Burger King just made a major move in the Twitch space - a potentially ILLEGAL move! You know what McDonalds did to promote themselves on Twitch? They payed an unknown artist to create a banner. The artist did and then they payed Twitch streamer to use it. It is not only adorable, but also a much better way to get money out of Twitch.

it's funny that you mention throne of lies, because that's an actual game and I was thinking of a very similar game during this video called Town of Salem. I was thinking "wait town of salem terms of service? That's TOSTOS! Hilarious!"
BK really likes getying involved in this kind of things. There was also the incident where the person on the TV commercial would say "Alexa, what is burger King whopper?" to which the alexas at home that are in range of the TV would answer by reading the wiki entry for the whopper. Internet trolls retaliated by editing the wiki entry and putting cyanide to the ingredient list which forced BK to shelf that commercial.

Another thing they did:
Burger king russia(aka russian sub-division) intentionally released an article about how their app **DIRECTLY STREAMS A VIDEO THAT WILL INCLUDE YOUR CARD DETAILS** on habrhabr(one of the biggest pure-tech site, something like old school "blog site", but for software developer professionals, it even had an invite system for a long while) and pikabu(just entertaiment site, functionally reddit, but smaller and worse and in russian). Got called out on it eventually, but nothing happened since the whole ordeal was a hoax on their part, just left a shitty aftertaste.

I saw a Burger King tell boy scouts (minors without anyone who could make legal decisions) that they owed it to them to advertise because they ate BK’s food. Big companies get away with whatever they want.

I stopped eating burger king when they started to push for "healthy alternatives." Their whoppers have no taste anymore and a lot of their ads don't help them. The "not everyone is happy meal" was pretty much the last straw. Side note, I prefer how Wendy's did the social media thing. They basically took over twitter for a time by having a sassy red head anime mascot telling people off. People were willingly sharing their content because it was funny.

The funny thing is that Burger King’s Australian subsidiary Hungry Jacks is already being sued by McDonald’s for using copyrighted material for their advertising. Clearly Burger King is less focused on being ethical, and more on making money

I don't care about streaming or advertising. What pisses me off about this situation is A) the breach of decorum, and B) the hijacking. That's precisely what BK did here. They hijacked the stream for 30 seconds. The streamer couldn't stop the TTS message once it started, so there was no control; that's hijacking. They may have paid the individual streamers a minimum donation of a few dollars each time, but it was unwarranted and was done WITH THE STREAMER'S FACE ON CAMERA WHILE THE MESSAGE WAS READ. That ALONE makes it seem like it was sponsored, makes the viewers associate the message more with them than a random midroll ad. I don't care what the law says in the moment; even if they found a loophole, they're in the wrong. They violated the spirit of the law and violated common etiquette, and they deserve punishment.

MessInMines I don’t think so. They often buy the info from info farms that buy the info from the websites you use. The websites DO tell you they will share info with third party companies, but it’s in the terms and conditions.
So, for instance, your dog food company may sell your email address to an info farm, which sells it to Burger King, and then when you get a Burger King email, it’s legal. If you ask for them to not spam you, and they still do, I believe that’s not legal. But you have to deal with it in the first place. 🤷🏻♀️

The viewers agree to see advertisment when they use Twitch.
The streamers agree to show their viewers ads from twitch when they chose to display them.
Twitch allows companies to advertise on their platform when they make a deal with said company.
Here Burger King had the consent from none of those.
The problem here is that the only one that can actually go after Burger King is Twitch.
Twitch can go to court over this for anauthorized advertisement and win easily, but i'm not sure twitch is willing to.
Depending on the people in charge it's even possible that Burger King will still be able to advertise on Twitch after this.

Fun fact: Here in Australia “Burger King” is called “Hungry Jacks”
And the funny thing is its because the Aussie government was primed to sue BK, as there was already a fast food chain called 'Burger King' when American BK tried to set up shop, hence the name change.

I think twitch has ground to sue, because there are twitch terms of service specifically made for advertisers on the platform, and it would stand to reason that bypassing the entire verification, taxation, and moderation of twitch to advertise would be disruption of the platform, causing in, possibly large, monetary loss.

To be honest, those of us like me who are turned off by this kind of BS are probably the ones who were already not going to BK.
I won't be giving them business for a while, but the last time I chose to go to BK, they were selling glasses for the 2009 Star Trek movie and I've only been through any businesses drivethrough about 10 times this year. They aren't losing money pissing me off. Meanwhile, one person seeing a stream, thinking it's funny, and going out and buying a Whopper almost entirely pays for the revenue they gave a streamer. Granted, that doesn't count the cost of whatever human employee they had doing it, the marketing team that came up with the idea, and the profit margin they threw on top before sending BK the bill, but it only takes a few, and it's likely they targeted high profile streamers to get more distance from their efforts.
Sadly, being a jerk pays in marketing.

Simple solution run streams on a delay like radio does so that if something starts happening out of their control that is unwanted/inappropriate then they can dump that portion and it never gets aired.

Also... this seems like a perfect subject for discussions about anti-spam laws, whether or not they exist, whether or not they *should* exist, and if they do, whether or not Burger King actually violated any of them.
Without a contract, legally they wouldn't be considered a sponsor. It's not forced sponsorship, it's basically unsolicited mid roll ads
@@GAMINGBAUS8703 Well that depends how the law defines contract. For example in the UK, contract doesn't need to be paper that sign by both side stating what do they promise to eachother. A verbal/ text for this case stating "I just did" is good enough. But of course Burger King could argue they didn't mean to sponsor them. But just to give the streamers $5 for whatever reason.
It could also be argued the the “just” meant “only” or “simply”.
In that context it would be.

Stepping in the conversation, they actually rely a lot on ads. Even if McDonald's is as big of a corporation as apple, they don't miss a single opportunity of saying "Hey! Here's McDonald's, come eat som crap!" Because it might seem useless but it actually works and some people (like me) actually forget that burgers exist.
Ads can make customers more satisfied with their products so giant companies still make them even though everyone knows about them

I agree with the end statement (closing) Streamers (Top) CZcamsrs are “influencers” for a reason. It won’t take much to make sure something like that doesn’t happen again and if they wanted to they can make the whole campaign backfire.

I know, old video, but in regards to the old law's covering sattelite feed, all of our internet at some point is sent through a satellite. I could see very easily someone at the fcc being able to make that case. I wasn't able to find anything online about how it turned out.
I would like to say, some internet does come from satalites. It's called Satellite Internet and while in mainly brings it to rural areas, it is the same. So if any streamers that had this Burger King ad or whatever it was in their stream, and their internet was provided by the satellite, the yes. It would technically be illegal

Funnily enough, MC Donalds did something similar here in Germany last year with a larger channel. Similar to Cash app and very careful that it is okay for the streamers.

This is exactly why terms of service exist. If I'm not mistaken, Twitch could sue Burger King for violating terms of service, abusing the platform and advertising without their permission. Twitch would win as well, because all users *agree to the terms of service upon joining.*

@@gussewho2732 True, for all intents and purposes the streamer who works for Burger King falls under the ToS. Unless there are additional terms that can target the employer of users if the platform is used for advertising by a larger entity.

It’s things like these why my friend and I when we are streaming have the disable tts button on hand and at the ready. We also have stream delay enabled so we can censor any advertisements that we didn’t approve of. The worst part is it’s gotten so bad on our channels we get and unapproved tts advertisement 3-4 times a stream. One time my buddy got 17 tts ads in a single stream that was 3 hours. I hope other content creators out there don’t have the same troubles we have.
