- EP. 1248 BREAKING: Apple Watch is BANNED in the United States
The Apple Watch is about to be BANNED in the United States, and NO! This is NOT clickbait, unfortunately.
Patent disputes are no joke, and Masimo claims that Apple has infringed upon their patents regarding blood oxygen tech.
Special thanks to 9to5Mac who broke the story first:

great news if anyone wants to buy an ultra new Apple watch, packed unopened for $1,300 😂😊
Lemme get that, will trade 1300 rolls of toilet paper and 900 bucks 😂
It is shit if you don't tell me the day you buy it. So I know if it is still eligable to buy apple care. Without apple care any apple product is shit and uglier than my grandma's asshole. It is like having sex without a condom it is fun until shit hits the fan like getting an STD. In this case having major scratches or crackes on the apple watch when you brake it. Otherwise what is the point anyone can go to Canada and still be able to buy one even after December 21st.
eBay 😂
Lmao
The fact that Apple didn’t cover their tracks or buy out the other brand
They tried to. Just maybe not as legally as they thought.
I'm sure Jon will spin this some way in Apple's favor and badmouth Masimo
@@LC34999 Well, technically Masimo should have spoken out back in 2020 if they wanted something done. If Apple truly did steal a patent, waiting for over three years until the tech is already well-established is a scummy, albeit clever, cash grab imo
It’s weird to see this be so public, normally these mafia style shakedowns are kept away from the public
LOL..."Mafia style shakedown"""... Have You never heard of patents ??
And when has a patent suit ever been "kept away from the public" ?? Only reason You don't hear about it 100 times/day is that normally it's about things that normal people either don't understand or don't care about... or both...
I would agree for patent trolls but Masimo is a legitimate medical devices firm. Their tech and devices are used in hospitals everywhere.
Apple could simply resolve this by paying royalties/licensing fees but I guess they don’t intend to.
Why were iphones banned in parts of europe?
This story is more likely damage control than anything else.
Did you hear something in the news about Tesla cars being recalled when it was actually just a software update?
As someone who’s life was saved on thanksgiving this year from the blood oxygen sensor on my series 8 this is kinda heartbreaking. I hope this is able to be resolved as this feature can be so important for people.
Probably has nothing to do with the o2 sensor and more about why it was banned in parts of europe and that's the SARs rates.
You can't turn off wifi/data with an apple watch?
@@Freakazoid12345 the exchange rates?
Dude that has nothing to do with my watch saying “your blood oxygen is at 87%” and getting to the doctors right before it dropped lower. Nor does it have to do with the patent suit in the video?
@@Freakazoid12345 can you explain please 😅
@@Portal64 why did your o2 drop so low?
@@Freakazoid12345 I had contracted rhinovirus while I was in the Philippines, which is a flu they get there.
idk how to feel about this. On one hand, Apple didn't respect the patents. On the other, it sucks to see patents restricting useful health and life-saving consumer technology.
Apple respects parents only when they own them and wants sue other companies
Apple just needs to buy masimo
But Masimo is not on sale. Masimo needs to agree and let apple to buy them. A company can't buy a company unless that company that apple will buy needs to be for sale.
@@ivanz4133 it’s a joke boss
well actually if a company is publicly traded, the board of directors have to act in the best interest of the shareholders. in that case, if a majority steak is bought for a sum that exceeds a certain amount, they literally can't say no. that's how Elon did it with twitter because they know they lied about user numbers, bot percentages and so on to push the value of twitter far beyond it's actual price. Why the FTC ignored this for years, never reviewed twitters numbers which were obviously fake and still is ignoring it is above my paygrade. Let that sink in.@@ivanz4133
@@ivanz4133they can, hostile takeover exist.
@@ivanz4133 If Apple would offer 50.000.000.000 USD (they have much more) Masimo would let Apple do much more to them....
Even though I have the ultra 1 this kinda makes me wanna run to Best Buy and grab a series 9 😂
I’ll get a s8 and call it a day
I think that this is what the actual plan is, to boost sales.
Bought 5 today 😂
Just give the 10% to the big guy and he will give you the veto
I love patent laws for the good stuff they protect, but I'm very aware that the patent system stifles a whole load of innovation and creativity. I don't know if this is a good example of patent law or a bad one.
Thats why we have China 😂
They don't stifle innovation, they promote one, they make sure that if you invent something, you will be able to make enough profit to make back all the costs it took to develop it and thus giving you incentive to innovate. After some time, during wich you should have made profit, this new technology is available for everyone with detailed patent explanation on how to use it. Even this types of patents are putting everything in motion, and it's important we protect the rights of those who innovate to make profits on these innovations
Got my ULTRA 2 already!!!
Gonna check my BLOOD OXYGEN RIGHT NOW 😂
Wait a $3 trillion market cap company can’t just pay a
Licensing fee 🤔
You don't become a $3 trillion company by paying a licensing fee.
They'd rather jump through several court hoops, bitch and whine, launch a PR campaign, and petition the President.
Exactly that what they did bitch and complain and they lost they stole the idea from someone else
Alot of these companies dont do licensing fees. They just accumulate patents just to sue companies that violate them. Same thing with facetime. Just so happened that some random company had a patent similar enough to sue them for 400 million.
@@blackfalcon1324but it's not, Masimo is a reputable medical equipment company, the number one in the blood oxygen monitor sector. From what I heard, Apple approached Masimo first, but after a lot of demos and proof of concept. Apple said they don't want to continue with their collaboration and cut Masimo out. And not long after Apple said they had it all figured out. I don't know the details, but from what I know it's very suspicious to say the least.
So regarding this, I’m curious, did apple change the sensor after series 8, or is it the same one being used from series 6 up till now?
They only sell the 9 and ultra, so that’s what they can ban… 8 and prior are not sold by Apple currently, just resellers
It’s the same sensor
I have a Series 9 waiting on me in my parents’ closet for Christmas….
Knowing your gifts before the big day is boring.
@@PocketUau Yes it is
@@PocketUaubetter than not knowing but it's just a planner notebook or ordinary clothe
Oh wow. Thanks for reporting on this!
Let the mad rush to the sales counter begin!
Holy sh!t!! Jon uploaded twice in a day! LET’S FUCKING GO!!
inb4 they push an update to disable the feature entirely - I really hope not
Did Jon just release 2 vids in 1 day wtf?!😮
I worked at Masimo during college. Amazing this actually ended up going through. 😮
So this is your fault?
@@MegaUtube99 😂 I wish. I wouldn’t be broke anymore.
Amazing?
@@ben_bot7289 You wouldn't think a trillion dollar corporation that has a history of bullying other companies would lose any sort of litigation.
perfect timing, right before Christmas 😂
the first initial thought was that scalpers would have a hay day with this one. the second thought is that because of the ban, more people may actually go out and buy an apple watch
Does the sales ban affect resellers?
Only thing is how does it affect the UK market, will that stop or is it just for the US market?
It is possible that the patent only applies to the US, or maybe the UK has stricter rules on patents for medical technology.
No way I opened my phone at the exact time you posted 😮
So what you’re saying is I need to go upgrade now before it’s too late?
I don't sit on the toilet. The toilet sits on me.
Take off the blood oxygen sensor, shame on you
Take off 3D Touch, shame on me
What about the Garmin D2 pilot watches that have the same type of SPO2 sensor
Maybe they have a licensing deal
probably some settlement for use of patent, done before or similar
The biggest Christmas sales pitch ever. You have 2 days to buy Apple Watch 9...
It’s banned only in the US?
They can just turn off the O2 sensor via firmware till next cycle and replace the watches for free.
The problem is the people that are depending on that to function for their health currently will be affected so apple wont do that...its just easier to stop sales of it till they fix the issue...it leaves a bad experience if you start limiting functions on apple products...they caught some heat for it in the past so im assuming they dont want to repeat history
I’m sure the users would love to wake up to an automatic update that removed an Apple Watch feature
Fosho - agreed. I was reacting to the comment that there would be a recall. If existing users can continue using then I think there's no issue - except Apple will lose out on the holiday season sales on the newer models. Stock fell around 1% so the street is not too worried about it. I hope the issue is just with the O2 monitoring and not the HR monitoring. The O2 monitoring on Apple watch sucks anyway - never accurate and takes forever to measure. Not many are going to miss the O2 functionality.
of course you mentioned settlement right after i wrote about it lol
Well luckily I got my series 9 this Saturday 😬😂🤣🎉
Same 😅
Why just the Ultra 2? Correct me if I am wrong but doesn’t the Ultra also have the Blood Oxygen sensor?
because it’s not sold officially by apple anymore
This Kinda Sucks because I was looking forward buy the Series 9 after Christmas but I Guess The SE 2nd Gen Will Work ;)
They're still for sale. Order now!
@@quinton1661 I wish I can my friend :(
I love my contraband Apple Watch Ultra!
I own the Apple Watch Series 7 and I don't even wear it much. I barely use it; I just have it sitting my charging station. Makes me wonder if Apple Watches will become more valuable if they can't sell it in stores anymore... 🤔
That’s what my series 4 did. Used It as an alarm clock and then for my workout in the morning otherwise it’s sat on the charger. That was until I bought the ultra 2 now that thing is on my wrist all the time the reason being battery life. It made no sense to me to wear, the other one when it was dead by 1- 2 o’clock in the afternoon
You just don’t know how to use it
I now want to buy one at 2:59 PM LOL
What about repairing your Apple Watch series 9?
Thats crazy how??
I just got my ultra 2 last week thank god
Double episode 😮
They could just buy Masimo and then sell it off after they own the patent. Masimo has a market cap of 6 billion and apple sells about 17 billion in revenue with the apple watch per year
And you think they can just go buy them when the company is not for sale?
@@elivegba8186 yes because it is a publicity traded company
@@elivegba8186 Yes, they go to the share holders and offer them double the market value of the stocks, get a majority and fire the CEO. Its called a hostile takeover and happens all the time.
So, does Apple brick the pulse oximetry functionality on the existing watches after 12/25? I wonder if previous buyers will eventually lose that functionality.
no, theyre just cancelling sales of the devices. they would have to essentially refund everyone who bought one of the new models because who tf is gonna want half the features removed
9to5 Mac is the Alex Jones of the Tech World! LMAO!!
Tim Cook surely is channelizing his inner Steve Jobs and firing someone's A*s as soon as this is fixed or might have already pulled the trigger(not literally *winks* )
Well that seems unfair. Just veto it bc it's apple 🙄
Doesn’t anyone find it a bit sketchy that 9 to 5 Mac are making these announcements? This happened with RCS.
So I have a question… if the technology is in all Apple Watches back to series 6 why are all of them not being pulled?
Im glad i already got my series 9 :)
Apple : a company soo big that the president of US himself has to review a patent issue 😶
Its not due to the size of the company, the president has the authority to refuse to enforce rulings from foreign courts.
I feel like this is just going to boost sales
I feel fancy with my contraband 😉
I’m about to head to the Apple Store and buy an S9/ Ultra 2
Welp. I know what I'm getting myself for Christmas
He probably forgot about the veto
Oops. Got the 9. They might kill off blood oxygen sensor with an update. Better switch off automatic updates
I'm glad they get call out on stealing others tech ...
I mean, it is kind of hard when there are patent companies that just patent the word 'the' just to sue you.
agreed but its not like apple dont know ...just like i know the infringing on arm chips that is qualcom tech and every knows that@@blackfalcon1324
Licensing agreement seems the most logical to me, but I'm a machinist not a lawyer lol my opinion doesn't mean much here
apple watch 8 also had a blood oxygen meter right. why wasn’t this a problem a year ago?
Maybe, but don’t think Apple is selling the 8 anymore and the ruling wasn’t out then?
Watching the 1st video of the day and this one pops up
If it gets bad it would probably be cheaper for Apple to buy out Masimo
contraband is my watch band of choice
Watch SE users are chilling right now.
Treacheries of the Troublesome Towns is a full town adventure generator for Four Against Darkness. It is published in two books, totaling over 400 pages of information.
So right now the Apple stores in US gonna be packed as hell
I read something about this about a year ago and they were trying hard as hell to fight it
Got the se2
Watch SE still available… 😂
What's happening today, 2 videos a day?!
Seems like it’s already blocked on the Apple Store.
This copyright stuff is ridiculous. Imagine havinv ease of access of a useful feature on a convenient device. No, you gotta buy specific oxygen measurer or something
In other words... But the watch and hold for a couple months and 💸.
This is like Huawei all over again 😂
Come to Canada we have lot of them and they aren't banned!
3:40 - Missed the perfect opportunity to say "Biden is biding his time" 😂
Just became a collector's item. They're going to sell out long before 12/21.
Right
2 FPT A DAYYYYYY!!!
I was like wtf then at 0:58 I was like okay I got it I can chill now
They got the Cramer curse its ggs
Apple, this is karma for shutting down Beeper Mini. If you want your apple watch back allow Beeper Mini or even just Beeper in general at this point
Wtf is beeper mini? And who cares?
Don’t
Howdy Jern
Funny you can buy all sorts of oximeters for $29.95.
Perhaps they did the proper licensing deals to make it legit
anyone owns a series 9 or ultra 2 will have the 02 monitor disabled with software update.
This feels like if clickbait titles on 9-5 Mac came true
Yeah they gotta go 2 court and get masimo outta here
This is gonna blow over #1 company in the world got so much leverage lol
Is this all a big marketing ploy?
Could be since the watches this year were basically the same ones as last year… except you can pinch your fingers now to click
Apple should just buy the company. Then they own the patent.
Apple cannot buy a private business , masimo is a medical equipment manufacturer for hospital patients and medical equipment for homes they're not a business that can be purchased by a technology company which does have anything to do with the medical field.
The probably do not have to stop selling the Apple Watch, Apple doesn't want to pay Masimo.
Bruh i just bought a ultra watch 2 oh hell no
The apple watch needs to check if Joe Biden's sugar's high from eating too much ice cream
buy a new series 9 keep it and see what happens and maybe resell it for more
So what you’re saying is we need to buy an Apple Watch?
Nice I bought 10 of them so I'll resell them
Don't get it, this is a dispute between two companies, why drag the US president into this? Let them slug it out between themselves, that's supposed to be the way of "the free market"
Because it was a ruling by the “international trade commission” which is a federal agency. The feds have power over interstate trade.
@@cypvh74 ah, cheers
Why in the US ?
Patent dispute between two US companies?
Who da fuq needs an Apple Watch ? Get a real watch. You have a phone already
It's the connectivity. The Apple ecosystem. The "I don't have to take my phone out of my pocket in order to check my texts or make a call, check how far I just ran, what my heart rate is", etc. Not quite as straightforward as you painted it.
I bet they find a way to settle this. They make too much money on Apple watch
They lost the case already
