      The federal Code covering lawsuits for violation of right under color of law is 42 US Code Subsection 1983. These officers can be charged under 18 US Code Subsection 241-242 for violation of rights under color of law. This is a felony conviction which precludes any officer convicted from every being an officer anywhere. It also carries up to a $1,000 fine and a year in jail. The 1983 lawsuit would probably mean loss of Qualified Immunity and being liable personally for any judgements. I agree that until suits and charges are filed, LEO’s will continue to violate Constitutional under color of law. There has to be some consequence.

    • @thetruepatriot7733
      @thetruepatriot7733 Před 2 lety +4

      Although filming is a protected activity it's important to understand that you can be trespassed from public property without committing a crime!! Public officials in public buildings do have a right to trespass you for violating their establishments rules or policies. If you violate a policy and fail to leave when asked, you could be charged with trespassing.
      For example if you stay at a public park past closing hours, you could be trespassed. Being out at 9pm is not a crime but it is a violation of the parks policies and they would have a right to tresspass you...
      A courthouse might require that you wear a shirt and shoes while in the courthouse. If you enter the building without shoes you'll be asked to leave, if you refuse to leave your committing tresspass... refusing to wear shoes is NOT a crime but it is a violation of the courthouse rules and they would have the right to ask you to leave and trespass you if you fail to leave when asked...
      The issue with filming in public buildings is because filming is a 1st amendment protected activity and generally speaking public buildings do NOT enact policies to prevent people from practicing their first amendment rights in publicly accessible area's.
      Although public buildings cannot enact policies that prevent you from filming, they do have the right to inforce "time, place, and manner" restrictions or limitations on your filming in "non public forums" (such as a courthouse or school). A courthouse may allow filming inside the lobby but prevent you from filming inside the courtroom, a public school may allow filming in the parking lot but not in the classroom.. those are "time, place, and manner" restrictions that can be placed on the first amendment limiting your abilities to film. If you violate those restrictions you are NOT committing a crime but you are violating the public establishments policies and you can be trespassed.
      The fact that you can be tresspassed from public property without committing a crime is why you you do not have to provide your ID to be trespassed. You are only required to provide an ID if your suspected of committing a crime, being asked to leave a public building for violating the establishments policies is NOT a crime, you do not need to provide ID.
      Although I enjoy this channel I've found lots of very misleading information... I encourage this channel to research
      "non-public forums (a courthouse) & public forums (a public sidewalk)" also, I encourage you to research "time, place, and manner restrictions". Your rights to free speech are protected more in public forums than non public forums. I'm concerned that this channel offers a legal course to educate people when they don't have a complete or full understanding of the law.

    As a building contractor I’m required to take courses refreshing my code knowledge every year. Shouldn’t police officers be required to do the same?

    So if I'm sitting in a public park, you can walk up to me and "ask" me to leave and I have to leave, because you "asked?" That's not how trespassing works.

    When those we entrust with authority abuse their allowance, it is the duty of every American check their authority by exercising our rights. Stop waiving your rights or they will be sacrificed on the alter of normalcy.

    The ignorance of the law by “law enforcement” in this country is so real that this needs to be addressed immediately I would argue that this is the REAL NEWS of our country and it needs to be MAIN STREAM NOW!!! I learned so much from this video and came up with the conclusion that for starters I know at least half of those officers served in the military at one point. And for police to come into a public space and tell the public that they can’t come to there building and indulge in a right that is grantee right through the law of this land. I mean it was like the constitution doesn’t even exist to these people, they are completely okay with Earning the hate which gets good cops hurt all the time. This shit is bad and CNN and MSNBC FOX News all need to be reporting on this cause this is the most un-American shit I’ve seen.

      The constitution protects corrupt officials. The constitution granted the authority to the Supreme Court to create qualified immunity which is unconstitutional. The constitution gave the Supreme Court the DISCRETION to act unconstitutionally. Who polices the Supreme Court and houses of representation? Nobody. It is a free for all. This is pure systemized chaos.
