The San Francisco Public Defender’s Office released new body cam video showing an officer shooting Sean Moore on Jan. 6, Moore who survived and is reportedly in stable condition, is obviously agitated throughout his interactions with officers Kenneth Cha and Colin Patino. He’s been diagnosed with schizophrenia, according to his family and the public defender’s office. Two officers responded to a neighbor's complaint in the middle of the night. Moore, 42, was agitated and verbally aggressive while officers asked him in a calm manner to come down from the top of a staircase. Finally, one officer fired pepper spray at Moore. He also inadvertently sprayed his partner, as he fell down the stairs. Moore went back inside the house while the officers continued to tell him to come outside. After a while, he did. Officers continued to yell for Moore to get down. He came closer, picking up some papers he dropped on the stairs. Then a scuffle ensued. One officer had his baton raised.
The body camera angle distorts the video. The other officer fired off two shots. Public Defender Jeff Adachi believes the officers should have used crisis intervention techniques. "Mr. Moore did not have to be shot and the officers, had they properly used deescalation techniques, would have gone home." Interim Police Chief Toney Chaplin sees the video differently, saying the officers were assaulted, and used great restraint. "You saw them back down the stairs a couple times," he said. "One officer, even put his hand up and even backed the other officer up at one point a little bit, to give him a little bit more time." Chaplin released photos of the two officers and their injuries suffered after the scuffle. Moore is at the county jail, charged with, among other counts, assault on police officers.

Without looking much deeper into it, this case certainly seems to be borderline harassment to me. Being rude or nice to the police shouldn't make a difference in what they're able to do. It seems they only made the decision to arrest him after their interaction, which doesn't look good.
Let's say cops are investigating you on account of bologna allegations, but they have no warrant - no legal authority to be anywhere on your property that strangers shouldn't go. This includes a structure's curtilage, saving for the path to the front door. At what point should you be able to trespass the officers? After the fifth interaction? After seven hours of listening to them knock on your front door? There is federal court precedence establishing that extending a traffic stop detainment well past what is necessary for the interaction results in said detainment becoming unconstitutional. Any evidence revealed by searches after this happens cannot be admissible in court. Surely the home has similar protections.

EDIT: he died 3 years later from in prison on unrelated charges. His death was partly caused by a gunshot wound to his abdomen that occurred three years earlier.

A San Francisco man who was shot by police in a confrontation in January and survived to see all charges against him dismissed has been arrested again and was charged with several felonies, including hate crime allegations.
Sean Moore, 44, was arrested Friday and has been charged with twelve counts, which include an assault and making criminal threats with hate crime allegations against two people.
One of the victims was a minor female, upon whom Moore allegedly inflicted great bodily injury, according to court records.
The charges also include allegations that Moore made a series of annoying phone calls to Taraval Police Station between June 8 and July 30 and made threats against one police officer and three members of police personnel. One of those charges also carries a hate crime allegation.
