Apple Watch series 9 and Apple Watch Ultra 3 are banned from being sold in the United States waiting on a decision from a lawsuit from the company Masimo.

You’re right, but Apple doesn’t sell the previous versions in their stores anymore. That’s why they’re talking about these two models mostly.
