Harvey Weinstein Conviction Thrown Out

  • When the Hollywood producer Harvey Weinstein was convicted of sex crimes four years ago, it was celebrated as a watershed moment for the #MeToo movement. Yesterday, New York’s highest court of appeals overturned that conviction.
    Jodi Kantor, one of the reporters who broke the story of the abuse allegations against Mr. Weinstein in 2017, explains what this ruling means for him and for #MeToo.

    Jodi Kantor argued for "hundreds" of women "coming forward" with the "same story", as constituting compelling evidence. Much documented research and understanding would suggest the contrary. A large number of people ending relying on the one shared narrative, invariably involves complex social process and complex social psychological dynamics being the authoring factor. Where, as the journalist credited with "breaking" the HW story, Jodi Kantor is centrally involved in that authoring and shaping process. Such authoring and shaping isn't intrinsically suspect or untoward; but is simply something to be acknowledged wherever a grouping comes to rely on one shared narrative. This authoring and shaping process is then implicated in advocating for and lobbying for the changes in law and judicial process which Jodi Kantor favours. Where, again, many other voices representing all the groupings in society, will have their own view to offer.

    Jodi Kantor offers an even-handed perspective on what has taken place, in convicting HW, and in the overturning of that conviction. The interviewer not so much. This interleaving of the "MeToo movement" and judicial process (for all), then has a complexity beyond even the very rational treatment by Jodi. We have two loose constituencies: one fairly exclusively concerned with advancing the MeToo movement; and the other fairly exclusively concerned with sustaining the integrity and principles of judicial process. The interview focused on the HW conviction overturning, as a setback for the MeToo movement; but did not much, if really at all, consider its merits vis a vis the judicial system.
    To broaden matters a little, the Scottish government is proposing that trials involving rape charges, will not always involve a jury. Which proposal might seem to some a leap from a frying pan into a fire: the demerits of jury trial of rape charges; being displaced by the demerits of whatever hearing and judging mechanisms become involved.
    Bottom line perhaps. The voices of many constituencies, not just the one represented by the MeToo movement, need to be heard on all the issues involved in the HW instance. It being admittedly concerning, that, like Trump, HW is a poor choice to represent the constituencies whose voices must also be heard. But we are we where we are.

    Though I know that the witnesses were a number of witnesses pertaining to their own cases and they’re arguing in those cases do not directly interact with this case they in fact did. Because the only reason they used those witnesses was because the girls there they had some instances of consent. They also had instances of being forced into things they did not want to do, and in order for the jury to understand they had to use other examples, so you could understand normal things. So those examples were essential to the case and therefore did relate to this case because they happened to those particular girls but because the things he did happen to those girls and you had to show that this is something that he did. The argument that they’re making is that it doesn’t count as their evidence, but I say it does actually count as their evidence as it does pertain to this case because if it didn’t pertain to this case, it wouldn’t have been useful to this case. Wouldn’t have been useful to this case. Hope that was useful was the predation and the history of predation not the individual cases however, the actual character was on trial here today and that is what is part of their case so I feel like they had bad counter arguments that could’ve argued that this extended court case was extended pieces to it were a part of this case because they weren’t trying him for those other assaults they were trying him for these assaults with an action or historic predation.

    😲 Eh ben, c'est dingue, il s'en sort bien ! Mais l'essentiel est que ça ne se reproduis plus, soyons plutôt concrets, mieux vaut prévenir que guérir : pour faire face aux manipulateurs, aux personnes dominantes, aux situations toxiques et au manque de respect en tous genres, il existe des solutions, des techniques, afin de préserver sa dignité et d'éviter que ça n'aille trop loin. Personnellement, je conseille le livre "SE FAIRE RESPECTER", de Nathan Stone. Il y a tout ce qu'il faut savoir, c'est le livre le plus complet pour faire face à des situations toxiques, c'est clair, pas de discours superflu, le top. Il cerne bien tous les aspects et ça peut convenir à tout le monde, c'est ça qui est bien ! 👌

    Both interviewer and interviewee, characterised the HW conviction overturning, as a setback for MeToo: blamed "conservative" judges for the setback; and argued that judicial process has to change to allow the type of trial and conviction HW was subject to, to go ahead. Viewed from another angle, of law and judicial process as it currently exists, a MeToo understanding informed the original trial and conviction, and that MeToo approach was found to be so fundamentally flawed, that trial process had to be condemned and the associated conviction had to fall.

    I don't know if HW is guilty. Regardless, this is a victory for the falsely accused and due process.

    Predators may need a new label of "Sexophiles". Sex should not be used as a transactional behavior.
