      Have to agree and disagree with you there, while certainly a stupidity issue, how did someone this incompetent and moronic, make it through screening, testing and training??? I'm reminded of Obi Wan's immortal question, "Who's the more foolish, the fool or the fool who follows him?". Yes, he is beyond stupid, but the academy trained him and didn't weed him out and the department hired him and kept him on the payroll, neither of which speaks well to their efficacy or sense of professional responsibility.

      You are partially right. "Honest mistake" at least implies that the person was acting in good faith and were attempting to get it right.
      Cops do crap like this, raiding the wrong house, do felony stops on cars that aren't stolen all for the same reason. Complete and utter carelessness and disregard for getting it right.
      They know they won't be held criminally liable, so why should they care?

    When my car got stolen (someone took the keys out of my office and drove away with it), the police who responded could not let go of the idea that one of my daughters were responsible. Problem is, my office is in Virginia while my home is 35 miles away in Maryland, and my daughters were 6 and 11 at the time. As they questioned me, they kept asking me, "So, where are your daughters now?". I couldn't believe it. Now I do.

      One of them major failures of cop thinking are the preconceived notions and theory about a case. They latch onto implausible ideas and then try to prove their theory correct. They make the assumptions without any evidence and often refuse to look at the actual facts. Innocent people end up in jail due to such stupidity.

      i got accused of pushing someone down some stairs, even after i proved i was in my room with my girlfriend playing video games (RAS dispelled) he still shouted to everyone on scene that he still thought i was guilty, turned out the guy was drunk and tripped down the stairs and put his head through a pane of glass causing a deep cut on his forehead. the cop was definitely a jerk

      They only record info, unless I'm terribly mistaken. Who would've cared should've been the DA, defendant's lawyer and the judge.

      @@Scleavers They issued the wrong Shane Brown a NEW ID number! If they "only" recorded or transcribed the information, then they would have used the EXACT number of the older white Shane Brown. The police in booking KNEW they were different people, but said, "Meh, the judge will do it and Shane will be released eventually."

    I was arrested for bank robbery. I was 45 years old at the time and native American Indian. But the witnesses said that the bank robber was 18 to 20 years old and white. I just happened to pull into the same strip mall that the bank robbery had occurred and was walking into a grocery store when I was tackled by police. When I ask the police for a description of the suspect they told me he was a 20 year old white male and I pointed out that I was a 45-year-old native American Indian. But still they arrested me and searched my car and eventually released me.

      You can tell in the video that the sun is going down already. Winter sun sets are so early, especially in the north. The thing is that it wasn't down yet.
      If the headlight was out that's a different story, but I still don't think it should matter unless they're driving at night with it out.

      Eh, I tend to agree, but where I live (WV) there aren't many black people and they'll do it to whoever is convenient, usually somebody poor. They like to use the suspicion of opioids as an excuse to be super aggressive in WV. I got out of a false accusation for DUI last year and they were super disappointed to find out I'm not a drug addict or trafficker. I'm an Iraq veteran and it's not the first time it's happened. I've been handcuffed for no reason in a Wendy's parking lot because a cop was afraid of me ( I did nothing) and he had a dog and a gun. Again looking for drugs I didn't have. I was let go, but that shit is degrading to be bent over the hood of an SUV while a cop yeets your shit into the parking lot to find nada. I know black people already know and feel that shit, but I know it too. They just used something besides my skin to do it. Racism makes it worse, obviously, but they love to kick poor people when they're down no matter the color.

      The pretext for the stop was my main issue with this whole scenario. Police are pulling people over for minor or imaginary offenses. The more interactions police have with the public, the more likely they are to violate your civil rights.

    The sunset on that date was at 4:53PM.
    Technically he didn't have to have his headlights on.
    This is a bs stop for a fishing expedition.
    End qualified immunity and disband the FOP so the cop pays for the lawsuit and not the taxpayers.

    About 20 years ago I was held at gun point because I matched the description of an armed robber. The robber was approximately 50 yo and had long hair, beard, and was homeless. I was 21, freshly shavin and cleanly dressed because I HAD JUST GRADUATED the POLICE academy. Unfortunately being so green I just chalked it up to stuff happens. Now as a retired LE SGT with zero citizen complaints I wish I would have held that officer accountable for his actions. It’s really not that hard to not violate people rights.
    As a SGT my shift would get mad as once a month I would hold in service training on laws and legal, telling the officers “this is the stuff you need to know to make sure you last until retirement.”

    Abolish qualified immunity then - Doctors have liability insurance. Everyone in law enforcement should have a liability insurance policy which is designated as first payer when they cause legal action to be instituted against their employer. This saves the taxpayer from footing the bill for the officer's illegal actions. Sooner than later the bad ones will be out of law enforcement and we can go back to respecting the profession.

    There should be no cap on lawsuits and damages made against the government. The officers that did this should be held accountable and be charged with all the felonies that anyone else would be. The don't care about putting him in jail because there is no accountability.

    This is also an issue of passing the bucket! not only stupidity but also flat out laziness and failor to take responsibility! We see this type of behavior in the gov as well as no cares & laziness prevails to the point they just push it down the line until it has basically nowhere to go and to where it's too late and the damage is done.       Many states cap their liability. My sister's father in law was left in a wheelchair for life because of defective highway material used to pave the highway he drove on daily. The state knew it was defective but was dragging their feet on replacing it.
      Her FIL was in his late 40s and required nursing care the rest of his life. They sued, but Illinois capped lawsuits against the state at $10,000 at the time. That didn't cover his care for six months.

      It's the freedom of information act - we get a lot more information about US policing than anywhere else in the world. It's true they are a lot more aggressive and don't de-escalate as much as Commonwealth countries, but a lot of it simply comes down to transparency.
