      Legally this is only partially true. Courts have firmly established that it's acceptable for cops to lie about just about anything. But they have also firmly established that it's not acceptable for them to lie about the law. They can lie all day long about what they saw you do or tell you they have all kinds of evidence against you they don't actually have. But they cannot lie about what a law actually is or claim that you're required to do something or provide something as a matter of law in an attempt to trick you into complying with unlawful demands.
      In practice of course they lie about the law all the time and generally get away with it. Because most people don't know the laws in the first place and just go along with whatever a cop tells them they need to do. And even in the cases where people actually know the laws and know their rights are being violated very few have the means to pursue a lawsuit that would actually hold them accountable.

    The fact they are so easily willing to say "sue me" just shows the mentality that Qualified Immunity has given these tyrants.. "sue me... what do I care, I'll never accept wrong doing. You and the rest of tax payers will pick up the bill." Qualified Immunity should be abolished and every badge should carry liability insurance.

      And they don’t care a shred that it costs about $5,000 PER CHARGE for a decent lawyer to defend you, at minimum. So basically they can pin you with a false charge and just for the pleasure it’ll cost you $5k+ just to prove you didn’t do anything wrong. And if you’re lucky you won’t end up pinned with a charge that’ll permanently screw up your life. But they’ll do all they can to make sure you’re not lucky and SOMETHING sticks. That’s why they’ll charge you with every infraction they can possibly find.

    To give an update. I just finished the IA complaint process, and it ended like we thought it would. Nothing done. I pulled all records related to this and it turns out...me wanting to pull to a safe location and me wanting to keep the cop out of my truck convinced him I had drugs and that is what he was after. I just did not give him any RAS or PC to get in... and that pissed him off. The department never corrected him on the law, in which he had all the info on my DL. He even stated in his interview that he wanted a local address to satisfy his policy and what he wanted. Then I had the police chief call the base and try to get me in trouble this video and mess with my career. Thankfully, my leadership saw through what was going on.

      Believe it or not, just remaining silent without invoking the fifth amendment has been ruled by the courts to be deemed suspicious enough for detention. You must invoke the right to remain silent to be protected by the fifth. Screwed up, huh?

      It may not be illegal to remain silent, however, staying quiet is not an assertion of rights. The best way to not speak in a way that cannot be misinterpreted is to state I would like a lawyer present prior to any questions, period. Or… state “I invoke my right to remain silent” and then shut up; otherwise, it may be misconstrued and not applicable. The courts do not recognize straight silence as an assertion of rights, nor speaking after you invoke your rights. Just be quiet.

Then maybe they will be inclined towards ending QUALIFIED IMMUNITY. Look at what has happened where it has ended. Bad Officers May quit and move to other jurisdictions and I say good riddance.     The officer is legally allowed to ask almost anything. He can ask for your sandwich and he can ask you to wash his car. He cannot legally order that you comply with those requests.

    That is Fairborn, Ohio, near Dayton and the home of Wright Patterson Air Force Base and the National Museum of The United States Air Force. They are WELL aware that military do not need to have DL with current addresses due to being moved around a lot! EVERY cop near a US military base is WELL aware of that fact!

    Bonus fact: When in the military, your state license can be expire and still valid. Each state is a little different, but they all say your license is good for as long as you're in the military without having to renew said license.

Are you actually saying that as long as I have an active duty CAC, I don't ever have to renew my driver's license? If so, that is incorrect. I lived in state A, my driver's license was from state B, and my car tags were from state C; and yes, if you are on active duty, this is legal in all states. Some states will allow having a driver's license without a photo; so if you have a DL from state A, then state A may allow you to mail in your DL and they will mail you your new DL without a photo on it.

      You receive your "official" state of residence when you enlist. That never changes except when you reenlist and that's up to you to change. Thus no matter where you live after that, you can' have a license in one state, live in another state. You can't have a vehicle registered in a third state, unless you've established residence there.

      That is not correct, you cannot go your entire career without renewing your DLs. Each state has its own requirements on how and when to renew active duty members' DLs. And yes, you can have a tag in one state, a DL in another state, and a residence in another state, or at least prior to 2016 when I retired after 28 years.

      @@james3588 According to the laws in my state (IN) you can go your whole enlistment without ever having to renew your license. Most states are that way, but i will admit there may be a state or two with different rules. The variation is how long you have to get a new license once you end your military service.
      Then there's the idea if you drive anything military while you're in, you have to get a military driver's license, which notes what vehicles you're qualified to drive.
      Btw, while i didn't serve 28 years in the military, i did serve as a personnel admin specialist (75B) at company and battalion level. And the only way you can tag in one state, license in another and reside in a third would be on a temporary basis, dependent on state law, until you can get them all under one state. But that would be a pretty rare circumstance.

    A law enforcement officer not knowing the basics of basic law involved in his day-to-day routine such as traffic stops is equal to a Master Carpenter not knowing the dimensions of standard materials. You cannot possibly do your job efficiently or accurately without that knowledge.

    I was wondering why he was asking for an address if he already had they guy's license. I had a cop try to pull that with me once. The cop was asking if the address on my license was correct. I said I wasn't answering questions. The cop then threatened me with failure to ID if I didn't verify that the address on my license was correct. I said, "You're holding my license in your hand. It has an address on it. In order for this to be failure to ID at this point you would have to have probable cause to believe that address is incorrect, and I have every right to not answer any question you ask. Your move." The cop didn't press it anymore.

      He asked for his address because... I know that here in Oklahoma, you MUST keep your address current on your driver's license. You only have 10 days, by law, to change your address on your driver's license once you move from that address on your license. I'm not sure what the law is on that in Ohio, but it is the law here in Oklahoma. It is an offense you can be cited for if your address on your driver's license is not your current address. Never tell the cops it isn't, and if you have to, tell you just moved a few days ago. Just make sure you don't tell them it's been more than 10 days that you moved.

      And have a direct link to it in all cars, publicly announced that it is required to be in there, so they can't lie about not having access. They would not have a valid ras without a working and often used tablet, would have a key logger with a publicly available password. Any detained person can check the current laws against what the leo is accusing/detaining them for on site, No more qualified immunity without meeting very strict requirements.

    if you ever doubted whether a law enforcement agent was a profession, this is a perfect example of why it is NOT a profession. the superior court has ruled that law enforcement is NOT a profession because it does NOT meet the definition. a profession is described as a vocation or occupation that requires advanced education and training and intellectual skills which definitely leaves law enforcement out of the definition. this decision was based on a lawsuit for membership in a clemency board which they loaded with police so no one could be granted clemency. state law defines a clemency board member to be a cross-section of professions of local residents to be a member and since only police were placed on the board, it would not act in the manner in which the board was designed to be manned and function.

    I live in the Dayton Ohio area. I am very familiar with Fairborn and all of the surrounding areas. The Air Force base is here and I’m guessing this gentleman was here for something related to his duties there. The reason they want him to roll his windows down more is obvious. I have been pulled over a few times in the area and never once been asked to roll my window down more than halfway. It’s sad that this man is nobly serving our country and is treated this way by uneducated law enforcement in Ohio. Kudos to him for knowing his rights and knowing the law better than these tyrants.

    Sid, here in Ohio when they ask you your address and they have your ID in hand that means they are checking to make sure you have kept up your info on your license. In Ohio, when you change addresses you have like 10 or 30 days to inform the Bureau of Motor Vehicles. So, they are looking to see if they can add another charge..

      That would be part of the investigation to which the individual has no lawful obligation to assist. And what do you say to an engineer or architect who is temporarily on assignment in a location that exceeds 10 or 30 days. Are they under some obligation to change their state of residency to satisfy the job? Or in this case an individual in the military. Doesn't make a lot of sense.

      That Ohio law doesn't apply if you are in the military. He doesn't have to get an Ohio driver's license or report to them that he isn't living in Florida. When you are in the military you are considered to be domiciled in the state where you enlisted not in the state where you are stationed and currently living.

    I say this all the time, when someone becomes a law enforcement officer, they must have at least one or two years of a law degree to become a cop, that way there is no misunderstanding of the law, because most of the cops I see don't know anything about the law

    The officer's claim that the citizen had to role his window down all the way so the could fully view inside the car is de facto stating that the citizen must submit to an unauthorized search.

    If the state has a violation on the books for having an out of date address, then the officer asking if it's a current address is a violation of the 5th. Threatening the man with arrest if he doesn't verbally answer a question that could potentially implicate him in a violation seems like a pretty clear case of attempting to violate a man's rights under color of law. The license is on the address, as you say Abiyah, he's satisfied the requirements under the law. Too bad this officer is too full of himself to ever get how much of a POS he really is.

    I dont understand why these laws are not standardized throughout the country so there are no surprises for people traveling from state to state. I would think that would make good sense

    The only thing a citizen is REQUIRED to do when they are the subject of a traffic stop is the give license, registration, and insurance. They are not legally required to verbalize their address, name, DOB, damn sure not the SSN. The only way that cop could have arrested him was for contempt of cop charge because he got his feelings hurt.

      Ohio used to use SSN as your driver's license number,that was bullshit I hated that place because of stupid shit like that, so glad I got the hell out of that ass backwards state.
      Wife's identity was stolen because of that.
