On June 7th, ATF published a new notice of proposed rulemaking on its website entitled Factoring Criteria for Firearms with Attached “Stabilizing Braces”. The proposed rule has not yet been published in the Federal Register, and interested parties will have 90 days to comment on the proposed rule once it is published.
The rule seems aimed at making nearly all configurations of firearms equipped with stabilizing braces subject to the taxation and registration requirements of the National Firearms Act.

No, what is sad how people that aren't disabled veterans put these braces on their AR or AK pistols and shoulder these pistols like rifles to avoid getting the tax stamp for an SBR are the ones taking them out of the disabled veterans hands. Again, it's just people who took advantage of loopholes in the laws. No, I don't think sbr's should need a tax stamp nor a short barrel shotguns or suppressors.

@@JordanI135 A poll tax used to exist in the US. In order to vote in elections, you must pay a fee. But this prevented lower income and poor citizens from voting. It was done away with. Voting is not a right guaranteed in the US Constitution though. If you disagree, show me where it says it is. it only says certain means of discrimination cannot be used to deny a person the right to vote. Men can lose the right to vote for life simply by not signing up for the draft, for example. US men must Earn the right to vote, US women don't have to do anything to earn the right to vote (even though the all-male draft was also recently ruled unconstitutional, yet remains all-male none the less).
The 2A is a right guaranteed by the US Constitution however, and so one cannot be deprived of their rights by a "pay to play" system. This "poll tax" or "pay to play" approach to Constitutional rights has already been ruled Unconstitutional and other such poll tax laws have already been thrown out and overturned, particularly with regards to the 2A.

As a disabled senior, I've been seriously considering trading my rifle for a pistol braced gun as it would be easier for me to use in home defense. Full-size rifles are harder and harder for me to use.
I agree. Where is the discussion of who can qualify to use a brace? Passing a background check ought to prove you are a grown up. Having a Concealed permit should be viewed as a badge of honor. But if you work for the ATF, *Honor* doesn't mean anything. What about mounting a wooden stock to a Pistol? What happpens if you just buy and mount a longer barrel? I'm a disabled senior too. I enjoy shooting, the way some people enjoy knocking over heavy wooden clubs with a 16 pound ball! I don't try to ride motorcycles, or water ski anymore. I know young people who do. They don't care if I shoot. Let's try compromise for a change. License a brace for 5 bucks for 5 years. Let us defend our home and family to the best of our abliity, and give us the tools to do so. PLEASE?

It is a pistol brace, not a rifle brace. ATF can't even get that right. These firearms are NOT short barreled rifles.
If you want to get technical, Ak and AR "pistols" are SBRs without stocks. But our laws don't reflect reality.
The 4473 has it listed as a pistol, not rifle. Adding a brace is lawful.

Braces are amazing to use as a “stock” because you can store a tourniquet in it!
That's why I have a stabilizing brace on my AR. I walk with a cane and don't have two hands available to carry my AR safely
I'm working on a way to make my ar attach and detach from my cane as well as my sidearm so I can use it as a form of stock

according to the ATF, 2-handed operation of a pistol is illegal (which makes No sense in reality, and simultaneously defeats their anti-brace stance)
@@SoloRenegade okay....but having one hand on a cane only leaves me one to hold it. If I didn't need a cane I'd have a regular AR that I could carry/shoot safely with two hands. I wouldn't need a stabilizing brace or a shorter less heavy barrel.
@@pneeb419 I'm on your side. I'm pointing out how the ATF's own definitions prove the validity of the brace (since one is Supposed to be able to fire the pistol one handed), and how in reality most pistols are normally fired two handed (so the pistol restrictions based on 2 hands are invalid).
The whole sbr ordeal is a joke. It should be no different to getting a normal rifle.

You hit the nail on the head. These braces make it so much easier to conceal these 25 inch long fire arms. Ask any of these bureaucrats to demonstrate how to conceal these pistols.
It's funny how there's a "proper way to respond" to the ATF's ruling, but it won't really do as much good as "properly responding" by showing up with your rifles and telling them "come and fucking take it".

100% accurate. I don't have a brace; but I have an AR and other guns for sure. As a former LEO and retired military I can say that rule changes like these are tyrannical at best. Imagine if having a light out on your car and you fix it (because it happens) and suddenly you wake up tomorrow and find that a "retroactive" rule was applied to that and you are now liable based on whatever method was used to catch you in violation...you now have to figure out how to pay or how to never again without thinking about all the possible outcomes that you're legitimate transaction created...mind blowing...no 1984 today. Technically isn't the judicial bar of " entrapment" ..something like. " the gov convinced you to do something you ordinarily wouldn't have done " so the ATF approved these braces as a move to entrap people deliberately for whatever odd reason

The US military has an M4/M16 mounted short barreled shotgun in service which, coincidentally, can be used separate from the rifle with a stock, like an AR15 pistol with brace. Didn't the NFA argue that such weapons weren't legal since they weren't military issue? And now that they are military issue, aren't they legal now?
The GOA ( Gun Owners of America) have such a thing. They are planing on going to court over this if the ATF try’s to implement this crap after the comment period. Look into joining and supporting the GOA and NRA.

I wish I could find the video, but someone predicted the ATF's "point system" over a year ago. In the video, the host talked about the ATF letter that said the brace did not constitute a SBR because it was not DESIGNED to be shouldered. But then he went on to say that the ATF could still try to confiscate and prosecute a braced AR pistol based on other factors that point to the weapon being designed to be fired from the shoulder, such as a tube-style RDS, bipod, or anything else meant to function like a shouldered rifle. He didn't mention a point-system, per se, but that's what this adds up to. Because of that video - and another one I can't find again showing a technique for using a sling to punch-out a AR pistol instead of shouldering it - I replaced my stabilizer brace with a rubber pad for the buffer tube, and added a 2-point sling and reflex-style RDS. Now it seems it might still add up to being illegal, but that's the point, isn't it? The Biden administration essentially wants to ban all AR's by executive order, and they are starting with the AR pistol because it's already been in contention. Biden made campaign promises to go after the AR rifle (AR14?) but he knows he can't get such draconian laws past Congress, even with a Democrat majority, so he is using executive policy. But, they called Trump a dictator?

I do not own a pistol brace of any sort, but this does not mean in any way that I believe this 71-page document and the preposterous regulations it presents will not affect me. I thank both of these gentlemen for educating us on this matter and providing the means to combat this despicable over-reach. The ATF will be hearing from me and I hope all of you. Together, I believe we can redirect the aim of this agency and the . . . (oh, let's stick with Mr Noir's request to be respectful) . . . activists who are running it.

I already contacted my two senators and my congresswoman to protest this proposed rule. I will be responding to the ATF forthwith. It’s not at all surprising that they’re doing this, but I am surprised at how they’re doing it. We need to fight this head on.
The Marine Corps taught us Marines in Security Forces to fire all 1911 45ACP with both hands ! We were taught that your responsibe for where your round hits ! So when you draw you use both hands to stabilize your side arm! Using one hand to fire your side arm places you at greater risk to miss your target and endanger innocent people! ATF fails to understand modern Firearm safety and yet they are the ones making rules 🤪
