According to the US constitution, it's only treason if one supports and follows an enemy of the US, AND provides said enemy with "aid", which is any kind of support, like sharing top secret documents with them. I *SUSPECT* (though have no proof to back this up) that this is why this australian billionaire pops up in the story. (There's also a clause that says if a US citizen starts a war against the US state then that's considered treason, but that's not relevant to this case).

I worked in military defense and later in the defense industry with classified information at different levels for almost 30 years. If anyone had taken just one document they would have had their security clearance pulled by the FBI - and if they disclosed classified defense information they would have been sent to Leavenworth Federal prison.
