  • After Justice Abimbola Awogboro of Lagos High Court sentenced cross-dresser, Idris Okuneye, also known as Bobrisky, to six months in the slammer without an option of a fine, it was clear that the anti-graft agency, the Economic and Financial Crimes Commission, EFCC, was going to bare more fangs. Top socialite, Paschal Okechukwu, better known as Cubana Chief Priest, is in the eye of the EFCC storm. He has been arraigned in court over naira abuse. The said crime occurred on the 13th of February, 2024. He pleaded not guilty and has therefore been granted bail, in the sum of 10 million naira

    Can someone explain to me what exactly is the crime Cubana Chief Priest is being prosecuted for? I am very confused. What is Naira abuse? Was he manipulating currency markets illegally? Did he violate some market regulations? It sounds like he is being prosecuted for spraying money, but I am very confused as to why that would be a crime. We spray money here in America too, but I am finding it difficult to understand why that would be a punishable crime that warrants posting bail. Is Nigeria this backwards that this is the state of the legal system? Don't we have more pressing matters to address?

      Do you really want answers to this questions or you are just asking as a form of mischief. I can provide clarity if you are really interested in what the Nigerian Law states. Kindly note that laws vary from country to country, and comparing the USA and it's stance on spraying money to Nigeria's stance on such is dishonest. Our subjective opinion on why the government has taken it personal to witch-hunt wrongdoers is another issue entirely.

      ​@@tolulopeadebayo8512 I am not interested in what the law states in this instance, more in the rationale behind it, so any guidance would be appreciated. The reason I mentioned America is to highlight that Nigerian communities globally spray their respective currencies, and no outside government has taken such a stance on such practices.
      Laws have to have some sort of base in rational reasoning even when balanced against the relevant society's principals. Here, it seems like an undue burden to both the State and the citizens to be subject to, and enforce, this seemingly arbritrary rule.
      For instance, the men in the above vid mentioned the money being dirty as some sort of explanation as to why the rule exists. However, this can be easily addressed by circulating the physical note through a reserve system that reprints and discards old notes. At least that's what some countries do. Also, money inevitably will get worn and tarnished overtime even with "proper" use.
      Also, the punishment seems a bit excessive and a wasteful use of judicial resources to pursue this matter in this manner. Imposing an arrest and bail for what should be a misdeamenor for a victimless crime that has no actual chance of causing any irreparable harm to any identifiable living person or irreplaceable property is very weird to me.
      I guess what I am trying to say is, money is personal property. Unless you acquired it in a manner that would be considered illegal and/or a crime, once you acquire it, it is yours to do as you wish. You can burn it, spit on it, stomp on it, use it to wipe your bum, etc. Same as your car, the clothes on your back, the deed to your house, etc.
      In this instance, spraying money is a well-known and accepted cultural norm. So merging that the money is both acquired personal property, and it's use adheres to an already established and accepted cultural norm, AND there are less restricitive means to achieve whatever respect the State wants citizens to have for the currency, I am having trouble comprehending exactly why this a crime, and that the crime requires an arrest and bail.

    The FIRS should be the one going after those that spray naira notes. Just review their tax profiles if they pay their taxes correctly. Many of them don't. Where they don't, fine them heavily as punitive measures. This way, you will begin to see people behaving themselves. The govt is not even smart about boosting its tax collections. Use instruments of state authority to compel behavioural changes in the society.

    Arresting and prosecuting citizens for a crime called “Naira Abuse”, is unconstitutional.
    Spraying of naira in parties is a way of expressing your love either for the celebrant or the musician.
    Expression is Free speech, and is a right in the constitution.
    A lawyer in Nigeria should take it up as a constitutional issue, pro bono.
    The guys on this show are ignorants. We spray money in US, and police officers are aware of it.

    It's apparent that Jide is not a lawyer, judging from his comments on the ongoing cases. Cubana chief priest has been charged and has pleaded not guilty; it's now up to the prosecution to carry out their duties. There's no need for speculation. The positive aspect of the EFCC's current actions is that it will likely discourage the practice of spraying money at parties from this point forward. Period.

    The real abusers of the Naira are government officials who steal our common wealth. Our money is worthless hence people spray it with reckless abandon. On the other hand you will find it difficult to spray dollars or pound sterling because their currency is strong. The easiest way to stop spraying of the nairait is to introduce in practical terms economic activities that will strengthen our currency. Where a dollar exchanges for N1,105 it makes it very easy to throw it around.

    In as much as both were culprits ,the judge will show mercy on whom he will show mercy n show compassion on whom it decides, it's the judge prerogative under the law.     Did the people in question earn the money legitimately? Did they pay taxes on the earnings as appropriate? Isn't the money they sprayed their personal property? Isn't spray of money a cultural matter? Why is the government offended by an aspect of a Nigerian culture? This appears to be a culture war.
    By the way, when was the last time our security agencies arrested and prosecuted kidnappers who receive millions of Naira as ransom from the families of the victims, even when the ransome was paid via the country's banks?

There are so many 'big people' with allegation of looting of billions of Naira hanging around their neck but they are not charged to court with the same zeal and spead. An ex-Accountant General who allegedly looted over N80 billion but a few billions were said to be recovered from him. Shouldn't such a person be charged to court? How do you explain how kidnappers could be collecting tens of millions of Naira through the banks without any consequence? I am making this contribution because I desire and feel certain that Nigeria will get better and flourish under Presidennt Tinubu.

    I pity TVC your analyst are alway sentiment in their analysis and that’s a big problem for you moving forward , we all want Nigeria to be great but this looks one sided we have seen more pressing issues in Nigeria and the EFCC won’t react to it eg. Some of the ministers in this government have corruption cases and the EFCC turn a blind eye to such people this is not what will make a real changes we want to see in Nigeria.

    Spraying money this way is very bad and really a notorious act. Money are sprayed in Europe and United States but never in this manner. You can't spray this way and go free. You would need to proof solidly the source of the funds.
