      Judge isint gonna care. Prossecutors gonna play on emotions and the judge will give gulty verdict by simple hearsay.

      in some states if someone doesn’t get a subpoena from a lawyer to retain the documents that comes from a police station, then the documents CAN NOT be used in court. reason being hearsay.

    Question, I'm sure that I will attain my restraining order. But the person lives right next to me in the same building practically.     I just got a restraining order put on me after I got blindsided by a hearing. I choose not to speak because im getting a lawyer so the judge issued the order because of that and I’m not even in the same state as my ex.     And when at the hearing can they respond at the hearing to the Judge to tell there side of the story along with evidence??

      Frank, I’m sorry, I’m just seeing this. You don’t have to respond “in time” because you don’t need to actually file a written response at all (in California). At the hearing, the person who filed goes first, then the person who is defending. I just made a video with way more details than this one about how to win your restraining order hearing (including how to present your evidence).

    I wish my sister could afford a lawyer. She got out of an abusive relationship. He then decided to move from nevada to California. He threatened my sister if she doesn't let him take the baby for a month then he would make sure she would never see her baby again.
    The plan was they meet halfway a month later and gives her the baby back.
    He made her drive all that way to have his cousin serve her with restraining order papers. And he didn't return the baby.
    It's been very hard to figure out how to get her emergency custody.
    She's very scared knowing she doesn't have a lawyer.

    What do I do when the judge has blatant political bias and Grant's not only the RO, but 100% legal custody for aside from my political affiliation, for a 2018 case I was not only exhaunerated from, but the petitioner who made the DV allegation admitted in that case under oath she made up the charges so I'd go away. This order was granted in 2021 and 1 year later WE HAD ANOTHER CHILD! INTIL 5 MONTHS AGI SHE LET ME VIDEO CALL WITH THEM EVERY NIGHT AND SEE THEM TIME TO TIME. IIVE DOR MY KIDS.     My wife got an order of protection against me because I blocked her mother's phone number from calling our home phone because it rang out loud, and she (her mother) refused to use cell phones.
    The judge granted my wife a 1 year order.
    The year is coming up.
    Will the judge automatically grant my wife's request to extend the order?

      It won't be automatic. There will be a hearing (similar to the hearing you likely had the first time). She will have to show that a restraining order is necessary to prevent future domestic violence. Usually, if there has been no contact between the two of you, the judge would not grant the request to extend the restraining order.

      Actually, SHE (my wife) got the order modified to talk about business (we ran a business together).
      In fact, the week before that hearing last October, her lawyer told my lawyer that my wife wished to talk about anything. But then at the hearing a few days later, her lawyer said, "no, no, just business."
      Okay, fine.
      So, my wife and I have been having nice exchanges involving business.
      I did slip up in February of this year when I asked my wife's parents for help with our suddenly exploded credit card debt, and got mad at them in another email when they did not reply.
      But, no, there has been no harassment or contact of any kind.
      I think my wife's lawyer is freaking out because my wife lied to him and caused him to lie to the judge at the original OP hearing last August. Her lawyer is freaking out because I have continually called him out for withholding an exhibit he presented at the hearing. By surprise at the hearing, he held up texts showing me calling my wife a b and ah the night before she filed, when in fact, I was asleep and had only hours before told her, "I love you, what time will you be home tomorrow?" via text.
      See? This case is really weird.
      Step 1: In laws bother me.
      Step 2: I block them.
      Step 3: They get mad at my wife.
      Step 4: A negative feedback loop is created and I said "Stop bothering me about blocking your fuk cing mother!"
      Step 5: Bam, I'm out for a year based on lies.

      I pray to god I can go back home at the end of August and see my kids.
      Unfortunately, I missed my daughter's last year at home before college, her last Xmas, Easter, prom, graduation, everything all because... I crossed my in laws. I am so sad and heartbroken.

      Unfortunately, I messed up AGAIN (god hates stupid people):
      She was granted exclusive possession of the marital home during the pendency of the divorce proceedings.
      3 months in, I was lonely and went to our street. A stranger's car was on my driveway. I went onto the driveway to look at it, then up the first 2 of 6 steps to our front porch to see who was in my home.
      I left.
      Unbeknownst to me, she had had Blink installed and saw me.
      She filed for a new order of protection.
      Now what?
      I freqeuntly wish I could take back 60 seconds of my life.

      No! If you have admissible evidence, you present your story well and do not change it, and you have appropriate demeanor in court, an attorney can only do so much. You might want to go watch some hearings.
      Please get the free class here: defeatthedvro.com What I teach in the class and the course applies to you. If the attorney says, "objection, foundation," for example, don't get flustered. Explain where the evidence came from. Bring extra copies (at least 3 copies) of each document. Don't plan to show anything that's on your phone (call the court ahead of time if you need to play a video or audio). Re-read your request for a restraining order so that you do not accidentally make changes to your story. If he has violated the restraining order at all, bring proof of that and tell the judge about it.

    Hi I unfortunately have a trial this Friday because I had to get a restraining order against my ex. she’s been harassing me as well as my current girlfriend. This ex and I have been broken up for 4-5 years now and she won’t leave me and my girlfriend alone. I didn’t think I was gonna need an attorney but after watching your video (though it was very helpful) also had the negative side affect of making me more nervous and unsure.     Question. I am a 37 year old disabled disabled individual who is living at my mother's House temporarily, At no point was there any kind of violence involved However, she did get a restraining order against me. I know it's because of her perceived idea of The possibility of violence because I occasionally drink alcohol Which she did not want in her home. Now she's 80 years old, and I'm almost certain. The court will always side with her as she plays the victim. I have a public Defender. Should I plead no contest as they are suggesting to me or take this to trial? Because no harm was ever done to anyone.
    I welcome your thoughts below period I very much hope somebody will give me some idea on how to proceed because I have never once been in trouble with the law.
    And have no idea what to do.

    Can a restraining order be made to penalize anyone regardless of the situation? For instance, if the person filing it was the one who is aggressive and destructive?
    My neighbor called 911 and told them I attacked her. She is now filing a restraining order. The thing is I showed the Police a video of what happened and it was in fact her attacking me*. You can even see her smirking at me when she was lying to the 911 operator about me grabbing her(she doesnt know I have cameras in the area). The video shows me as I backed away from her with my hands in the air. I also have several videos of her destroying my raspberry and blackberry bushes(talking to herself as she stabs at the branches to cut them away), destroying one of my vegetable gardens by crushing my plants with the cinder blocks used in my own compost pile(we are in a land dispute and the compost pile was in an area they claim as theirs). There is another video of her and her husband killing our 19 year old mulberry tree(although I dont think they did it on purpose. They pruned it to death right as it was coming out of dormancy)...but Im getting the restraining order placed on me?
    I dont go near her, talk to her, or even look at her, her husband, nor her kids. When we see them, we just go back in the house. We are kind of scared of her, she's unstable(her husband even said she was once, in confidence, back when he and I got along. That "she could be vindictive and aggressive". That she "cycles" through emotions. Whatever that means)..and she has (subtly)threatened to harm my puppies.< but I cant prove that.
    She is a Wealthy Pediatric radiologist and Im a struggling artist. I cant do a long, expensive court battle.
    *apparently it wasnt a crime for her to grab the hose in my hand use it to push me back and then throw the hose to the ground..I was following a court order to remove my raspberry bush and needed to loosen the soil by watering when she went off on me.

      It's really sad how all of this works. The last DVRO hearing I had, I ended up giving advice to a few different people in the hallway who were responding to these restraining orders, which is what inspired this video in the first place.

    Single male.37. Got an order of protection slapped on me last Friday. She’s got recordings of me yelling. I’ve never been arrested for anything domestic, she literally resided here 10 months as of 1-11-24 she left me that day. She’s made false allegations I’ve put hands in her daughter face on Christmas. Her daughter stayed at my home 6 days, this teenager texted me looking for mom after she left, long story short I’m on recording yelling. I’ll admit I yelled. I did not assault anyone ever. I’m
    Just nervous. I’m broke, court date is 1-25-24. Just nervous, and more importantly embarrassed. She was homeless prior to me.

Also, my dad is the co-signer of the house and my ex recently lost his job. We now have dual restraining orders and court is set for April 6th. Any tips would be greatly appreciated.

      Hi Mike, If you don’t feel ready and have not already postponed the hearing, you have the option of asking to postpone it one time. (The judge will say yes if it is the first time you asked and you are the respondent.) The tax papers may or may not be helpful, depending on what she is alleging.

      @@MikeRyte-tb1nb Go to court, and ask the judge: “Your Honor, I would like to request that we continue this matter to another day so that I have sufficient time to gather my evidence.” (The courtroom staff will likely ask before you’re in front of the judge whether you intend to go forward with the hearing today, or similar.) The judge will understand your request and grant it.

    I am a victim of severe domestic abuse! Do you not realize how condescending you come across with a Power Trip High Attitude in which you seem to be oblivious as to whether or not either party can present their true evidence and it seems you rather enjoy deliberately causing a situation to be worse than it already is I'm playing Court games. This is not a game and people do died everyday. You should really consider re-evaluating your smile which is very smirky and doesn't come across is wanting to exercise justice law for all parties or anyone else involve. It's like you're more interested in getting it as in "I gotcha you" rather you've actually got a gotcha you or not, well getting off on use and twist the law to cause people to not be able to exercise their rights by the law is the impression that I get from this video. Again this is not a game Lady it's not about you being some little super lawyer in a courtroom twisting people's lives using courtroom technicalities to manipulate the case instead of serving it for other party involved. And pardon me, but this thing about the judge is higher or holier-than-thou and such and citizen is lower and cannot speak attitude is one of the major problems in this country. I am woman betta male judge puts his pants on one leg at a time just like I do and I was created equally just like everyone else. In other words for Dr World this is known as a God complex! Or in the most simplest of terms you are not all that special... D_m! You should try living on the street for a week and not eating for 3 Days to get a reality check of how horrible it can be to live in this world and come down off of the pedestal that you seem to think you're on... Because this is the core problem is why it is that women cannot actually get the help that they need in the real life because politicians and lawyers and people who think they're upper-class only because they might have some money failed to recognize the status of an actual hardship life are there in the short-term or over a period of decades in life as I have suffered personally yet I'm not interested in doing a guy. You to get Justice for my husband's behavior I'm interested in the courts following the law and executing what is right not playing I got you games with a technicality to prevent someone from being able to testify or to deliberately fluster someone so that they come across as someone that did normally wouldn't be if they weren't being deliberately prodded and poked to cause a very irritable response that ordinarily would be out of character even and yes I am referring to potential as well. Overall this issue are domestic violence is not but you seem to come across with the attitude that you think all of this is a laughing matter. A tip of advice

      Sounds like you need some therapy. The way you assumed that she had a "smirk" and assuming she is condescending shows that you are very emotional and *Argumentative* (I'm using what I just learned) and not understanding what she is saying. While I understand your emotions, Frustrations, and being pissed off at your abuser and their attorney because I too was a victim of Domestic Abuse (almost got killed, and the asshole had a bulldog attorney his parents were paying for ...I went through some terrible shit plus had PTSD from the abuse), you are still in your emotions while viewing this video and that is exactly what you should not do in court and while preparing to be in court. The court system in the U.S. for Family Law MUST change and totally sucks (I got screwed over by it), complaining about it without actually learning how to Use and Work the system isn't going to help the situation. You are also assuming she has a God-complex ... I just see her as trying to help and smiling to the camera so that people can see how she is friendly and trying to be presentable. I recommend that you go to therapy--it really helped me.

      Everyone deserves to have a defence. They are millions of videos helping the victims and almost always there are comments saying: lock them up and throw away the key. This is literally the only channel i've found helping the other side and i wholeheartedly thank the creator of this channel.       I felt the same from this video. Women stay because they are afraid and when they try to leave often abuse escalates and lawyers doing what she described above where she laughs as she decimates the victim is not justice esp if the abuser controls the money and ability to have legal representation. When she sees a victim without a lawyer she said it's fun to decimate them. Women die every day from domestic abuse. Others live in fear for many years with no access to money, because they are traumatized and don't present organized. Mine hired father's rights lawyers just for divorce. Controlled millions and the home and car. Said he needed to control me and the accounts because there was something wrong with me. I was healthy prior to marriage and DV. At no point in divorce did I have access to even checkbook. I signed, under duress without discovery while his abuse escalated. I was afraid to report him. Then he defaulted on divorce and said he's untouchable. That's what these lawyers do to women. Even divorced I'm not safe and have no rights to even enforce what he signed.

    I had run into a woman for 27 years put a restraining order on me. My wife past away in my arms. Well an electrician who worked at my home who also worked at her home. Well he gave me her phone #r instead of his phone #r. Well I love this I texted her I cared for her and I love her. Well this electrician hung out with me for 10 months to start trouble. He introduced me to some of her friends. So all the sudden I'm going to court for menacing by stalking. He was calling her telling her false things. So she's scared for her life and distressed. I would hurt this woman I love her. So my lawyer basicly made me sighn it before court. I'm so hurt over this.

    The beginning made me cringe! It’s kind of tacky to gloat that you like destroying the plaintiff. For instance, I’m trying to get a restraining order against my neighbor. He’s a jackass living with his mom, he’s 27 years old, and threatened to kill my dogs and myself. But mommy and daddy are paying for his lawyer for the restraining order. Please read text full and saying things because some people can’t afford a lawyer, but they really do you have a need for a restraining order.

      There are definitely two sides to it.
      I only do defense work (although I did volunteer for a domestic violence legal clinic for about a year). What I often see is people lying in order to get a leg up on custody/child support or kick someone out of their house while not even paying rent.
      I've never, in 10 years of doing this, had a case where the other party kicked my client out of his home with a TRO but still paid their fair share of rent, for example. Never.
      I came home from court after defeating one such petitioner and filmed this video, which is.... polarizing to say the least. But hopefully it helps people.
      Best of luck with your case, but beware of having a false sense of security. A restraining order is a piece of paper. It's not going to stop anyone determined to commit violence against you. At least in California, you'd be better off calling the cops and reporting him for a criminal threat. At minimum, then a prosecutor would make sure to get a protective order on your behalf, without you facing a lawyer in court alone.

      Restraining orders can go on your record and affect your future housing, employment, and professional licenses. They can also cause you to lose custody of your children and lose your home (while still having to pay). Not everyone who applies for one is telling the truth, and even amongst those who are, not everyone actually needs a restraining order to protect themselves.

      There are resources to assist you with obtaining a restraining order in most states. Personally, when I felt harassed, I blocked the other party and moved away. A restraining order is a piece of paper. Violating it is a crime, sure, but it doesn’t stop a determined person from bothering you, especially if the police and/or local prosecutors don’t care.

      In the state of California, if you want to have the government make it a crime for someone to contact you, come within X amount of feet of you, etc. (as well as potentially affect their background checks, housing, employment, etc.) you have the burden of proof to show the judge that you are entitled to a restraining order. If you meet your burden as the petitioner, you win. If not, you lose.
      You wouldn’t want anyone obtaining such an order on you without providing sufficient proof (or at least most people wouldn’t, which is why we have due process in the U.S.). If you do not agree with due process, there are plenty of countries without it. (Just hope you don’t end up being the accused person there, I suppose.)
      Plenty of people ask for restraining orders based on lies. Their motives are to gain various advantages in housing, custody, alimony, child support, immigration
 the list goes on. Our system is not perfect, but it at least requires the person claiming that they need protection to convince a judge before obtaining a burdensome restraining order on someone else.
