  • Hello guys and gals, it's me Mutahar again! This time we take a look at a situation where 20 years worth of modding is at risk if it's anywhere near Nintendo related due to a new campaign by the legal team at Nintendo of America. Garry's Mod is a gaming icon and the modding community runs deep in relation to it and currently a mass takedown of mods are occuring if they feature any Nintendo made asset. Thanks for watching!

I think the laws and the legal system itself need to be reformed. A lot of the Gary's Mod Mario content that's user-created/(not asset rips) and doesn't imitate real Nintendo games feels like "fair use" under DMCA to me - clearly parodies (especially when use for videos like machinima). There is no copyright infringement if the content was created by the modder (not ripped assets) and they aren't profiting from it. I think a slight loophole behind the 3 year statute of limitations is how are updates handled? Is it 3 years from version 1.0 release or does each update reset the clock? Then things like updates to maintain compatibility with the latest versions of Garry’s mod just resets the clock. When the DMCA was being created you didn’t have constantly updated works, if a work was updated it was the “directors cut” or “game of the year edition” and was generally classified as a separate work.
This was likely a mutual agreement between both sides legal teams to save dealing with all the paperwork associated with thousands of dmca requests and the statute of limitations wasn’t considered.
