  • Hello guys and gals, it's me Mutahar again! This time we take a look at how a CZcams game development project may be the victim of asset stealing by another independent games company. With quite alarming evidence and threats of lawsuits being thrown around, this kind of behaviour should be called out. Thanks for watching!

      @@devarient - Counter-claims are actually filed at the beginning of the lawsuit process. The plaintiff serves you with a lawsuit, and then your response to the lawsuit needs to include any counter-claims you'd like to raise - including for abuse of process. After that both claims and counter-claims move forward, until dismissal or settlement of the claims in question - though settlements usually (but not always) resolve all claims at the same time, while dismissals are more common for a subset of claims.

    Those asset flip "develpors" use the same tactics as car thieves: "Steal it, paint it in a differnt color and voila not stolen anymore."

    As someone in the professional 3D-Modeling community, Re-UV unwrapping an asset, decimating polygons or removing edges so that the poly count is lower / different, and slapping that bitch in Substance painter to change the texture is not a valid counter argument to what's being claimed at all. It's theft pure and simple with some surface level editing. It's incredibly blatant.

      Exactly! Modifying the amount of vertex (decimate) and re-aligning of UV mapping is a piece of cake.

      @@ThePopo543 90% of modeller work is that "tracing and recolor" , its sad but true, if you are not a artist that R&D, sketch, and then model you are never 100% owner of "your model"!!!.
      Simple example from my portfolio: I model Ghost from Destiny for 3D printing yes according to LAW model is my but I CANT FULLY SELL IT because it represent other 'ppl' property I can and I mean like up to 5-10$ sell it as "Fan art" for cosplay community.
      If someone "tracing and recolor" my model He do exactly what i did only difference I did that from picture and He did that on my model.
      Now days 3d modelers do retopology on megascans so who is the owner if i do a scan of someone else sculpture??

    I was there during the beginning of harshdoorstops development. Bluedrake is genuinely incredibly passionate about his game and it sucks to see scumbags try to profit off of something he intended to be used for free.

      bluedrake is also a really cool dude who genuinely likes to interact with fans. I remember a few years ago when he was a much smaller youtuber he would actually post his real cell phone number in the description of videos literally just so his fans could text him. fucked up to see something like this happening to em

      @@SerotoninCrunch I actually remember playing on some of his servers on Project Reality and meeting the dude in--game wayyy back then. He seems to be a passionate person as mentioned, and cares a lot about the community.
      I wish him good luck and hope this mess of an issue can be resolved on Bluedrake's favor.

    Similar story happened to Jim Sterling with Digital Homicide back in 2014-2016 when he reviewed an asset flip game called the slaughtering grounds and digital homicide tried to sue Jim for $10 million dollars and failed badly. They also tried to copyright strike his channel too. He has the full video on the whole thing.

      ​@TomJacobW I hate having to agree with this because it feels rude or disrespectful, but I genuinely feel like his content really changed after the whole transition.
      While I wholly believe we should all attempt to be kind and understanding to any friends or family members that go through a gender transition.
      With that being said. Jim Sterling was just a CZcams channel that provided content that I enjoyed in the past. Once the type of content started to change I unsubscribed. I can't express enough that I didn't unsubscribe because of the gender transition, but because the content that was made was no longer entertaining to me.

    I'd like to point out that Asset Flipping should not be compared to Kit Bashing. Asset Flipping is taking already made maps, systems and already made projects, making a rough "game" out of it, and selling it. Kit Bashing on the other hand is buying small pieces of what are essentially building blocks, meaning you still need to build the maps, you still need to assemble the game, and you still need to stitch it all together. Nobody hates that assets are being used, we just hate seeing full games made of stuff other people made.

    They also put a PEGI 18 logo on the game site, but on the PEGI database there aren't any info about the game being rated or the developer being registered. This would violate the PEGI terms of use, so I wrote PEGI to ask if they're aware of the situation. I'd bet that in a few days they'll have to face serious legal consequences by the European rating authority. Prepare your popcorn.

    There's nothing wrong with making a game from bought assets exclusively - you might be a lone developer with no artistic skill but might still have some really fun gameplay concepts. It becomes an asset flip when it's abundantly clear how lazy the effort was.
    Edit: EULA or not - copyright law is copyright law and Italy participates in copyright treaties.

      Purchased assets are insanely useful for prototyping! Using them as placeholders until you can get an idea of how the real things should look and feel is a huge time-saver when conceptualizing a game.

    i've worked in indie game dev since about 2016 and was really lucky to make a career out of it with my boss and co workers. There isn't a chance in heck they would sue you if they can't hire on people to make assets for them. We started off as a 5 man team and it was pretty darn expensive just for art, models and music, we save money with programming as that's my bosses role but to do this seriously? I'd bet my entire career they'll never follow through with a legal threat when they can't afford even hiring someone on a salary to do the most basic tasks in gamedev.

    Man, I hope it goes well for Blue Drake. I supported the game with the highest tier purchase I could reasonably afford just because I was fond of their mission statement. To be honest I don't quite enjoy the game all that much, but I'm glad it exists, and I seriously hope this doesn't cause issues for the project as a whole.

    10:05 Bit of a legal fun fact, it doesn't actually matter if you sign a contract or not. Simply acting out the terms is the exact same thing. So even if you never sign the EULA, you're still agreeing to it by default for even turning the game on.

    Artists who made the assets should leave a hidden mark within them, and then they just needed to find those marks in the stolen assets

    I work on a investigation team, that takes case worldwide due to who my employer is.
    I can guarantee, its complete BS that they can not provide proof of purchase because Italian law, as many italian seller have to provide me/us with invoices for many things.

    Last time I heard of a game dev suing a CZcamsr for calling our their asset-flipping bullshit, they filed a lawsuit for $15 million against them and failed miserably.

    Glad you covered this, Muta. I saw Bluedrake's video on it and as a developer myself it pisses me off. It's very apparent they stole OHD assets and just put a new texture on them or did very minor updates.
    Gotta hit these scumbags in the wallet (lawsuit). That'll get them to pick the feces out of their ears and heads. I dunno how a lawsuit will go against a team in Italy though.

    Italian law prevents unauthorized "strangers" from viewing purchase history etc. Strangers is classified as anyone but the card holder name who has purchased things, and unauthorized is classified as someone who does not have explicit permission from the card owner to view this information. So the person they are talking to might be someone other than the person who allegedly bought assets but to me it sounded like they blamed the GOVERNMENT for not being able to clear the waters.

    I've given up with modern games, mostly. I've been enjoying going back and playing some of the best games from the 2010s as they're cheap, work with few bugs, and don't cram purchases down my throat.

      i can understand it to a degree; i have supported a couple of early access games if i feel strongly about them, but so many early access are just 'throw out a broken demo and collect the money whilst never updating/releasing the game'

    The extra hvacs and lockers would be separate assets. Textures are also separate assets. So they are just straight up ripping off at the very least the complete 3D model assets.

    The crazy thing is I'm a begginer/intermediate 3d modeller and I would totally make original game assets for a project like this 100% if I could find an employer😂 Honestly I'm not learning modelling for gamedev but now I'm going to search around

      same... i thought about contacting the blue guy and offering a few assets to begin the portfolio that could be a showcase of my ability... start there. if you're modelling and have already made a bunch of assets, offer them out for free with the caveat that you're name is included for contributing, then you can reference these games.
      don't do what i did and spend 6 months making a fucking school with insane details, for the dev to ignore you when the project is done. rigorous contact and daily reminders/conversations with them. become friendsly and make sure you're focusing conversations on the task and related subjects to that task.
      since you say you're an amateur, i'd like to remind you exporting is crucial for the dev to know before you start guessing which one is needed. it's a long road and coordination is paramount.
      good luck. but don't expect to "get noticed" and instead, make yourself noticable. and never be ashamed to make your own assets with guides either online or literally crafting it yourself from references (guide like tracing paper). what the big problem is, stolen assets are obvious.
      also also... old assets are always useful. try to keep all your completed/integratable modelling files for even easier exports and maybe reusing your own crafts to make something new.

      bluedrake is pretty professional when it comes to modeling work, u should try and contact him, probably both of you can benefit out of it and you would help build up a great game

    Funny thing is that the guy who stole the assets says "The UVMap doesn't work and physics are badly reconstructed" UVMaps or UV Coordinates are or can be easily modified and scaled differently to make it look different. The part where "physics are badly reconstructed" sounds like an AI response or someone used a google translate (Italian maybe). I know these things with 3D texture materials and assets because i have been doing 3D models using Blender.

    I saw the Bluedrake video a few days ago, it's a pretty shitty situation and I hope they absolutely destroy that studio and take every penny they earned on that shovelware.
    I generally don't have a problem with market place assets, I've seen plenty of good games utilising the Synty Studios assets for example, and I find them super handy as someone that's trying to learn the programming side of things, and don't want to stare at capsules all day.
    But I couldn't imagine just straight up ripping someone else's models/textures, and even if accidentally, the absolute audacity to have any push back whatsoever when it's brought to your attention is beyond insane.
    Frankly I think it's too late for them, they didn't just dig their grave with this situation, they expedited the process with a god damn nuclear bomb.

    I made this suggestion years ago, if your games contain and make uses of assets that you purchased, state it in credits sections, what was purchased and from whom.

      As a person who aspires to create a mobile game, I think the same way too.
      I believe purchasing legally-usable Unreal assets and then using it inside our game is permitted (as stated on the Unreal Store), but just to be safe, share details about every asset purchased in the credits section so the creators get their deserved attention too.
      Correct me if I'm wrong, but do people not do this because of professional ego (game developer/ studio not wanting to admit it) or publishers trying to maintain their brand (for developers releasing games under a publisher)?

    making a game takes so much hard work, an indie game Dev will be working on Blender, adobe AI, Photoshop, visual studio, the game engine... all at the same time.

      And this is why proper assets are so useful. Between Ai-generated code and art on the asset store, a single man can build an entire game without having to spend a decade on it like the guys behind Kenshi or Project Zomboid

      Maybe if you're an artist. Most of us are just gonna spend a few hundred dollars on quality asset packs. It's all about saving time when you're starting out, else you're overwhelmed with learning everything at once@@odhorizon

    These situations can be very tricky. First of all, individual intellectual property can at times be hard to prove to be stolen in a lawsuit if there isn't something unique about or if it can otherwise be traced that someone acquired an entity illegally. Secondly, assetflipping and assset theft are so rampant that it can be difficult to even tell, you'd be surprised how much identical-looking content you can find online (especially if it comes to houses with a type of architercture of a specific region).
    At the end of the day company A has to prove something was stolen by company B and while at times it looks obvious, proving it in court is the real challenge.

    If you steal a car, then repaint it, that doesn't make it yours. You're still a car thief. If these people really did steal assets, and then change them superficially, and it can be proven, then they are in a 12 piece bucket of trouble. I know it's an assumption here but it seems like they are trying to bluster their way out of being sued with counter threats and what not.

    I've been playing around with Unity and keeping up to date with the game dev industry since around 2012 as a hobby on the side and this whole asset flip thing only blew up in the last couple of years in my opinion, now people understand better what it really is. The scary part is that they don't even buy these assets from the marketplace most of the time, it's so easy to get them for free on websites that host all the marketplace assets and even keep them up to date. My latest gripe is with the countless backrooms game developers which utilize a literal premade backrooms template with gameplay functions from the marketplace, just making a few map changes and then go out on social media and say they made it all themselves and pride themselves as indie devs. Game dev is hard, but so appealing for so many people so they do whatever they can to cobble something together with no experience. It's a complex topic.

    I'm making a game by myself. I have read the legal text for assets that are made available on the Unreal Marketplace...from what evidence you have presented it seems that this "Operation Harsh Doorstep" developer put their whole game up on the 'Unreal Marketplace' as a "mod kit"(though this is impossible to verify as it has been removed more on this later...). Unfortunately it seems like this is their own fault for not understanding the legal licensing that comes with putting your assets in that storefront("Unreal Marketplace"). Personally I have no interest in trying to take somebody else's game wholesale and sell it myself(and seemingly that may be what this Venatur did, which is a scumbag thing to do), however legally speaking it definitely seems like that "OHD" team possibly did not understand the licensing rights that come with putting seemingly their entire game available on the Marketplace for other developers to LEGALLY download and use.
    The "OHD mod kit" link that was put in the email is now a 404, which leads me to believe that the OHD team removed that asset from the marketplace after realizing that having it there was not what they wanted(too late)...now if the original OHD team did not put it on the Marketplace themselves then this is a different story as there is a middleman somewhere in here that has stolen the game and/or assets and passed them off as their own. In this case I believe it is up to EPIC the billion dollar company to police their marketplace because it is impossible as a developer to verify the source of all of the assets inside the marketplace.
    Personally with my game, I simply do not have the resources(aka time) to build all of the 3D assets/music/sound/animations/etc. that my game needs. Purchasing items or downloading FREE items on the Unreal store IS NOT STEALING, and has significant benefits for developers as well as the content creators:
    1. Pays artists for their work at a rate that THEY have determined is fair, and this supports those independent creators
    2. Allows developers access to the assets that they need to make their games(or movies or advertising...Unreal is used for a bunch of stuff now)
    3. Allows indie developers to not be constrained by Publisher demands because developers do not need to hire a person, which costs significantly more money and would require Publisher money to complete a lot of these games.

    This video qualifies as REPORTING under the US DMCA Act. Thus, Fair USE Applies therein, according to the relevant exception in the US Jurisdiction. This is quality reporting which infact highlights something far darker and far deeper in the video game development industry and that is.... Intellectual ASSET PLAGIARISM or as us brits call it, 'passing off' someones work as your own.

    What if the whole situation was a collective collaboration to acquire insurance policies and simulate an asset theft situation in order to create a legal justification to receive financial relief from insurance bodies in addition to consumer expenditures?
    I’m not saying this is what happened, but this kind of stuff in this time period should definitely be mildly acknowledged just in case

    In Germany this would obviously violate several laws; and I cannot imagine that Italy, which is a proper part of the European Union, which means it is subject to the EU's legislative, would have a different jurisdiction.

    THe most benfit of the doubt I can give is,
    - either the 'original' is also using store assets (unlikely due to the refusal of purchase showing)
    - the artist stole it without the creator knowing
    -they used a lot of the game as reference and closely resembled it (which would justify the bad geometry comparatively if true)
    or yk, just a lil scandal which seems likely

It doesnt matter if it's the same make, model and licence plate, it's a different color, so it's a different car !"

    Assets that can not be modified to something unique should be used for prototyping in my opinion (for commercial games), if you own them ofc. Christ, you get monthly free assets from epic, why steal anything? Worst case scenario, keep and modify the prototyping models until you get some money or time to make your own.

    This alone has been one of the biggest reasons why I have not yet bothered to see a game project 100% the way through. Eventually I run into the assets problem, both in acquiring/creating them and maintaining them as my own without some punk trying to steal them.
    Granted, I'm not doing anything with Epic or Unity or any engines like those, so I don't have to deal with a lot of that possible BS going on with these devs. But I was playing around with stuff like Rpgmaker at one point, and it's definitely rife with asset flipping and straight up theft. And that even with the free assets the devs provide for their engine...
    But no matter. Rpgmaker just isn't good enough for what I want to make. So I've moved on to looking around again. Might try out Godot. Or Game maker. Or Enigma, an open source variant of Game maker.

    oh the asset flip game... steam greenlight back in the day was the wild west. jim Sterling covered that era of steam pretty well.
    digital homicide was a developer that was notable for asset flips.. and particularly nasty with the litigation

    Theres been recurring problems with asset packs on the unreal marketplace having stolen assets. Stolen from corporations that have the money to go after devs for using them. Of course the people who stole the assets in the first place get away scott free. Its all a mess

      @@Likely_Alucard yeah definitely make sure you dont accidentally release anything with stolen stuff. there’s especially been a recurring problem with those assets cropping up in the free-for-the-month. pretty sure i have some packs myself with stolen assets because of that. You can find out more if you look it up, theres a pretty long thread on the forums about it. of course epic is hardly doing anything about it.

    I have way too many tasks to do for my own game I'm creating, but asset-flipping sounds like a horrible idea... anything that's "Non-Commercial Use" is already at a risk, people are crazy about their small shit sometimes, even a font online... there's so many cool fonts out there, but you best not put any font in your game becauuuuse "not for commercial use" even if it's absolutely free feels like a trap for this kind of thing.. someone can correct me if i'm wrong but that just seems obvious to me, being sued hundreds or thousands for a fkin Font is probably possible, or just any asset that wasn't purchased or ... have/had a license.... a lot of things aren't clear how long your license is... so i think it's safe to say just use those for as long as you want if you bought em but... this is totally different xd
    ripping all the 3D models/textures from another game... I don't even wanna use all the free asset shit in Unreal Engine most of the time cause so many people are using it... having something a little unique is better but this dev didn't care about some of the walls / gas pumps for their game I guess to give that detail not many people would bat to care/see understandably so... but this is how awful the risks are, though despite all that, I don't see what "Damages" have been done by booting up a knock-off game tbh... are we gonna just defend Nintendo for being like this same dev now? Mario in fan-made mini games is technically an asset flip.. but this is indie shit, idk lol, just saying thousands might be a bit much but idk what revenue these are.

    "Asset Flip" does not mean low-quality game, nor does it necessarily mean a game with a bunch of store-bought assets. Other videos have been done on what an 'asset flip' actually is.

    Out of all models, environment models are easiest to make/buy as there are billions of them available on various different stores, I could understand stealing a character or a model or weapon/vehicle model, but a structure? Omfg it’s crazy

    going on about what you said at around 15:00, even if the people did the ship of theseus on the assets and changed just enough to legally shield themselves, it still doesn't make it better because now the two games are uncannily similar to one another. the same layouts, the same buildings minus a windows here or one more door or file cabinet there, it's basically the same thing with a different coat of paint. now imagine if i did the same thing with the recent COD games where I took the assets from warzone and made little changes to drive home the point, they would bleed me dry in the legal department even if they have no merits. after asset flipping, you step into the plagium territory where you game is obviously TOO based off of OHD to even DENY the accusations

    As much as i hate to say it, there is enough changes in it that it will be hard for anyone to sue for any sort of theft aspects.
    The major thing would be the gas pump decals (with the fade out via 'wear' on the vertical holes/gaps roughly in the middle coming across on their version compared to the initial).
    Otherwise it's modified enough that can can argue that they have built their own models as they are standard objects in common life.
    It would be completely different if it was hyper detailed models, but buildings be buildings y'all, as much as it sucks.

    Bad games and assets on steam reminded me that I recently learned of a game on steam so bad that people were only buying it because it actually makes other games cheaper. It's a square enix game called "Various Daylife". A lot of people seriously hate this game but buy it because it makes other games cheaper. An example being that if you bought this game in a bundle with octopath traveler 2 you would get both games 30 percent off. Do with this information what you will if this is still an active thing.

    Tbf, asset flips are fine as long as they’re good games with quality features. Some developers are programmers so they don’t have the skills to create assets. (Trust me I tried making a character and by the end of a week of work I had the throw it out because it didn’t look the way I wanted and the mesh topology was all over the place).

    Asset flipping has been a widespread problem for years in the indie scene, and it's not just on Steam anymore. I'm amazed how few people even talk about it these days.

      we got bored of it after 3 years of flooding steam with hundreds of thousands of asset flips. a lot of them were duplicated games with slight alterations... we just got bored. kind of how you and i both know there is a starving, dying child somewhere very close to me and you respectively, but we don't care because it's so broad and so numerous, there's no fighting it. just pointing fingers is all we can do now.
      also, the generation that loved and grew old with games before the internet and during its infancy, we were adamant that we should and could "police" our respective fanatical affiliations. the last great gamer outrage that was noticed by this generation, was MGSV. then that got an asset flip and turned into an ancient old timey zombie game from the mid naughties. that was the last time we cared.
      give it about 4 years and the next wave of passionate naive gamers will appear and you can care as much as they do. right now, we're just bored of noticing it and we don't even seek out games anymore. we got old, we got families and jobs and responsibilities making it less likely to be invested in games. this is why "we" rarely get a thrill or an excited childlike wonder to a new game.
      it's just a sign of the times. the flips aren't as abundant but they are still pervasive. especially the weird porno games that never leave the "new games" pages. maybe you could be SOG for the next wave/generation of passionate gamers. but as for why we don't talk about it... boredom and desensitisation.

    It sucks if those assets are indeed stolen. It's also possible that someone ripped the assets from a game, then uploaded them on a marketplace like Unity Asset Store, or Unreal Marketplace and an unsuspecting developer bought it - tho I didn't hear that in this argument - I just know it happens. I'm a programmer and as a hobby I've worked on my own games from time to time, and over the last 10 years I've probably spent over $10k on art assets bc I can't create models or textures worth a crap. I haven't released anything, and probably never will because it's just a hobby. I just hope when I see videos like these that the proper research has been done by the channels and that both developers aren't using the same asset pack purchased from somewhere ( though, sounds like tho the original project had 100% custom assets), or that the second dev didn't buy a pack that had stolen assets in it (which he should try to show thru receipts / links - if the asset pack hasn't vanished from the marketplace without any trace).
