Yuzu was used to play Tears of the Kingdom... but Microsoft Windows was used to run Yuzu to play those games. Clearly Microsoft is equally responsible for the damages.
AMD and Intel processors where used to run Windows so equally as responsible

No, it's much worse than that; they're suing because they claim *all* emulation is strictly illegal. Not just playing pirated copies. But they consider even ripping your own games and running them to be completely and utterly illegal. They said so in this very lawsuit.
What makes it better is that you can still use official hardware with pirated copies, and most of it lies with the fact that they ignorantly shipped the switch with a powerful vulnerability that could have been caught and fixed fairly quickly.
@@Aurora12488they include that but they are using for the specific case the fact that the devs on discord talked about people using it to play a video game before it was released and gave assistance to those people. So while some aspects of their legal theory are unsound the yuzu devs made a dumb choice and may have to pay for it.
@u1vv Well Nintendo is a Japanese country, a country with super strict copyright and IP laws and has zero fair use. Something such as playing one of their games on something that isn't their platform, is viewed as violating their copyright.
Do I agree with this logic? No I don't. But the thought process doesn't come from nowhere. Like I watched a video a while back that theorized that Nintendo is even more protective of their IPs because they witnessed first hand a large company losing exclusive rights to an IP when Universal sued them saying Donkey Kong was infringing on King Kong and lost.

Funny enough that Yuzu refused to add compatibility for Tears of the Kingdom until the official release date.
To maintain their "legalese" standpoint...the fact is that 95% of switch emulators are pirates. The only way to legally emulate is to own a switch that is modified, own the game, then dump your own keys and your own game....95% of people using yuzu do not own a switch, modified or stock, they don't own the games either, they use keys and roms they don't own......I hate large corporations for many reasons, but the fact is that if these pirates ran nintendo, they would do the same.

@@blvckl0tcs750 I've heard that a lot of dumps come from pirates who work at a video game stores, who receive games prior to launch date, then swipe one copy and dump it......The TOTK leak was an "xci", meaning cartridge dump.....not "nsp" which comes from the eshop.
Physical games cannot magically appear on store shelves all around the world on launch day, they have to start shipping them weeks prior.
If the "nsp" leaked, then nintendo would be to blame since they run the eshop digital storefront.
You said "it doesn't matter".....Yes it does, devs are considering using more drm like denuvo more on the current and upcoming switch games and non-switch games, digital only releases, more online only live service games like genshin impact..........because of rampant piracy.

@@blvckl0tcs750 As a former retail worker, I can tell you stores usually get copies of games a week b4 the official release date and only sell them on the release date. Review copies may go out even earlier. So, a retail worker or reviewer probably dumped it. Most of the early dumps have been from physical copies.

It's like suing a DVD player manufacturer for users watching bootleg DVDs on it. This entire question was already settled and legal precedent established in Sony Computer Entertainment, Inc. v. Connectix Corp. where Sony tried to sue them for developing the Virtual Game Station emulator. Sony lost.

As someone who owns Five switches in his household and every Zelda ever released I can confirm Yuzu is the best way to experience Zelda on the switch
On the "strength" of my playing experience for other Switch games, I held off on buying _Pokémon Legends Arceus_ (which I *did,* for the record, buy) until it was playable on the Steam Deck.

Yuzu was not the primary emulator used during the totk leak, did not work well until a week after official release. Everyone used ryujinx for the early pirated copy and switch only to yuzu after it ran better 2-3 weeks after launch

@@momob4276 I said this because in Nintendo's lawsuit, they claimed yuzu was the primary emulator used for the leaked totk copy prior to official release, when it was not.
Yuzu is the better emulator, but totk wasn't playable until after official release. Nintendo has made a false claim because they want yuzu to be 100% responsible for pirated totk since ryujinx can't foot the bill if sued.
For anyone looking for a potential alternative to Yuzu, Ryujinx is also a great Switch emulator with mod support! I own Smash Ultimate but use Ryujinx to play a modified version of Ultimate called HewDraw Remix since I don't have a modded Switch.

Yuzu couldn't even launch the game on the public release until post launch, the beta build could launch it, but it'd be like playing a corrupted rip of a bootleg ps1 game. Hell, the depths would crash to desktop until a week or two after release. All this on top of the lawsuit Sony lost in the 90s that established that even though emulators could be used for piracy they are legal, as there are perfectly legal avenues legitimate owners could take to run their legally owned games on emulators

The benefits of using machine learning to untangle data sets and tasks where programming an algorithm from scratch would take forever are probably going to always outweigh the costs of having all this AI enabled useless nonsense everywhere, so my guess is, in a couple of years we'll see more mature and productive uses of these technologies rather than a crash. I use Yuzu. But here's how I do it.
I have a Gen1 Switch that exploits it's recovery mode. Recent laws state that I, as the owner of MY purchased device, can do with it as I please for my own personal enjoyment. This is why warranty stickers can no longer be used for "tamper-proofing".
So, I BUY the game (i.e. Zelda) I back it up on my switch to an SD card. Then in turn, transfer it to my PC.
Using my switch's product key files and various other files, I back those up into the necessary Yuzu folder directories.
My game.
My Switch.
My Personal Experience.
All perfectly legal.
You are not creating a backup you are creating an illegal copy what is piracy and you are not allowed to play those games on anything but the Nintendo Switch.
My country rarely gives a fuck about people who pirate, they only shut down distributing websites. So imma pirate the shit out of Nintendo's games. I will keep them on my hard drive but most likely will never even play them
i wish we all could have a 1st gen switch but yes at the very least i buy the game from that point on i am morally at least in the clear for myself to emulate

We see more and more companies suing open source developpers of software not in their interest just to put pressure on them in hope they give up in front of the daunting legal task that awaits them. Individual legal protection that wasn't so great to start with continues to dwindle year after year unfortunately...
Not a lawyer, but I'm hoping they get a lawyer who takes the case on contingency, banking on the case getting thrown out pre-discovery. Rhode Island has an anti-SLAPP statute, and while I'm not sure this qualifies, if it does, then Nintendo is on the hook for all of Tropic Haze's legal fees.

How does Nintendo even knows how many illegal copies were downloaded if it's allegedly pirated and usually not distributed by Yuzu's developers anyway. Moreover, in order to make Yuzu work you need Decryption Keys & Firmware files that they did explain how to obtain from your own Nintendo switch meaning in essence you are able to use your own purchased hardware files (including games) to play them on the emulator.
THIS, THIS, THIS! People keep throwing around the number, yet so few (if anyone) is questioning "HOW DO YOU KNOW how many people downloaded the game?" It seems like it'd be impossible to track if you include all the places to download it, it smells too much like bullshit (the same kind of bullshit the RIAA and MPAA tried with movie and music piracy numbers in the 2000s).

Yuzu is neither used to circumvent copyrighted material nor to download or copy it. I don't really see how they have a case. when someone plays a pirated movie, they can pretty much use any media app they want, since they all can read mp4s. Similar to that, there are a bunch of emulators on the market that already can play switch games, regardless of homebrew, legal copy or pirated copy. even if the usecase was primarily illegal, I don't see how that allows them to ban them.

Guys the intel charts and timeline is not representative of market release date. It’s when their fab will be able to produce first silicon. So if you watched the intel tour videos you would know that it takes a good 3-4 years to go from first samples to consumer production. Usually they are validating designs on the current node for 2 or more generations ahead and then shrinking node size as the fabs come online, going from 10 to 1nm will definitely throw some curve balls their way. Either way you have to add 3-4 years to those timelines for actual consumer in hand products. Maybe half that for companies like Amazon, Microsoft, Google, FB to start field testing enterprise level chips built on that node/architecture.

Nintendo shouldn't have any case on this. Because emulators are a legal gray area. It doesn't uses anything made by Nintendo. You're supposed to use your own Switch to export the keys needed for it (well, pirates don't do that... but it's still the official way to do things on Yuzu)
