  • Unscripted and unedited, the Gun Cranks sound off on the ATF's new pistol brace regulations - which, at the stroke of midnight on June 1, turned who knows how many law-abiding citizens into felons instantly. Penalties for owning an unregistered short-barrel rifle (SBR) could result in up to 10 years in federal prison and a $250,000 fine. But the real kicker ... Congress didn't have a lick to do with it!     Just think, The ATF could do the same thing with red dot optics on pistols or standard capacity magazines.

      They already tried going after variables and magnifiers before. Which also already have a history of being used for hunting

    How could I register a brace on an 80% lower I completed? No way I am putting a serial number on it.
    I feel better that I haven't taken this to a range or a LGS to show off.
    The worst part of this in Washington is I can't change it back into an un-braced build. The parts are now illegal here. Some Catch 22 at work here.

      See, that's exactly the type of questions we should be asking... "So if I remove and destroy the brace - do I also have to remove and destroy all the compatible stocks that are currently on my legal AR's?". What a clown show and none of it makes any sense whatsoever UNLESS you assume they're just angling to make ALL AR's illegal. That's the only way this makes any sense. The problem with that is the second amendment was intended to be a fail safe in the event that the American people needed to help turn back a foreign invasion OR defend the republic from tyranny. Leaving us with 6 shooters and scatter guns doesn't come close to satisfying the second amendment. If they really wanted to disarm people they should try doing so with the tens of thousands of gang bangers in Chicago and the other blue cities who are responsible for a staggering percentage of gun violence statistics annually

    There is so much contradictory information about this going around on the gun channels. I heard that the 5th circuit court of appeals blocked this in my home state of Louisiana.

      NO! There are three Preliminary Injunctions that cover members of three organizations nationally.
      1. The 5th Circuit injunction applies ONLY to the NAMED PLAINTIFFS in its lawsuit, which are Firearm Policy Coalition (FPC) members nationally, and Maxim Defense Industries customers nationally.
      2. The next injunction is from the Northern District of Texas. It applies ONLY to the NAMED PLAINTIFFS in its lawsuit, which are Second Amendment Foundation (SAF) members nationally, and Rainier Arms LLC customers nationally.
      3. The 3rd injunction is from the Southern District of Texas. It applies ONLY to the NAMED PLAINTIFFS in its lawsuit, which are Gun Owners of America & Gun Owners Foundation (GOA/GOF) members nationally, and ONLY EMPLOYEES of the State of Texas and its agencies (one plaintiff is Texas Att'y Gen'l).
      So, if you're a member of FPC, SAF or GOA you're covered. If you bought it from Rainier Arms LLC or Maxim Defense, you're covered. If you're an employee of the State of Texas, you're covered.

      @@GunCranks FWIW there have been several major incidents in which pistol braces were on the rifles (three or four). However, I agree that with more likely 10-20 million braced pistols, if they were highly prized devices by the criminals, you'd see many, many more of them being used criminally. The most popular firearm for mopes and perps is the 9mm pistol, and the "Glock Switch" is their most desired accessory along with the extended mags. I've sent a message to my Congresswoman to push the Joint Resolution to a House floor vote. Two cases to watch now. The FRAC plus 25 State AGs Pistol Brace lawsuit in North Dakota District Court, and the 4th Circuit Court of Appeals, which just heard oral arguments on the Maryland gun and mag bans. That one was one of the four GVRs that SCOTUS issued a week after the NYSRPA v Bruen decision last June. I predict the 4th Circuit will be a 2-1 decision striking down Maryland's weapons and mag bans.

    There is no way thay they're not going to eventually say "well, you cant have any other compatible stocks in your possession either". They know that folks who own ar pistols are very likely to own many other firearms. That's the whole point of this 'rule'. It's just another convenient registry

    I took the brace off my PSA AK-V because it was a plastic piece of crap and I didn't like it anyway. It's really not that difficult to shoot with a sling.

    Gelhaus, just a quick question- does Gunsite Academy have an AR-pistol course or allow you to use one in a pistol class? If not then it is a double standard that these firearms are really NOT pistols.
    And not everyone agrees that these are “pistols” as even FMG Publications has pictured these “pistols” being fired from the shoulder- not as a pistol is intended to be used. A lot of gun owners agree and see the “brace” as a way to circumvent NFA rules. The ATF clearly defines what a pistol is and in is most basic element is a firearm that is intended to be fired with ONE HAND. Ridiculous as it is putting a vertical foreword grip on your “pistol”- even without a brace- declassifies it as a pistol
    ATF “rule” making aside- yes you are correct- you cannot enact a law and retroactively charge someone for committing that particular crime. However in this case, the possession of a prohibited item is an “ongoing crime”- that CAN be charged. If an enacted law (read NFA) is amended that in theory should be ratified by lawmakers- however that is a VERY simple and quick process (only a voice vote is required as in “the yays have it”) so don’t be surprised if it happens under the radar.
    And yes- AR and AK “pistols” have become the gangland weapon of choice. In the last 5 or so years, we at the PD have seen an extreme spike in .223 firearms being used in drive-by shootings, the vast majority of those weapons that are recovered have been in “pistol” form. And also AR “pistols” have been used in several “mass” shootings.
