There is a new updates to the VA colossal claim presumptive condition legislation regarding the disabilities and the PACT Act. This 2024 expansion of VA dosability benefits could have a big impact on VA claims and could also signify a move toward future benefits expansion for 2025 presumptive conditions.

Many Veterans lost percentages as well when they filed for the Pact Act. Meaning that the VA did a re-evaluation for thier ENTIRE VA claim. Just be aware Vets.

After sercing 27 yrs, I now have anemia, bone marrow disease, and many other issues I absolutely know are associated with my service...

I got 100% and I didn't even mention my tinnitus, burn pit exposure, JP8 exposure, and uranium exposure (one of our bases had yellow cake lying around). Plus every time one of our tanks blew up it was basically a hazmat site because the armor is depleted uranium. I could get 1000% rated if they let me.

Am I understanding correctly, that is we filed a claim in the past that was denied to due to lack of service connection, and now that condition is pact act presumptive service connected, we can refile it and potentially be awarded an effective date of when it was previously filed and denied?

Ok, first thing, great video my brother. I applied for migraine headaches and asthma back in 2011 and was denied. When the Pact Act took effect and I applied for the same disabilities they approved me but only back-dated to when the Pact Act took effect. This took me to 100% P&T but I'm still upset that I didn't get my full back pay from my original claim that was denied in 2011. After watching a few videos and getting some info from Dewayne Kimble (Retired VA rater on CZcams) he told me they weren't giving back pay like the NEMR Vets. I didn't want to poke the bear so I didn't complain. I want my back pay though.
Same situation. Applied for sinusitis in 2008. Denied. Got awarded in 2020 for sinusitis, but no back pay. I’ve tried but they wont back date presumptive conditions i guess.

Crash crew marine here. We used Jp8 jet fuel to burn for our training fires all the time along with Afff to extinguish neither which the VA wants to claims as toxic right now. And of course even though Jp8 produces crazy amounts of heavy black smoke it’s not the same as the burn pit registry. Been going back and forth to get it documented in the va and on the record.

Here's my question. As someone who worked on and serviced aircraft (F-14's) back in the day. There were many occasions where I was exposed jet fuel. Also, later in my navy career, I worked in corrosion control, where we painted the aircraft, and I was also exposed to several types of chemicals. My question is, should I put in some kind of claim, even though I have no medical documentation? Anyone??????

That is a really good question I was there for KFOR8. I don't think people realize that Kosovo was considered a combat zone at least when I was there. We received combat and hazardous duty pay while we were there. The only thing we didn't get was a combat patch because it wasn't Iraq or Afghanistan.

I was in the radiation earthquake in Japan. Is there anything for me? Stationed in Yokosuka and we had very toxic levels of radiation in our vents while I was on the vent team.
I was there too during that time and from what I found on the VA's website is that fukishima is on the list. I filed for radiation but you need a diagnosis of some sort. Best of luck.
What about the hours of idling in the Humvee's during training and the Diesel fumes?
I have major breathing issues I believe caused by toxic chems from super fund site Ft Ord Cali in the 80's does the pactact cover these Chromic diseases like COPD. And asthma emphasized?

I have problems with my hands. I was 11B1P and all the knuckles always pop and o always have pain. Back in the early 90’s we had MEK dip tanks we used to clean our rifles. We used to get our hands soaked in solvents. I reclassed over to be an Apache Crewchief. I used to get my hands soaked in hydraulic fluid. I have always thought my hand probes were due to those exposures. Would this be covered?
I was just service connected under TERA for chronic rhinitis. I was stationed at Ford Island Hawaii. Pearl Harbor Naval Complex was very toxic. It was added to the EPA's National priorities clean-up list in 1991. Check it out.

I just had my C&P for a 2 Pact Act related conditions that occurred after I retired. Agent Orange exposure while on Guam. Type 2 Diabetes from 2011 and Prostate Cancer from 2017. In 2019 I had my Prostate removed though. Already at 40% post retirement claims. I'm curious how automatic these will be and what rating?
I just got denied for a claim I submitted back in September 2023 for degenerative arthritis in my whole body.

I got denied migraines and I listed I worked with JP-5 fuel. This is great news. Been sitting at 90 for 6 years and VA been denying all claims since
Air Force firefighter. We burnt thousands of gallons of JP-4 and JP-8. We used AFFF. In Saudi Arabia, we burnt everything the motorpool wanted to be disposed of to include tires.
This happened to me for 14 years. The C&P examiner would lie and say they last less then an hour. If they misrepresented you too file a “CUE claim”.
in 2006 I filed a sinusitis claim and was denied. I was in Kuwait and Iraq in 2003-04. My question is if I file a presumptive claim for sinusitis due to the PACT Act... will the VA back pay me from 2006??? I still have these problems.
Mannnnnn I was in Afghan 2009. Burned our own trash and made that great poop soup twice a day and that’s just the toxins WE made. Can’t even get a VA dr to diagnose me. Can’t smell right half the time, nasal discharge all the time and my damn face hurts from the blockage lol. Ridiculous
You dont need a VA doctor to diagnose you. It can be any doctor just make sure you express the severity to your doctor. Your nexus is the pact act itself and your dd214.
I'm with you, same thing for those of us who served in Honduras at Palmerola/Soto Cano Airbase in the 1980 - 2000 time frame. Big azz burn pits, and not even on the location list.
Try a private doctor or switch your primary care doctor at the VA José
My VA claim was denied in 2011 but now I’m preparing to file a supplemental claim, I’ve submitted the ITF.
My condition is now presumptive under Pact Act is it possible to awarded back pay from 2011? I thought the back pay deadline was Aug 2023. Please help me understand.

I filed a claim in 2012 for sinusitis and was denied then filed in 2022 I got it approved due to pact act but they only gave me 3 months of backpay and they stated that because I did not actively pursue the previous claim they did not give me the backpay
Go back and challenge the effective date as a CUE claim. In my case the C&p examiners misrepresented my answers.
I put a claim in a couple years ago for toxic mercury fillings that they kept putting in my teeth when I was in active duty! You think I could appeal this claim or resubmit this claim?
I drank plenty of jp5 jet fuel as I was deployed aboard the USS SARATOGA AND USS AMERICA FROM 1987 TO 1989. 👈🏿🤣😂😂😆😆😬. Let the VA come out with compensation for that.

how can i get help filing? i was in iraq and have photos of our burn pit i remember back then thinking it was wild we burned everything
I remember taking over an older Iraqi Air Base. The airbase DFP’s we assumed (took over), had diesel fuel heaters. No indoor ventilation (this was early Iraq part 2 invasion time period), and we justed used to bake in that shit for 12 hour shifts. 6 days per week . . . I just filed for the PACT Act, but honestly- I’m apprehensive AF.
does it make sense that i filed a toxic exposure claim under the pact act for the asthma that i developed from the burn pits and it was only given 10 % for it? it seems very odd to me since it is why i had to separate in the first place and there is not one single medical issue that impacts my life on a day to day basis more than the asthma. i'm not sure that it matters all that much, i'm 65% and am receiving the treatment that i need, but i really thought it was going to be much higher. has anyone else filed for asthma from the burn pits and would you be willing to share your experience?
If you have an inhaler that you need to use twice a day, file a supplement with evidence of prescribed inhaler twice a day, and your asthma should be bumped up to 30%.
I initially applied for Tinnitus in 1994 and was denied. Refiled last December and got awared 10% on the 10th of this month. Could or should I try for HLR to see if I can get it back dated to 94?
Tinitus rating has changed now. It is only granted if it part of another condition. If you reopen the claim I would be careful that they do not evaluate you under the new rules.
I got a 0% continuation for allergic rhinitis (previously rated as rhinorrhea with rhinitis) back in January of this year. I served in Kuwait and Iraq in 2018. I though I would've gotten rated more than 0% per the PACT Act. Do you recommend I appeal or something?
Yes. There is a one year appeal from the date of denial.
How does back pay work if a veteran's disability is a (tax free) carve out of the veteran's retirement pay, i.e. it is not new new dollars? Is the back pay still some type of tax credit or will it be actual net new money?

The VA denied my PACT claim for emphysema/COPD. X-rays show dark patches of “oligemia” suggestive of emphysema. My spirometry test showed breathing difficulties. The VA conceded that I have the presumptive location based exposure to toxins, clinical evidence showing emphysema, and I’m on a twice daily powder inhaler but my VA doc wrote “for asthma”. The VA denied my claim because I was missing the “clinical diagnosis” of emphysema written in my record. Should I talk to my doc about giving me a confirmed diagnosis of it, given the other conditions pointing to it? Any help is much appreciated
make sure you have a formal diagnosis...if it's asthma or COPD

Hello, I filed for rhinitis and sinusitis on September 2023. Got service connected for both received pay from when I filed but no pay when the PACT ACT came to law. Any thought why not?

During exam the dr scheduled me a X-ray to find sinus and rhinitis and found it so I had more evidence
@@maryanmiranda1946 yes through Va. made sure I had complaints of allergies in my VA medical file. During c&p exam mentioned my allergy medication using and then they scheduled me for X-rays for a later date and detected both. I had a great examiner in my case but I can’t say you will.

i served in djibouti in 2005. Says chronic toxin exposure on my post tour physical. I dont get a rating because i dont have a disability connected to that. I dont get it.
disability pay / rating is for a disablity.... you state you dont have a disability connected to that... thts why there is no rating or pay.. but if you were to get cancer or a condition due to exposure then you will have a rating and care / pay for that condition.
Curious…husband died (2/2024) from PSP (VA verified agent orange) in 2021 he was under civilian doctors until he filed in 2021. Is there a possibility of me putting in a claim before 2020? Other issue …VSO won’t submit my DIC claim because they say death certificate needs to be amended. Resubmitted certificate April 23 and told it may take up to 2-9months. In meantime time no money. Talked with VA clerk said he was “tagged “ and did not understand why they won’t submit the form. Thank you, M

Solved my own problem!! ……On Monday called my state assembly person and by Thursday death certificate was available !! Friday delivered certificate to VSO and supervisor completed claim form and submitted it!!
That’s what happens when I get frustrated! Later on, I’ll tackle getting payment for the years he suffered . I was and will continue to be his advocate….he wanted to die in 2032 but didn’t make it. M

Same here jet fuel for many years, I had to have half my thyroid removed from a nodule.
Jp8 exposure could get you paid? Leaky jerry cans from refilling generators, aircraft tugs, heaters, and being around jp8 for refueling vehicles and helicopters. Wild.
Are you saying if someone was denied in 2008 for an illness that is now on the pact act list they can get backpay from 2008 if they are approved now?

I wouldn’t try it personally, fails the risk assessment unless you are at risk of passing away due to a PACT act condition that isn’t yet service connected

You could certainly file, the chances of getting it approved will increase with more evidence that you’re able to provide them about the event
I was exposed to burn pits when I was deployed. I was also exposed to jet fuel on a daily basis. I don’t have any conditions that I know of. Am I able to file a claim?
You will only be compensated for medically diagnosed conditions
