stupid dummy instead of helping him.
      All of it is preventable.
      It's interesting when cops talk about crime prevention or proactive policing, yet some of them do the opposite to good people.

    I left policing over ten years ago, because they majority of my coworkers were incompetent, police officers will over react to something small and simple causing unnecessary injuries, but they will under react to a serious incident like Uvalde Texas. I hope this man gets justice.

      @@ianbattles7290 I don't understand how anyone recovers from that sort of thing, and it terrifies me. I'm not deaf, but that's not the only thing that causes this sort of horror. If I spent four months in jail like that, I would end up homeless, jobless and, at my age, probably unemployable, all my belongings gone, my cat probably euthanized, no way to get medication or doctor care for my health conditions. All because some cop made up some BS to justify throwing someone in a cage over a simple misunderstanding.

    This is another great example is the police escalating the situation. The tone in the officer’s voice, even now that she knows Mr. Mystic is deaf is, “Do what I say & do it now”. This guy was totally clueless as to what the hell was going on & the police just used force on top of force. I understand that police officers face various situations in dealing with the public, but to ignore the clues Mr. Mystic gave them, that he could not hear anything they were telling them is unforgivable. In the hospital room, in this video, the officer sounds like she is doubling down, “You didn’t do what we told you & now you’re gonna pay for it”.

    As a deaf person, this is absolutely terrifying. I have a laminated sheet that explains I’m deaf and how to communicate with me kept in my car for this reason. I was told to place it on door window then keep my hands on the steering wheels until they communicate via paper/pen or an interpreter. People are unpredictable though. I’ve had people become extremely angry in public because I didn’t hear them when they’ve said excuse me behind my back. I’ve been shoved, had things thrown at me, and yelled in the face. It’s a rare occurrence, but it still happens. I hope the lawsuit is the catalyst needed for police training on how to handle people with disabilities.

      Fort Worth, Tx. cop exited his vehicle, called an elderly lady with a camera by name and in 12 seconds on video, had her slammed face down on the ground and yelling "STOP RESISTING" as two female officers told him "She is unconscious and bleeding." Cop has a history of use of excessive force incidents. Was big news, but has died down and I've heard nothing new in almost a month.

    I had a police encounter a few months ago. Im also Deaf and grateful it didn't end like this. I got falsely detained for standing around waiting for a church I didn't realize had been canceled to begin, but knowing my rights and using my phones notepad helped out significantly. The officers gestures and lack of ASL skills only made things worse. I wish they'd ONLY written, but who wants to write and have proof of what was done and said?

    Back when I took drivers Ed, we were taught to meet officers at the back of your car when pulled over. Then came the seatbelt laws and tickets couldn’t be given for failure to wear seatbelts if you met them at the back of your car. Then young police officers were trained different to throw other charges if you got out of your car. That is the history of the evolution that created stories like this.

      The other officer got fired after that incident with the 75 year old. From what I read officer summers was being trained by Hanning. I doubt she will face disciplinary action for following her training officers lead. She got a verbal warning for the other incident with the 75 year old. I hope it works out for him.     I honestly don't know how they go to sleep at night. Knowing that they've towed this person's car hurt them so bad that they have to go to the hospital and are threatening them jail. Not even threatening she's going to take him there I'm sure. They make my stomach hurt. It's so disgusting. They're the criminals this is criminal to watch this.

    They always try to rationalize rather than simply admit they made a mistake and seek training to become better. The problem with sooooo many cops is they think the are in charge. They are servants. The job duties are to "protect and serve". Not "boss y'all around".

    I have two boys around his age and my heart goes out to him and his family. The way he was treated is uncalled for. That "officer's" arrogance is palpable on video through her words & tone. Just imagine her at "work"! hope he gets every penny that's coming to him. I'm so sorry this kind of inhumane treatment was inflicted on this young man. So unfair.

    I Pray that this man does get a lawyer. Why was the camera muted during the conversation in the hall way before for speaking with the suspect? To me this was get your story straight time. The deaf man asked the right question through his interpreter. Good job to that healthcare worker.

      So the reason the footage was muted was because she didn't actually turn the camera on until she walked into the room when the audio started, their body cams record 30 seconds before the record button is pressed (their constantly recording but only starting saving when the button is pressed) but the audio is muted.
      It's very similar to a car's dash cam

      It's literally in the design documents for the camera so...

    I hope that the deaf individual, gets compensated for what he had to deal with. I’m over here just smh at the whole situation, like he’s deaf, it made sense he got scared, and later frustrated, he should of never went to jail in the first place, at ALL! Even after watching this 4 times, this has made me frustrated for him, just sad. My heart goes out to him. ❤❤❤❤❤

    These two are No Hero's. Excessive force. Male trying to impress female officer, and her trying to look like she is tough like a male. After having been in law enforcement for many years myself this is disgraceful behavior and an embarrassment to law enforcement as a whole. Interesting how they quickly dismissed charges too. They should be charged with assault, unnecessary use of force, and fired from law enforcement for good. Civil charges should also be applied along with heavy penalties.

      Thank you for speaking up, I wish active cops would speak out. That's why cops get a bad name as a whole. They defend every cop and blame everyone else and then feel as if they are under attack and can't figure out why people hate them. There are so many issues with this case. They charged the man with assault because the cop hurt himself. Apparently any injury a cop sustains while interacting with someone is their fault. In addition to this, the male cop is not longer a cop and was involved in an incident in which he tazed a 75 YO man in his home after the cops busted in without identifying themselves. The department wouldn't say why he was no longer with them...people are so mad with cops because we want them held accountable. Instead, they are defended and supported by cops and the system as a whole. But thank you for at least speaking out against these cops.

    What really makes me mad, is those two officers are the same two who tased an elderly man, causing him to call back and hit his head, passing out. To cover their unlawful action, they dragged him to the hallway, and went in and got his sword, that he placed up on a cabinet, and later it in the hall, making paramedics think he came out after the officers to attack them. Both cases, there was a rush to use excessive force. Then they lied about both instances, saying the victim attacked them! Why wasn't officer crazy wearing a body cam? With the many complaints against him, why send him out into the public, putting citizens lives in danger? When these both happened, their supervisor said he reviewed the report and they didn't violate policy! THAT'S THE PROBLEM! Because a supervisor, and perhaps a police department, wanted to cover their A*,! They would rather charge innocent victims, than admit there's a problem, and retraining is necessary. That make officer has anger issues! Yet he didn't have to spend a day in jail! He was trying to take the freedom from two innocent victims, and the prosecutor goes easy on him? The deaf man spent 4 months in jail, with no aides to help him communicate, although he asked many times! You would think the officer who used excessive force and blamed the victim, could at least be made to spend the same amount of time in jail!
    Next time a police chief says they hold officers to a higher standard, ask how! There certainly isn't any evidence of that in these two cases, and many more!

      there was a a video a young black male who was deaf. and was murdered despite the fact that the neighbours were yelling from the first floor " he can't hear you, he is deaf he doesn't even know you are behind him".

    Interesting point made here. The man says that due to the cops lights he couldn’t see, which to a deaf person means they can’t communicate! So doesn’t it make sense for him to approach, to get past the lights, in an attempt to make the officer aware of his special conditions?
    If a deaf person is pulled over, and the cops lights are blinding him, how would the person determine if the cops are giving him directives?
    With the ridiculous ‘for officers safety’ propaganda going on, cops regularly use their lights to blind the detained motorists, it’s to give the cop an upper hand.
    But then a deaf person, detained and being blinded, not following directives he can’t hear- a ego fueled cowardly cop will decide that’s at least ‘non-compliant’ but more likely claim it as ‘resisting/obstructing’.
    The cop will use that to fear for his safety and execute the citizen.

    I want to remind people that when the police department said they brought an interpreter, that was not true. That was an outright lie. The hospital had Virtual Remote Interpreting (VRI) which is trained to handle health-related conversations, not law enforcement or law-related conversations. Basically, what happened is that these officers USED the VRI from that particular hospital (instead of bringing their own interpreter or their own VRI) to communicate with Brady and that is totally inappropriate and unacceptable thing to do. It puts the health-trained interpreters in very awkward situation. If it was used in the courts, it would be considered as inadmissable. Goes on to show how dumb the cops can be.

    Where did she get the idea that he MUST remain in his vehicle and cannot get out unless ORDERED to do so???
    The court decision is that if ordered to exit or remain in your vehicle, you must do so.
    In the absence of an order from the cop, nothing prevent anyone from exiting or entering.
