  • Aid and Attendance (A&A) is a medical circumstance that veterans face when they require regular care from another person in order to carry out the activities of daily living. VA's Aid and Attendance program is a part of Special Monthly Compensation (SMC) and Enhanced Pension, which pay Veterans who require this aid higher benefit rates than standard VA disability compensation.     It would have been very helpful to add that this smc benefit aid and attendance is paid to the veteran to help offset or pay for the aids the veteran needs.

    I understand income and asset limits. What I don't understand is how an IRA counts as both (especially with required monthly payout). If a Veteran had an asset under the limit but the income put them over the annualized limit and they completely withdrew that asset to preclude having an "income" is that considered an asset transfer that would disqualify them from A&A since they are transferring it to themselves? They're not hiding the asset just putting it in a different account, perhaps 'more secure' like a savings account.
    I looked in the 38 CFR 3.271-3.279 and it seems they should not be disqualified for doing this. Thoughts?

    Does VA disability compensation count against the income/net worth limit? Everyone is talking about income, retirement pension, and social security but I haven't seen anything on that yet.

    Is it correct that the 2023 SMC-L is $4,506.84? And if so, you’re saying that this would be in addition to my 100% P&T Pay? Or in Lieu of it? I am finding a lot of conflicting information on google.

      I only get 4200 a month . Thinking bout applying but it will reduce my smc if I receive it at all . I’m pt house bound . 100 percent for mdd alone . Plus ptsd sleep apnea ect.

      One does not qualify for A&A if one has a VA disability rating and is receiving a VA disability check. There is an income restriction with this benefit. One has to be on Social Security or have an equally low amount of income. One must prove a medical need for assistance with ADL's because of a disability or life situation that is not a service-related disability that one receives a VA check for.

      One does not qualify for A&A if there is any VA rating of disability that one draws a check for. This benefit is for Social Security or low income only. One can have a disability or life situation that is not service related and can prove a medical need for assistance with ADL's.

      Also, you have to spend the full amount of whatever your income is towards care, otherwise you will be out of VA compliance, and they will stop the benefit. This is a reimbursement payment for care assistance.

    I receive SSDI and 90% VA disability currently.
    If I receive 90% VA disability do I qualify for Aid and Attendance? If I have a caregiver who is compensated through the expanded Primary Caregiver program can I still receive Aid and Attendance? Do I have to switch to pension from disability compensation?

      Yes on aide and attendance, no on switching and the money goes to you. What your caregiver gets doesn't effect you.

      NO. you cannot have a service-related disability that you receive a check for. You have to have non-service-related medical conditions that require you to need assistance with ADL's. Your income has to be Social Security only or low income. This benefit is income driven.

    Can we talk about “housebound benefits “ the VA is so corrupt they will sit here and deny aid and attendance but won’t tell you about “housebound benefits “

      @@CCK_Law it’s sad a civilian law firm knows more about this then the va …. I was denied aid and attendance before I even submitted the paperwork yet no one suggested housebound ,,, the VA is corrupt trash ,,
