    Muting or turning off body cameras should be charged as a felony tampering with evidence.

      The only time officers should turn off their cameras and mikes is while off duty, while eating lunch or using a rest room. Forgetting to turn them on while on duty should be a reason for immediate termination after 2 warnings.

      Police body cams should be made where they cannot be turned off or muted, the arguments for privacy goes out the window with 100's if not 1000's of videos like this one where they cover up their own crimes. Another choice would be that if a cop turns off the camera, while the camera is off or muted the cop won't be paid. If the cop forgets to turn the camera on again then guess what the cop just worked for free.

      @@brianabc83 Make it an automatic, required, and fireable offense to have a dashcam or bodycam turned off while on duty, and enforce it. Officers should not be required to wear an actively recording camera for bathroom breaks or lunch breaks (who wants management to hear what you talk about on your own time). But have a consistently enforced REQUIREMENT that all bodycams be working while an officer is on duty. And fire those officers who "forget." Memories will improve instantly.

      Even calling for the police when you need help is extremely dangerous. There is a plethora of videos showing police murdering people because the families called to help with a mental health crisis. Or people falsely arrested because their cars were stolen or damaged; and police accuse them of hit and run.

    They seized him, restrained him n handcuffs, searched him, removed him from where he was in public, and caged him in their vehicle.
    That's an arrest all day long.

      Don't forget the injuries to his wrists. That's battery.
      Also, since the search happened after he was taken from where he was to the car, that was a search subsequent to arrest reinforcing the fact that he was actually under arrest.
      Add to that he had invoked his 5th and 6th ammendment rights and they still attempted to question him. Of course seconds after that the cop denied that he had asked a question.

      Exactly. I've dealt with similar with local pd's, it seems they want you to provide them with the name address and SS# of the people(s) they are looking for when you report a crime, otherwise how are they supposed to do their job if you don't do 95% of the work first.

      Perhaps initiating a basic bond upon graduation from academy. That grows in value over the process of a career that is attached to their pension. That replaces qualified immunity.     The first thing the officer, police chief, and detectives should have asked was, what is the physical description of the individual. An old friend of mine and I were detained by 2 detectives from the sheriffs office, they made us get in the car, but I left my foot sticking out of the car, and I asked them why we were being detained? They said that they had solid information that we were seen stealing stop signs. I told them flat out, they were violating our 4th Amendment Rights. I then asked them who it was that made these accusations, their comments were, we can’t give out that information. I then said, bullsh•t, that’s another violation of our Constitutional Rights, I then said, we have the right to know who our accusers are and be confronted by said accusers. They again said that they can’t reveal who made the accusations. I told then them, that we wanted a lawyer and that we were done talking to them. I told my buddy, let’s go. They said you can’t leave, we’re detaining you. I then said, I want my phone call. They then said, to whom? I replied, the Department of the Army, because I’m coming for your badges and the sheriff’s department, I’m going to own everything, and you may want to go check your information and confront the accuser/s, because I’m home on leave and preparing to deploy overseas, as we exited the car. The next week, they arrested the 10 individuals that were actually stealing the stop signs, after they received information that 1 of the individuals was bragging about it at school. When they served the search warrant, they found 1 of the signs in the kids closet. We never received 1 apology at all from the detectives or even the sheriff himself. Sorry about the novel, I just wanted to share the experience I had.

      In some areas now, departments have new equipment that doesn't allow the body camera/audio to be turned off even if they think they are. There was a big bust recently of dirty cops in detroit I think. A whole bunch of them were fired and arrested for all sorts of violent crimes against suspects, sometimes even just traffic stops or other crimes with no victims.

    Judges need to treat turning off the cam or tuning off the mic as "Tampering with evidence." BECAUSE IT IS! Anything said when the mic is turned of is not available to the court and that is TAPERING with evidence!

      The fact that he was placed in handcuffs and taken from where he was makes it a defacto arrest.
      If the cop had simply said he was detained but he needed to step to the side of the road to allow traffic to pass would have been different, but that's not what happened.

    Every single time cops turn off their mics or their body camera, they should be charged with obstruction of justice, as they are hiding evidence of a crime or the potential of a crime by hiding what is happening. The camera is there to protect the people from the police, not so the police can turn them off.

    Imagine physically taking another human being (kidnapping), place them in restraints, lock them in the back of your vehicle and force them to sit there for any amount of time against their will? Yeah, that’s illegal. Your name, race, religion, age, gender, job title, etc are completely irrelevant. No human being can kidnap another human being against their will. “But they are cops!” Someone will say - irrelevant. Simply being a cop does not grant you permission to kidnap a law abiding citizen.     I have stated in the past, and I will continue to state that police SHOULD NOT BE ALLOWED TO MUTE OR TURN OFF BODY CAMERAS. These cameras should be issued at the beginning of the shift, and not be able to be muted, turned off, or otherwise tampered with. At the end of shift, the cameras should be turned in to the Internal Affairs IT guy to be downloaded for review. Appropriate action should be taken for any wrongdoing on the officer's part, including immediate suspension or dismissal for turning off or muting the camera.
    If the officer mutes the camera, then this footage is later used in a prosecution, is muting the camera or turning it off not tampering with evidence? Which is, incidentally, a CRIME!

    Their mics actually weren't manually muted by the officers. The audio was edited out by the department. That is important to notice. The department knew they incriminated themselves during that huddle. That edit has removed evidence against the department.

      Absolutely! I liked a comment earlier that said there should be a bodycam online, real time archive, with badge numbers of officers. I responded with "active for the entire shift, un-mutable & shut-offable. You can remove it for breaks (food, toilet, etc) but if you don't have one, you don't work with the public at any point.".

      @@chrisbudesa they would not release the redacted audio with another FIOA request. They always attach an excuse to the documented FIOA request when it is upheld, redacted or denied. I don't know the reason in this situation, but I'm not naive enough to think they redacted it bc they thought the original FIOA requester didn't want it.

    How does a cop hear, "What is your reasonable, articulable suspicion" from a subject and not stop for even a single beat to make sure he's got everything right? Because that subject obviously knows what's going on better than the cop does, and is keeping score. And seriously? How can he with a straight face say he's not under arrest? He's in cuffs, locked in the back of a cruiser, unable to leave, and his property was removed from his pocket. So which one is it, an arrest or an illegal seizure of his property? Because it has to be one or the other.
    "We're trying to figure out what's going on." I would argue that you better make sure you know what's going on before you have a subject cuffed and stuffed.

      It's considered "detention" when you are seized against your will, cuffed, searched, and thrown in the back of a police car.
      It's not an arrest until they have reasonable suspicion of you committing a crime. And this is important, there's literally no way for someone innocently walking down the street to know the difference between a lawful arrest or detention and unlawful arrest or detention until after the cuffs are on.
      These cops really weren't terrible. Compared to most these guys were great and didn't frame the person for daring to be upset he, while innocently going about his business was stopped and detained.
      That's what usually happens when they accidentally grab the wrong person and then in fear of a lawsuit decide to stack every single charge they can think of on some poor schmuck who did nothing wrong but be in public.
      There's two main things wrong with modern policing today. Subjects who think they have rights they really don't and the type of people they hire to be cops.
      It's not well known but the psychological testing they do on recruits isn't to protect the public so much. Mostly it's just to identify the petty controlling narcissistic morons and put badges on them. They've literally fought in court repeatedly for the right to turn down anyone who isn't a petty vindictive moron.
      What modern policing has turned into is the inevitable result of decades of intentionally dredging the bottom of the barrel when it comes to police recruits. Petty controlling narcissistic morons are always going to do what they do. They're always going to think they're smarter than and better than everyone else and they're not the type to ever admit they were wrong. Most would rather lie under oath and send an innocent person to prison than ever admit they were wrong.
      You take societies worst and put badges on them they're going to do what they do.
      Still instead of trying to stop it we do the opposite. Our prosecutors encourage cops to use their badges against anyone they don't like. They tell them what lies to tell to make the charges stick and when they screw up instead of charging the cops they tell them the things they should have said instead.
      Cops are going to butt heads with the public who for some reason is constantly told they have rights they don't really have. There's literally nothing a cop can't do to you just by saying the right magic words first. The only difference between a lawful arrest and an "unlawful" arrest is what the cop says first. The only difference between a lawful shooting and an execution is whether the cops said the right things before after the shooting. If they say the right things they can literally shoot a toddler holding a video game controller and get away with it.
      Your "rights" are a cheap magic trick. You believe you have them through the power of suggestion but at any moment a magician can make them disappear in cloud of smoke. It's not right, it's not fair, but sadly it's just how it is until people demand better.

    I remember about 30 years ago in a small town I lived in, justice was done. There was a young man who got in with the wrong crowd and got into trouble for a while. He finally realized that he didn’t want that kind of life anymore and went clean, got a job and minded his own business.
    Well, there was a tyrannical cop who followed him everywhere and harassed him by pulling him over every time he was seen driving. And he didn’t just harass him, he was known to harass anyone who he felt like giving grief.
    Some of the young man’s former acquaintances in that life were also family and they continued with that lifestyle. They found out about the harassment and went to the cops house one evening after finding out where he lived. They knocked on his door late and he answered.
    They pulled him out into his front yard and beat the living hell out of him until he was bloodied and unconscious.
    The harassment stopped.

      Whilst I would never endorse violence, this behaviour is almost certainly going to elicit retaliation. Officer safety will become a real issue and if they do nothing about correcting these situations, there will be an open season on uniforms. The war of Independence was fought to free Americans from this type of oppression.
